be extended beyond its original expiration date if the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff.
7. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. 66113i ii) a private criminal complaint under 23
Pa.C.S. 66113.1j iii) a charge of indirect criminal contempt
under 23 Pa.C.S. 66114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00; and iv) civil contempt
under 23 ~a.b.S. 66114.1. Resumption of c~~residence on the part
of the plaintiff and defendant shall not nullifY the provisions
of the court order.
8. The Newville and Pennsylvania State police Departments
ahall be provided with certified copies of this Order by the
plaintiff's attorney and may enforce this Order by arrest for
indirect criminal contempt without warrant upon probable cause
that this Order has been violated, whether or not the violation
is committed in the presence of a police officer. In the event
that an arrest is made under this section, the defendant shall be
taken without unnecessary delay before the court that issued the
order. When that court is unavailable, the defendant shall be
taken before the appropriate district Justice. (23 Pa.C.S. 6
6113) .

ACT, 23 P.S. 8 6101 et seq.
A. ABUSE
1. The plaintiff, Kimberly J. Frye, is an adult Individual residing at
37 Rays Drive, Newville, Cuaberland County, Pennsylvania 17241.
2. The defendant, Gresory T. Frye, (SSN: 213-02-B9371IDate of Birth:
October 14, 1966), is an adult individual residins at 37 Rays Drive, Newville,
Cuaber!and County, Pennsylvania, 17241.
3. The defendant is the husband of the plaintiff and the father of the
parties' son, Dustan Riley Frye.
4. Since approxiaately August, 1994, the defendant has attempted to
cause and has intentionally, knowinsly, or recklessly caused bodily injury to ths
OIlaintHf, has placed the plaintiff in reasonable fear of imminent serious bodily
injury, and has knowinsly engaged in a course of conduct or repeatedly coamitted
acts toward the plaintiff, under circumstances which have placed the plaintiff
in reasonable fear of bodily injury. This hss Included, but is not iimited to,
the following specific instances of abuse:
a. On or about April 25, 1995, the defendant threatened to kill
the plaintiff. The plaintiff feared for her safety.
b. On or about February 20 I 1995, the defendant Ilrabbed the
diaper ball the plaintiff wos unpBcklng, threw it at the nishtstand
causing the laap to Call to the Cloor, picked up a crock and
threatened the plainti cr saying, "Don't you know I can hi t you in
the head with this and kill you." The deCendant pushed the
plaintiff backward onto the bed, pinned her arllls down and choked
her. The plaintiCC got away Crolll the deCendant and ran to a
neighbor's ho.e. Plaintiff was afraid to call the police because
the defendant threatened to kill her if she did.
c. On or about December 15, '1994, the defendant pushed the
plaintiff backward causing her to Call into the bathtub and hit her
head. After the defendant left the bathroom, she went into the
living roo. where the defendant pushed her about, yelled at her,
pushed her to the Cloor and kicked her in the abdomen. The
plaintiff feared for her safety.
d. On or about August 9, 1994, when the plaintiff was recovering
frOB a cesarean section, the defendant hit the plaintiff in the
head, grabbed the telephoned CroD her, and broke the antenna off of
the telephone when the plaintiff tried to call the police. The
plaintiff went into the kitchen and used the telephone to call 911
as the defendant Collowed her and threatened I "You'd better not be
call 911, you bi tch." and yanked the telephone Crolll the wall. The
plalntifC Cled to a neighbor's home where she called 911 agaIn and
was told that the pollce were on their way to her hOllle. When the
Pennsylvania State Police arrived they eacorted the deCendant Crolll
the premises, but he returned an hour later.
e. Since approximately August 1994, the defendant has abused the
plaIntiff in ways including, but not lImited to pushing, grabbing,
restraining, choking, slapping, and pulling her hair. On a regular
basis the defendant threatens the plaintiff's life saying, "Don't
think I won't kill you j I'll only serve B years and I'll ,et out."
"You're gonna be the next Nicole Sillpson casej she deserved to be
stabbed to death." "You can't do anything to .e because I don't ever
lesve any .arks on you i I don't use IIY fists." The defendant
intimidates the plaintiff by punching walls, &lUlling doors, and
throwing household items causing the. to break.
5. The plaintiff believes and therefore avers that she i8 in i..ediate
and present danger of abuse from the defendant and that she is in need of
protection froll such abuse.
6. The plaintiff desires that the defendant be enjoined fro. harassing
and stalking the plaintiff, and froll harassing the plaintiff's relatives.
7. The plaintiff desires that the defendant be enjoined froa re.oving,
da.agine, destroying or selling any property owned Jointly by the parties or
owned solely by the plaintiff.

