P.C., who file this Complaint pursuant to Pa.R.C.P. 297l(al for a
Judgment by Confession in Ejectment and aver as follows.

The Plaintiffs are Gordon E. Smith and Jeannette M. Smith, adult
individuals, currently residing at 6 Adams Road, Carlisle,
Cumberland County, Pennsylvania.

The Defendants are Nicholas R. Vay and Mary C. Harvey, a/k/a Mary
n. Va" adult individuals, whoso Isst known addross Is P. O. Box
11444, MoLean, VA 22102.

Judgment hae not been entered on the attaohed inetrument in any
juriediotion.

The Defendants are in default under the attaohed instrument in that
they have failed to make monthly inetallment payments or other sums
of money when due.

On Haroh 23, 1995, the Plaintiffs' attorney, at their direotion,
mailed a written notice advising the Dsfendants that they were in
default in having failed to pay the following.
A. pa.t due installments for the month. of January, February,
Haroh, and April, 1995 in lhe Ilmount of $280.79 per month.
B. 1994-5 School Taxes, which are now delinquent.
Attached hereto and marked as Exhibit a is a copy of said letter.

Paragnph 2 of the attached lnstrument provides that monthly

Paragraph 11 of the attached instrument providee the following with
respect to what constitutes an event of default I
On default of payment of any monthly installment for B
period of 30 days or upon failure to correct the breach
of any other obligation under this Agreement within 30
daye after written notice from seller to purchaser, the
eeller may declare this Agreement to be ended, retaining
all paymente made to that time as liquidated damages, and
in such event, that the Prothonotary or any attorney ie
hereby authorized to appear for and to confess jUdgment
in an amicable action of ejectment against purchaeer, his
heirs, SUccessors, assigns, or lessees and in favor of
eeller, his heirs I euccessors or assigns for the premises
herein described and to direct the immediate issuing of
a Writ of POsseesion with Writ of Execution for costs,
without notice and without asking leave of court, and
with $300 added as a reasonable attorney fee...

The Defendants continue to be in default under the attached
instrument.

By reason of Defendants' default and pursuant to language in the
attached instrument, the Defendants have authorized any attorney to
appear for and to confess jUdgment in an amicable actirm of
ejectment against the Defendants.

WHEREFORE, PlaintiffB demand judgment in ejBctment for possession
of the above-deBcribed premises aB authorized by the warrant
appearing in the attached instrument.

We have, aqain, received a telephone call from Mr. Smith advising
that payments are now due for the months of January, FebruarYI and
March. We have also been advised that the 1994-1995 school taxes
ere delinquent. Please accept this notice as a notice of default
pursuant to the terms of the Installment Agreement of Sale. Your
failure to correct this breach within thirty (30) days of the date
of this notice will allow the Smiths to enter a judgment against
you by confession in an action of ejectment. This would mean, as
you have previously been advised, that you would lose your property
rights to the real estate. Your immediate attention to this matter
is neceseary.
