Funck and Jean S. Funck, parents and natural guardians of Scott S. Funck, a minor, by and through their counsel, Goldberg, Katzman & Shipman, P.C., who file this Joint Petition for Approval of a Compromise Settlement, a Minor's Action, by respectfully stating the following: 1. Scott Funck, born on March 6, 1991, is a minor who currently resides with his parents, Steven S. Funck and Jean S. Funck, at 170 Winding Hill Drive, Etters, York County, Pennsylvania, 17319. 2. The Defendant is an adult individual who has a last known address of 418A Herman Avenue, Lemoyne, Cumberland County, Pennsylvania, 17043. 3. Defendant is insured by the Erie Insurance Group. 4. On February 13, 1997, Defendant and Steven S. Funck were involved in an automobile accident which occurred on State Route 944 (Enola Drive), East Pennsboro Township, Cumberland County, Pennsylvania. 5. The minor, Scott Funck, was a passenger in his father's automobile. 6. Scott Funck allegedly sustained a laceration to his tongue as well as a laceration paralleling his lower lip between the tip of his jaw and lower lip. 7. Scott Funck has received medical attention, and the medical bills have been paid for the treatment rendered. 8. At this point, Scott Funck has been released from any doctor's care with regard to his alleged injuries. Records of his care with Dr. Lawrence K. Thompson, III, are attached as Exhibit "A." 9. Steven Funck has negotiated with the Erie Insurance Group to obtain a settlement on behalf of his son in this matter. 10. Steven S. Funck and Jean S. Funck have agreed to accept a payment of $15,000 to resolve this matter on behalf of their minor son, Scott S. Funck. They believe the settlement to be fair and in the best interest of their son, Scott S. Funck. 11. The $15,000 will be structured, and the guaranteed payment will by $23,737. A copy of the cost summary is attached hereto as Exhibit "B". 12. Steven S. Funck and Jean S. Funck have not incurred any expenses with regard to this litigation, and there will be no funds expended for attorney's fees. 13. There are no out-of-pocket medical expenses.