B. The plaintiff asks that the defendant be ordered to pay reasonable
attorney fees to Legal Services, Inc.
WHEREFORE, pursuant to the provisions of the "Protection froll Abuse Act"
of October 7, 1976,23 P.S. g 6101 ~ ~., as B1Dended, the plaintiff prays this
Honorable Court to grant the following relief:
A. Grant a Temporary Order pursuant to the "Protection from Abuse
Act:"
1. Ordering the defendant to refrain from abusing the
plaintiff and/or placing her In fear of abusej
2. Ordering the defendant to refrain from harl!.Bsing the
plaintiff and from harassing the plaintiff's relatives, and
3. Prohibiting the defendant fro. removing, damaging,
destroying or sellIng property jointly owned by the parties or
owned solely by the plaintiff.
B. Schedule a hearing in accordance with the provisions of the
"Protection fro. Abuse Act," and, sfter such hearing, enter an order to be in
effect for a period of one year:

AND NOW, this If}" day of July, 1996, upon consideration of
the Consent Agreement of the parties, the following Order is
entered:
1. The defendant, Gregory T. Frye, is enjoined from
physically abusing the plaintiff, Kimberly J. Frye, or from
placing her in fear of abuse.
2. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relatives.
3. The defendant is prohibited from removing, damaging,
destroying or selling any property owned by the plaintiff or
jointly owned by the parties.
4. The defendant is ordered to reimburse the plaintiff for
the repairs or replacement of the storm door which was damaged on
or about July I, 1996, within ten days after she presents the

be extended beyond its original expiration date if the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice thut indicates continued
risk of harm to the plaintiff.
7. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. g6113i ii) a private criminal complaint' under 23
Pa.C.S. g6113.1i iii) a charge of indirect criminal contempt
under 23 Pa.C.S. g6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,OOO.00j and iv) civil contempt
u!,\der 23Pa. C. S. g6114. 1. Resumption of co:'residence on the part
of the plaintiff and defendant shall not nullifY the provisions
of the court order.
8. The Newville and Pennsylvania state police Departments
shall be provided with certified copies of this Order by the
plaintiff's attorney and may enforce this Order by arrest for
indirect criminal contempt without warrant upon probable cause
that this Order has been violated, whether or not the violation
is committed in the presence of a police officer. In the event
that an arrest is made under this section, the defendant shall be
taken without unnecessary delay before the court that issued the
order. When that court is unavailable, the defendant shall be
taken before the appropriate district justice. (23 Pa.C.S. g
6113) .

Dear Jim:
Ms. Frye recently contacted our office regarding Mr. Frye's
refusal to pay for the storm door which was damaged on or about
. July I, 1996, and which he agreed to replace in the Consent
Agreement dated July 19, 1996, which was entered as an Order of
Court. I am enclosing a copy of the estimate for the replacement
of this door.
Ms. Frye presented your client with a copy of the estimate,
and he has not paid for the replacement of the door within ten
days pursuant to the court's order.
If we do not receive payment by October 7, 1996, we will
advise our client that she has the right to file a Petition for
Contempt to enforce the Order.

having been called for hearing, fOllowing a conference with
counsel in chambers, the Protection Order of July 19, 1996, is
modified as follows I
1. The Protection Order of July 19, 1996, is
extended such that it remains in effect through July 30, 1998,
said Order being incorporated herein by reference.
2. The Defendant, Gregory T. Prye, is enjoined
from having any direct or indirect contact with the Plaintiff,
including, but not limited to, telephone and written
communications, except written communications regarding custody.
3. Crystal Robinson or any other adult agreed
upon by the parties shall facilitate custody arrangements,
inclUding picking up and returning the child at the Plaintiff's
residence or any other place mutually agreed upon by the
parties.
4. Thie Order can be extended beyond its original
date if the Court finds that the Defendant has committed another
act of abuse or has engaged in a pattern or practice that
indicates continued risk of harm to the Plaintiff.
5. A violation of this Order may eubject the
Defendant to arrest under 23 Pa, C.S. Section 6113 and 6114,
which is puniShable by imprieonment and/or a fine and civil
