SEPARATION AND PROPERTY SE'ITLEMENT AGREEMENT
TillS AGREEMENT Mnde lhis 1. ~ day of -bJove-...CJ~. 1995, by nnd between
KAREN S. GARVEY (hereinnfter referred to as WIFE) and PATRICK W. GARVEY (hereinafter
referred to as HUSBAND);
WITNESSETH:
WHEREAS, the pnrties hereto were nmrried on Augusl26, 1994. in Frederick. Maryland; have
been nnd arc HUSBAND nnd WIFE: and as a result of this union. one child wns born to wit: ALYSSA
DESIREA GARVEY. born September 9. 1992. hereafter referred to as the "child."
WHEREAS, diverse, unhappy differences, disputes and difficulties have arisen between the
panics and it is the intention of WIFE and HUSBAND to live separate and apart for the rest of their
nntural lives, nnd the parties hereto are desirous of settling fully and finally their respective financial
and property rights and obligations as be1ween ench olher, including. Wi1hou1limi1ation by specification;
the settling of all matters between them relating to the ownership and equitable distribution of real and
personal property; settling of all matters between them relating to the pas1, presen1 and future suppor1
and/or maintenance of the WIFE, the settling of any and all claims and possible claims by one ngains1
the other or agains1their respective estate.
NOW, THEREFORE, in consideration of the premises and of the mutunl promises. covennnts
and undertnkings hereinnfter set forth nnd for other good and valuable consideralion. receip1 of which
is hereby acknowledged by each of the parties hereto, WIFE and HUSBAND. ench intending to be
legnlly bound, hereby covennnt nnd ngree ns follows:
1. AGREEMENT NOT A BAR TO DIVORCE PROCEEDINGS: This Agreement shnll not
he considered to nffect or har the righ1 of WIFE or HUSBAND to a limited or absolute divorce on
Inwful grounds as such grounds now exist or shall hereafter exist or to such defense as may be available

to either party. This Agreemelll is not inlended 10 condone and shallmll be deemed to be a condonation
on Ihe pari of either party hereto of any act or acls on the part of Ihe olher party which have occurred
prior to Ihe date hereof. The parties intend 10 secure a mutual consclll divorce.
2. EFFECT OF DIVORCE DECREE: The parties agree Ihat unless otherwise specifically
provided herein, this Agreemelll shall cOlllinue in full force and effect ai'ler such time as a final decree
in divorce may be elllered with respect to the parties.
3. AGREEMENT TO BE INCORPORATED IN DIVORCE DECIH~E: The parties agree that
Ihe terms of this Agreemelll shall he incorporaled into any divorce decree which may be elllered with
respecI 10 them.
4. SEPARATION: It shall he lawful for each party at all limes hereafter 10 live separale and
apart fromlhe other party as such place as he or she may from time 10 lime choose or deem til. The
foregoing provisions shall not he taken as an admission on the part of either party of Ibe lawfulness or
unlawfulness of Ihe causes leading to their living apart.
5. INTERFERENCE: Each party shall he free from illlerference, authority. and cOlllact by the
olher, as fully as if he or she were single and unmarried except as may be necessary to carry oU1the
provisions of this Agreement. Neilher party shall molest the olher or allemplto endeavor to molestlhe
olher. nor compellhe other 10 cohubit with Ihe olher, or in any way harass or malign the olher. nor in
any way illlerfere with Ihe peaceful existence, separate and apart from Ihe other.
6. WIFE'S DEBTS: WIFE represellls and wnrrallls 10 HUSBAND Ihm since Ihe parties'
separation, she has not and in Ihe future she will not colllrael or incur any debt or liability for which
HUSBAND or his eSllIle mighl be responsible and shall indemnify and save harmless HUSBAND from
any and all claims or demands made againsl him by reasons of debts or obligatiolls incurred by her.
7. HUSBAND'S DEBTS: HUSBAND represellls and warrallls 10 WIFE Ihal since Ihe panics'
separation he has not and in Ihe future he will not colllract or incur any dehtor Iiabilily lilr which WIFE
or her estate mighl be responsible and shall indemnify and save harmless WIFE from any and all claims
or demands made against her by reason of debts or obligations incurred hy him.
8. MUTUAL RELEASE: Suhjectlothe provisions of this Agreemelll. each pany Ims releiLsed
and discharged, and hy this Agreemenl docs for himself or herself and his l'r her heirs. legal
represelllatives, executors, administrators and assigns, release and discharge the other of 11l1d from all
causes of action, claims, rights. or demands. whatsoever in law or cquity. which either of Ihe panics
ever had or now has against the other. except any or all cause or causes of aClion for divorce and except
any or all causes of action from breach of any provisions of this Agreement.
9. DIVISION OF PERSONAl. PROPERTY:
(a) The panics have heretofore divided thcir personal propeny to their mutual salisfaclion.
Ilenceforlh. each of the panics shall own, have and enjoy. independelllly of any claim of righ1 of the
other pany. all items of personal propeny of every kind, nalurc and description and wheresoever
situated. which arc now owned or held by or which may hercafter helong 10 the HUSBAND or WIFE
rcspectfully. with full power 10 the HUSBAND or thc WIFE to dispose of same as fully and effectually,
in all respccts and for all purposes as if he or she were unmarried. All ilcms of personal properly shall
be divided hetween thc parties as pruvided herein:
(h) Personal Effects: All itcms of personal effeCls such as, hU1 nOI Iimitcd 10: jewelry.
luggage. spons equipmclII, hohhy collections and hooks, hut nOI including furniture or any properly,
personal or lllherwise specifically disposed of pursualllto Ihis agrecmelll. shall becomc the absolule and
solc propCrlY of Ihat pany who has had Ihe principal use Ihcreof or 10 whom Ihe properly was given

