STIPULATION AGAINST LIENS
THIS AGREEMENT made the )5/~ day of April, 1996, by and
between DARWYN L. BLACK, BUILDER, of 646 Lindsey Road, Carlisle,
Pennsylvania, hereinafter referred to as CONTRACTOR,
and
PATRICK K. WALKER and TERRY E. WALKER, husband and wife, of 41
Broad Street, Newville, PA 17241, hereinafter referred to ae
OWNERS, whereby the former undertook and agreed to erect and
construct improvements to a dwelling house on the certain lot of
ground situate in Penn Township, Cumberland County, Pennsylvania,
more fully bounded and described on the attached Exhibit "A".
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
CONTRACTOR, for and in consideration of the sum of It 1.00)
Dollar to him in hand paid by OWNERS, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for himself and his subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by hi.
or them against the said buildings and the lot of ground
appurtenant thereto for or on account of any work done or
materials furnished by him or them under aaid contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said CONTRACTOR, for himself, his subcontractors and
others under him hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or clai.s
against the said real estate and/or buildings or any of the., and
agree that this instrument, waiVing the right of lien, shall be
an independent covenant.

described in accordance with the Final Subdivi.ion Plan
of Hount Rock Hanor, prepared by Eric L. Diffenbaugh,
Professional Land Surveyor, which Subdivision Plan ha.

BEGINNING at a railroad spike in the centerline of
public road known and designated as Hount Rock Road at
common corner of Lot No. 16 and Lot No.7; thence along
common boundary line of Lot No. 16 and Lot No. 7 and
Lot No. 16 and Lot No. 16, North thirty-five (36)
degrees fifty-six (66) minutes twenty-eight (28)
seconds East, seven hundred twenty-three and nine
hundredths (723.09) feet to an iron pin in line of land
now or formerly of Robert A. Suloman; thence along line
of land now or formerly of Robert A. Suloman, South
sixty (60) degrees thirty-three (33) minutes ten (10)
seconds East, two hundred ninety-five and fifty-three
hundredths (296.63) feet to a concrete monument; thence
continuing along same, North eighty-three (83) degree.

thirty-three (33) minutes ten (10) seconds West, five
hundred one and seventy-two hundredths (601.72) feet to
an iron pin; thence continuing along line of Lot No.8,
South thirty-five (36) degrees fifty-six (66) minutes
twenty-eight (28) seconds West, four hundred ninety-
five and fifty hundredths (496.60) feet to a railroad
spike in the centerline of Hount Rock Road; thence
along centerline of Hount Rock Road, North fifty-four
(64) degrees seven (07) minutes fifty-seven (67)
secondo West, forty-two and eleven hundredths (42.11)
feet to a railroad spike; thence continuing by same,
North fifty-three (63) degrees fifty-eight (68) minutes
thirty-five (36) seconds West, seven and eighty-nine
hundredths (7.89) feet to the point and place of
BEGINNING. CONTAINING 3.3392 acres, more or less, in
accordance with the subdivision plan referred to above.
