I, William B. Goetz, III, the undersigned (and if they be more
than one, jointly or severally), for consideration received,
promise to pay to the order of Jennifer G. Retallack, the sum of
Two-hundred fifty thousand DOLLARS, ($250,000.00) in lawful money
of the United States of America, said amount payable as follows:
Upon Demand.
AND FURTHER, I do hereby authorize and empower any attorney
of any Court of Record of Pennsylvania to appear for and enter
judgment against me for the above sum, with or without
declaration, with costs of suit, release of errors and without
stay of execution. I also waive the right to inquisition on any
real estate that may be levied upon to collect this note, and do
hereby voluntarily condemn the same, and authorize the
Prothonotary to enter upon the writ of execution said voluntary
condemnation; and do hereby waive and release all relief from any
and all appraisement, stay of execution or exemption or
bankruptcy laws, of this or any other state, now in force or
hereafter to be passed.
If this Note is placed in the hands of an attorney for
collection, the undersigned agree(s) to pay as a reasonable
attorney's fee ten percent (10%) of the amount due and owing on
this Judgment Note.

POSTPONEMENT AGREEMENT
THIS instrument is made on the /~' day of ~4~u~.~6'P/r.- , 2004 and
pertains to the Judgment filed on April 25, 1995 by Jennifer G. Retallack against William B.
Goetz, III in the amount of $250,000.00.
SAID judgment is recorded in the Office of the Prothonotary of Cumberland County,
Pennsylvania at Case No. 1995-02083. It is hereby agreed that the lien of said Judgment shall be
subordinate and junior in priority to the lien of the mortgage executed and delivered on
/ol-o2-o~ by William B. Goetz, III as Mortgagor to CENTEX HOME
EQUITY as the Mortgagee in the principal amount of ,$ ,:D? 9: q ~/, 70 in first position.
Said Mortgage having been recorded in Cmnberland County Recorder of Deeds on
/~ -[0' ~t.p~ in Mortgage Book Volume/~ 90., Page ~0
THIS legal description of the property which is the subject matter of this Agreement is attached
hereto, made a part hereof, incorporated herein by reference as "Exhibit A."
