Defendant's New Matter as follows:
[Plaintiff regards the material following
paragraph 7 in Defendant's "Answer to complaint" as New
Matter even though the document is not verified nor a
notice to plead provided.]
7. The alleged condition of the subject land waD tho result
of Defendant's private and individual transaction with the
"contractor" and not with Plaintiff. The "dumping site" occurred
by agreement between Plaintiff and the user of the subject land.
Plaintiff had no obligation to restore the pasture lot to any
prior condition, 'l~e condition of the subject land resulting
from Defendant's transactions with third parties is not a defenso
to Defendant's failure to pay the rent due l'lalntlff.

AND NOW, comes the TOWNSHIP OF SILVER SPRING by its
Attorneys, SNELBAKER & BRENNEMAN, P.c., and avers the following
cause of action against Defendant:
1. The Plaintiff herein is TOWNSHIP OF SILVER SPRING, a
municipal township of the second-01ass, having its office at 6475
Carlisle Pike, Mechaniosburg, Pennsylvania 17055.
2. The Defendant herein is RAY EARL KRAMER, an adult
individual, who resides at 264 Ridge lIi11 Road, Mechanicsburg
(Silver spring Township), Pennsylvania 17055.
3. Plaintiff is the owner of a tract of land containing
approximately 103 acres of land adjoining or near Defendant's
residenoe.
4. Defendant is a farmer.
5. On or about March 22, 1994, the parties agreed to a
verbal lease of a portion of Plaintiff's land containing 37
acres, whereby Plaintiff let and demised eaid 37 acres of land to
