The Agreement provided that settlement was to occur on or before April 30, 1995. 6. All contingencies under the Agreement were satisfied. 7. In anticipation of the sale of the Property to the Defendant, the Plaintiffs moved from the Property to a new residence. 8. The time and place for final settlement was fixed in accordance with the provisions of the Agreement as April 28, 1995, at the offices of Broujos, Gilroy & Houston, 4 N. Hanover street, Carlisle, Pennsylvania 17013. Notice of the time and place of settlement was given to Defendant through her attorney. 9. The Defendant failed to appear at the time and place fixed for settlement, or to pay the balance of the purchase price, in breach of her obligations under the Agreement. 10. Under the Agreement, paragraph 14 (c), the Defendant waived formal tender of a Deed. 11. Following the Defendant's breach of the Agreement, Plaintiffs sold the Property on October 31, 1995, to another buyer at a price of Ninety Seven Thousand and 00/100 ($97,000.00) Dollars. 12. In order to consummate the actual sale, the Plaintiffs were required to pay Three thousand Dollars ($3,000.00) towards the actual buyer's settlement costs. 13. As a consequence of the Defendant's breach of the Agreement, the Plaintiffs incurred additional expenses in continuing to own the Property until its sale, including utility bills, real estate taxes, casualty insurance, maintenance costs, and mortgage interest expenses. As a consequence of the Defendant's breach of the Agreement, the Plaintiffs suffered damages of $15,407.38, as follows: $6,000.00--difference between actual sales price and price under the Agreement; $3,000.00- -settlement costs paid by the Plaintiffs on behalf of the actual buyer; $3,208.91--additional interest expenses incurred by the plaintiffs from the time of the Defendant's breach until the actual sale; $517.16 --expenses of maintaining the Property from the time of the Defendant's breach until the actual sale; $506.31 --additional real estate taxes on the Property from the time of the Defendant's breach until the actual sale; $175.00 --attorneys fees incurred for the cancelled settlement. $2.000.00- -attorneys fees estimated to litigate this matter. $15,407.38 WHEREFORE, Plaintiffs demand judgment against Defendant for the sum of $15,407.38, together with interest and costs of suit and such other relief as this Court deems just and appropriate, a sum that does not exceed the jurisdictional amount requiring arbitration referral by Cumberland County Rule 1301-1.
