upon consideration of the within complaint and upon motion of
DIANE G. RADCLIFF, ESQUIRE, attorney for plaintiff, DEBORAH S.
CARUSO, IT IS HEREBY ORDERED that a hearing is to be held on

L.M. in Courtroom No. n , Cumberland County Courthouoe,
Carlisle, Pennsylvania. The Defendant, JOHN J. CARUSO, shall
appear on that date at that time and place and preferably with
counsel representing him.
IT IS FURTHER ORD~RED that in the interim time between
now and the time set for the above-mentioned hearing thatl
(1) the Defendant is restrained and enjoined
from tlu"eatening to cause, attempting to cause or
intentionally, knowingly or recklessly causing any
abuse of the Plaintiff.
(2) the Defendant io restrained and enjoined
from having any contact with the Plaintiff and
entering the Plaintiff's place of employment, the
parties' residence located at 6Bl Deer Road, Boiling
Spdnqll, MOllI'oe Township, Cumberland County,
Pennsylvanill, or IIny other rceidence which Plaintiff
lIuy ent lib! ish for herllUlf, and shall not harass the
1'11l\nt Iff or the children.
Caruso born January 25, 1983; and Tracy Caruso born April 22,
1965.
6. The parties are the joint owners of an improved
tract of real estate known and numbered as 661 Deer Road,
Boiling Springe,
Monroe Township,
Cumberland County,
Pennsylvania, which has been utilized as the parties' marital
residence and the rssidence of their children for
approximately the last six (6) years.
7. The Plaintiff desiree to live ssparate and apart
from the Defendant because of the abuse perpetrated by the
Defendant upon the Plaintiff as hereafter eet forth.
6. The aforesaid abuse perpetrated by the Respondent
coneists of at leaet the following:
(a) On April 29, 1995, ths Defendant returned home
to the marital reeidence late in the afternoon after
drinking at the VFW. After he arrived home the Defendant
cornered the Plaintiff in the bathroom and refused to let
her pass, threatening her that he could have her killed
for $2,000.00. The Defendant also shouted obscenities
and describsd eexual intimacy in front of the parties'
children.
When the Plaintiff tried to get away the
Defendant hit the Plaintiff's hsad into the wall causing
a dent in the wall, grabbed her by her hair and threw her

that no one would want to look at her.
When the
Plaintiff attempted to call the police to get help, the
Defendant broke the telephone by throwing it at the
Plaintiff and told her that he would not allow her to
leave the marital home with the children.
(d) During the period from January 1995 to February
1995 the r~fendant came home and followed the Plaintiff
through the marital residence yelling at her. When the
Plaintiff tried to go to the bedroom and lock the door,
the Defendant kicked in the door breaking it so it would
not close. The Defendant then trapped the Plaintiff in
the bathroom, grabbed her arms and threatened to hurt her
if she did not behave as he wanted. He then pushed her
onto the bed, ripped off her nightgown and tore off her
underwear before leaving her alone.
(e) During the period from January 1995 to February
1995, the Defendant returned to the marital home after
drinking and cornered the Plaintiff on the sofa and
required the parties' two youngest children to sit
together on a chair. The Defendant had the Plaintiff
pinned by her wrists on the sofa and yelled at her,
telling her he was going to pour gasoline on her and
light her on fire.
The Plaintiff reported this incident

to the police and left the marital residence for the
night with the parties' children.
(f) In February 1995, the Defendant slapped the
Plaintiff's face and kicked in the bedroom door.
(g) Over the past two years preceding 1995, on an
ongoing basis of at least aile time per month, the
Defendant would return to the marital residence drunk and
would grab and push the Plaintiff and threaten her with
tL'ouble at work.
(h) One time in the past two years the Dafendant
took out a knife and threatened the Plaintiff with it
which was witnessed by one of the parties' children.
(i) Earlier in the parties' marriage the Defendant
punched and slapped the Plaintiff with great frequency.
9. As a result of the aforesaid actions of the
Defendant, the Plaintiff has a reasonable fear for her safety
and needs the protection of the Court under the above-
captioned Act.
10. The Plaintiff and her children have no where els8 to
live other than the current residence located at 681 Deer
Road, Boiling Springs, Monroe 'fownship, Cumberland County,
Pennoylvania, and deoires that she be awarded exclulive

and excluded therefrom,

Plaintiff has no information of a custody proceeding
concerning the children pending in a court of this
conunonwealth.
plaintiff does not know of a person not a part to the
proceedings who has physical custody of the children or claims
to have custody or visitation rights with respect to the
children.
16. The best interest and permanent welfare of the
children will be served by granting the relief requeeted
because:
(a) The children want to live with the Plaintiff;
(b) The Plaintiff can provide the Children with a
safe and stable environment;
(c) The Defendant is abusive and is an alcoholic
and is incapable of providing the children with a good
home.
17. Each parent whose parental rights to the children
have not been terminated and the pereon who has physical
custody of the children have been named a part to this action.

