MEMORANDUM OPINION AND ORDER OF COURT
Two motions are presently before the courtl th~ motion of
plaintiff, Larry Bugene Keefer (Keeferl, to amend the complaint
and the motion of defendant, Jaime M. Keating, Bsq. (Attorney
Keatingl, for summary judgment.
Keefer is currently incarcerated in a state correctional
institution. In the original complaint, filed May 4, 1995,
Keefer stated causes of action against several dsfendants
sounding in false imprisonment, assault and battery, and
infringements of his constitutional rights. Attorney Keating has
answered the complaint and filed new matter. There has been no
response to the new matter. Attorney Keating has also filed a
motion for summary judgment. Defendants the Ilonorable Edgar U.
Bayley and H. Anthony Adams, Esq. (Attorney Adams), have filed
preliminary objections to the complaint.
Recently, with no regard to the aforementioned outstanding
matters, Keefer attumpted to liet this matter tor the next civil

when used with respect to a document means to state the date,

identify its last known custodian and location.
