In support of its application, MPJV states: (1) Paul Williamson ("Williamson") is a witness in the underlying civil matter pending in the circuit Court of Cook county, Illinois entitled Midwesco-Paschen Joint Venture for the Vikinq proiects vs. IMO Industries. Inc. and Federal Insurance comoanv, docket no. 90 L 13444. (2) Williamson is a former employee of defendant, IMO Industries, Inc. ("IMO"). IMO has filed Williamson's affidavits in support of its motion for summary judgment on count II of its counterclaim. At all times herein mentioned, there was a building, front doorway entrance which was negligently maintained and would not open, rear doorway entrance, concrete deck and concrete walkway, chimney, egress, ingress, and walkway erected, paved, maintained, operated, owned, possessed and controlled by the Defendant, DIANE PERESIE, located at 410 South York street, in the Township of Mechanicsburg, county of Cumberland, Commonwealth of pennsy 1 van ia. 9. At all times herein mentioned, on or about March, 1993 the latch to the front door broke on the aforesaid premises thereby making the only means of egress and ingress by the rear doorway entrance. Plaintiff, DUANE E. MYERS, did report this to Defendant, DIANE PERESIE in March, 1993. 10. At all times herein mentioned, Defendant, DIANE PERESIE, entered into an agreement with Defendants, ERNEST F. ZIMMERMAN and KELLY T. ZIMMERMAN, individually and as owners and operators of ZIMMERMAN PLUMBING & HEATING, INC., to install a new water line on the property located at 410 South York street, in the Township of Mechanicsburg, county of cumberland, Commonwealth of Pennsylvania. II. At all times relevant hereto, Defendants EnNES'!, F. ZIMMEHMAN and KELLY '1'. ZIMMEHMAN, individually and "s owners and operators of ZIMMERMAN PLUMBING & HEATING, 3 INC., and Defendant ZIMMERMAN PLUMBING & HEATING, INC., through its agents, servants, workmen and employees were responsible for installing a new water line and refilling the dirt in the area located on the concrete walkway, side and rear of the property located in at 410 South York street, in the Township of Mechanicsburg, county of cumberland, Commonwealth of Pennsylvania. 12. At all times relevant hereto, Defendant, ERNEST F. ZIMMERMAN and KELLY T. ZIMMERMAN, Individually and as owners and operators of ZIMMERMAN PLUMBING & HEATING, INc. and Defendant ZIMMERMAN PLUMBING & HEATING, INC., through its agents, servants, workmen and employees began installing the new water line on said premises on or about April 30, 1993. 13. Failing to properly and adequately maintain the aforesaid area; c. Failing to properly and adequately inspect the aforesaid area to ascertain the existence of the defects and unsafe conditions therein; d. Failing to properly and adequately warn the Plaintiff of the dangerous conditions then and there existing; e. causing and/or permitting unsafe conditions and other dangers to become and remain in the aforesaid area; f. Failing to properly and adequately correct the dangerous and unsafe condition of the area; g. Failing to post signs, rope off unsafe area, or to insured the safety of Plaintiff; h. Failing to issue any warning, verbal, written, actual and/or constructive to Plaintiff of the dangerous condition which existed on the aforesaid premises and about the area of the Plaintiff's aforementioned accident; 6 ., i. Failure to comply with the UOCA code and other applicable local and state laws in reference to residential property; j. Failing to use due care under the circumstances; k. Being otherwise careless and negligent. 17. The Defendants' negligence, carelessness, recklessness and/or unlaWfulness also consisted of, but was not limited to, the following: a. Hired, employed and/or promoted the various agents, servants, workmen and/or employees who had the responsibility and obligation to properly inspect, maintain and clean the area of the aforementioned accident; b. Permitted the various agents, servants, workmen and/or employees who had the responsibility and obligation to inspect, maintain and/or clean the area of the aforementioned accident, to continue to work as agents, servants, workmen and/or employees, when said Defendants knew and/or should have known that said agents, servants, workmen and/or employees were unable to and/or incapable of properly performing the requirements 7 of their respective employment; and o. Failed to establish procedures and programs to determine whether employees and/or potential employeoa were and/or are fit and capable of properly performing the requirements of their respective employment; and d. otherwise wsre negligent, careless, reckless and/or unlawful under the circumstances in the hiring, employing and/ or promoting the various agents, servants, workmen and/or employees who were responsible and obligated to properly inspect, maintain and clean the area of the aforementioned accident. lB.