or for whom it was purchased. lInd elleh party hereby surrenders lIny interest he or she may hllve in any
sueh tangible personal property of the other.
(c) IIll1lngible I'ersonllll'roperty (other than Life Insurance): All stocks, bonds. cllsh, lInd
sums on deposit in checking lInd sllving lICCOUIllS (owned hy either or both pllrties) have been or will
be divided to the mutual slltisfllction of the pllnies.
(d) lIusbllnd's Retirement Benefits: The pllrties recognizc tlmt IIUSBAND's retiremelll
benefits through his employmen111re mllrital assels. The reliremenlllccoulllllnd pension hllve no1 ves1ed
m the dme of execution of 1his lIgreement. The WI FE hereby waives lIny lInd all rights Ihm she hlls to
sueh retiremelll benefits.
(e) Molor Vehicles: The Pllrties' 1980 cadillac which is unencumbered liS well as their
1993 Ford Escort which is currelllly encumbered shllll be the properly of the IIUSBAND. IIUSBAND
shllll be responsible for the car loan associated with the 1993 Ford Escort. HUSBAND shall indemnify
and hold hllrmless the WIFE from lInd alllillbility lIrising from his fllilure to satisfy said car loan. The
panies agree to execute any lInd 1I11 documellls necessary to transfer title of both vehicles to 1he
IIUSBAND.
(I) Furniture and other Tangible Property: All furniture lInd other tllngible personal
property not disposed of pursualll to olher paragraphs of this lIgreemelll shall be the property of the
IIUSBAND.
(g) Debts: The IIlJSBAND shllll be responsible for 1I11 exis1ing joint debts lInd liabili1ies
incllrred by the parties prior to their separation except as olherwise provided herein. The HUSBAND
shall also be responsible for 1I11 cxisting debts and liabilities incurred in his own name prior to the
sepllration. The WIFE shllll he responsible for 1I11 existing debls lInd Iillbililies incurred in her own
nllmc prior III the separation.