b. On Tuesday evening, April 30, 1996, at approximately
6100 p.m., the Respondent entered the Petitioner's
residence, pinned her on the couch and threatened
her with a fire place poker informing her that if
she did not kill him he was going to kill her with
the poker.
c. On Wednesday evening, May 1, 1996, when the
petitioner returned to her residence with the
children, the Respondent, who had his car hidden
behind the house, approached the Petitioner's
vehicle and grabbed her through the open windowo
When the petitioner attempted to drive away he
grabbed her by the hair to prevent her from leaving
and then took her car keys, opened the car door and
then proceeded to pin her in the car. When a
neighbor showed up he released the Petitioner who
drove away and contacted the police who accompanied
her to her residellce. When the Petitioner arrived
at her residence she discovered the Respondent had
trashed the IIOIJHe by breakinfj several windows and a

Caruso born January 25, 1983; and Tracy Caruso born April 22,
1985.
6. The parties are the joint owners of an improved
tract of real estate known and numbered as 681 Deer Road,
Boiling Springs, Monroe Township,
Cumberland County,
Pennsylvania, which has been utilized as the parties' marital
residence and the residence of their children for
approximately the last six (6) years.
7. The Plaintiff desires to live separate and !Ipart
from the Defendant because of the abuse perpetrated by the
Defendant upon the Plaintiff as hereafter set forth.
8. The aforesaid abuse perpetrated by the Respondent
consists of at least the following:
(a) On April 29, 1995, the Defendant returned home
to the marital residence late in the afternoon after
drinking at the VFW. After he arrived home the Defendant
cornered the Plaintiff in the bathroom and refused to let
her pass" threatening her that he could have her killed
for $2,000.00. The Defendant also shouted obscenities
and described sexual intimacy in front of the parties'
children.

Defendant hit the Plaintiff's head into the wall causing
a dent in the wall, grabbed her by her hair and threw her

that no one would want to look at her.
When the
Plaintiff attempted to call the police to get help, the
Defendant broke the telephone by throwing it at the
Plaintiff and told her that he would not allow her to
leave the marital home with the children.
(d) During the period from January 1995 to February
1995 the Defendant came home and followed the Plaintiff
through the marital residence yelling at her. When the
Plaintiff tried to go to the bedroom and lock the door,
the Defendant kicked in the door breaking it so it would
not close. The Defendant then trapped the Plaintiff in
the bathroom, grabbed her arms and threatened to hurt her
if she did not behave as he wanted. He then pushed her
onto the bed, ripped off her nightgown and tore off her
underwear before leaving her alone.
(e) During the period from January 1995 to February
1995, the Defendant returned to the marital home after
drinking and cornered the Plaintiff on the sofa and
required the parties' two youngest children to sit
together on a chair. The Defendant had the Plaintiff
pinned by her wrists on the sofa and yelled at her,
tell ing her he was going to pour gasoline on hsr and

to the police and left the marital residence for the
night with the partiee' children.
(f) In February 1995, the Defendant elapped the
Plaintiff's face and kicked in the bedroom door.
(g) Over the past two years preceding 1995, on an
ongoing basis of at least one time per month, the
Defendant would return to the marital residence drunk and
would grab and push the Plaintiff and threaten her with
trouble at work.
(h) One time in the past two yeare the Defendant
took out a knife and threatened the Plaintiff with it
which was witnessed by one of the parties' children.
(i) Earlier in the parties' marriage the Defendant
punched and slapped the Plaintiff with great frequency.
9. As a result of the aforesaid actions of the
Defendant, the Plaintiff has a reasonable fear for her safety
and needs the protection of the Court under the above-
captioned Act.
10. The Plaintiff and her children have no where else to
live other than the current residence located at 681 Ileer
Road, Boiling Springs, Monroe '!'owllshlp, CUlllberlllnd Cuunty,
Pen'nsyl vania, and desires that aha be IlWlll ded exe had vo

concerning the custody of ths children in this or another
court.
Plaintiff has no information of a custody procseding
concerning the children pending in a court of this
conunonwealth.
Plaintiff does not know of a person not a part to the
proceedings who has physical custody of the children or claims
to have custody or visitation rights with respect to the
children.
16. The best interest and permanent welfare of the
children will be served by granting the relief requested