(h) The parties further ilgree that neither will incur any future debts for which the OIher
may be held liable, und if either party incurs u debt for which the other will be liuble, that purty
incurring such debt will hold the other 11lIrmless from any and all liability thereon.
10. ArTER ACOUIRED PERSONAl. PROPERTY: Each of the parties shull hereafter own und
enjoy. independelllly of uny c1uims or right of the other. ull items of personal property. tangible or
illlangible. hereafter ucquired by him or her, with full power in him or her III dispose of the same as
fully and effectively, in all respect and for all purposes. us though he or she were unmarried.
II. CUSTODY: Primary physical custody of the child shall be with the WIFE. Visitation shall
be as agreed upon by the parties. The parties shall share legal custody of the child.
12. COUNSEl. rEES: Each party shall pay his or her counsel fees and expenses.
13. DIVORCE: The parties herelo agree to elller illlo a mutual conselll divorce. HUSBAND
agrees to pursue the divorce and to be the Plaillliff therein. WIFE agrees to sign the necessary
documellls, including an Affidavit of Conselll and further instruments that may be reasonably required
to give full force and effecllO the provisions of this Agreemelll.
14. WAIVER or CLAIMS: Except as herein otherwise provided. each party may dispose of
his or her property in any way, and each party hereby wuives and relinquishes any and all rights he or
she shall now have or hereafter acquire. under the prescnlor future laws of any jurisdiction. to share
in the property or the estate of 1he other as a result of the marital relationship, including without
limitation. dower, courtesy. statutory allowance, widow's allowance. right to take in illlestacy. righ1to
take against the Will of the other, and right to act as administrator or execulor of 1he olher's estate, and
each will, at the request of the other. execute, acknowledge and deliver any and all instrumellls which
may be necessary or advisable to carry illlo effect lhis mutual waiver and rclinquishmelllof all such
illlerests, righls and claims.

15. BREAClI: If either pany breacbes lIny provision of Ihis Agreement, Ihe U1her pliny shall
hllve Ihe righl. at his or her c1eetion. to sue lilr dllmllges for such brellch or seck sucb olher remedies
or relief liS may be aVllilable to him or her. lInd Ihe pliny brellching Ihis cOlllrllCI shall be responsible
for pllyment of leglll fees and COSIS incurred by the olher in entilrcing their rigllls under Ihis Agreemenl.
16. VOID CLAlJSES: If any lerm. condilion. clause or provision of this Agreemelll shllll be
delermined or declared to be void or invalid in law or olherwise. then only Ihllllerm. condition, c1l1use
or provision shall be stricken from this Agreemelllllnd in 1I11other respects this lIgreemelll shall he valid
lInd continue in full liJrce, effect and operation.
17. DESCRIPTIVE JlEADINGS: The descriptive headings used herein lire for convenience
only. Thcy shall have no effcct whatsoever in delermining Ihe righls or obligations of Ihe panics.
18. INDEPENDENT SEPARATE COVENANTS: It is specifielllly understood and lIgreed by
and hetwcen Ihe panics herelo that each paragraph hereof slmll be deemed to be a separate alld
independenl covenalll and agrccmclll.
19. ADDITIONAL INSTRlJMENTS: Each of the panics shall fromtimc 10 lime. lit the requcst
of the other. execUlc, acknowledge lInd deliver to the other pany any and all funher instfUmellls that
may bc reasonable rcquired 10 give full tilrce lInd cffcct to Ihc provisions of this Agreemenl.
20. APPLICABLE LAW: This Agreemclll shllll he construed under the laws of the
Conllllonwellhh of Pcnnsylvllnia lInd more specilically under the Divorce Code of 1980.
21. AGREEMENT BINDING ON JlElRS: This Agreemelll shllll be hinding lInd shall inure to
Ihe hellenl of the pllnies hereto lInd lheir respective heirs. executors. lIdministralors, successors lInd
lIssigns.

23. MODIFICATION AND WAIVER: A modificmion or wilivcr ofilny ofthc provisions of this
Agrcemcnl shilll be cffcctivc only if madc in writing and execntcd wilh thc samc Iilrmality as Ihis
Agrccmclll. Thc litilurc of eilhcr party 10 insist upon strict pcrformancc of any of thc provisions of this
Agrccmcnl shallnol bc conslrucd as a waiver of any subscqucnl dctilult of Ihc same or similar naturc.
24. WAIVER OF RIGIlTS: Thc partics hcrcto have bccn informcd of thcir righls or hilvc bccn
adviscd 10 scck counscllO inform thcm of thcir rights undcr and pursuanl 10 Ihc Divorcc Codc, ACI of
April 2, 1980, Numbcr 1980-26, pilrticularly Ihc provisions for alimony, illimony pcndclllc litc,
cquitilblc distribulion of maritill propcrty, counsel fccs or cxpcnscs. BOlh partics agrcc Ibal this
Agrccmclll shall conclusivcly provide for thc dislribution of propcrty undcr tbc said law and hcrcby
