MARPOE. The plaintiff is represented by Joan Carey of LEGAL
SERVICES, INC.; the defendant is repreaented by Marcus A.
McKnight, 111, of Irwin, McKnight & Hughes, The partiea agree
that the following may be entered as an Order of Court.
1. The defendant, JOHN A. MARPOE, agreea to refrain from
abualng the plaintiff, HEATHER R. MARPOE, or placing her In fear
of abuse.
2, The defendant agrees not to have any direct or indirect
contact with ths plaint iff including, but not 1 imited to,
telephone and written communi cat ions, except for the limited
purpose of facilitating custody arrangements,
3. The defendant agrees not to harass and st~lk the
plaint iff and harass the plaint iff's relat ives,
4. The dafendant agrees not to enter th~ plaintiff's place
of employment.
5. The defendant agrees to stay aWAy from the plaintiff's

directed as followsl
1. A Hearing is scheduled in Courtroom No. of the cumberland
qount)( Courthouse on the ~ day of ,} , 1995, at
:00 M., at which time test~mony will be ta en in the above
case. At this Hearing, the Father, John A. Marpoe, Jr., shall
be the moving party and shall proceed initially with
testimony. Counsel for the parties shall file with the Court
and opposing counsel a Memorandum setting forth the history of
custody in this case, each party's respective position on
custody, a list of witnesses that will be called by that party
to testify at the Hearing along with a summary of the
anticipated testimony of each witness. This Memorandum shall
be filed at least ten days prior to the Hearing date.
2. Pending further Order of this Court, this Court's May 15,
1995, Order shall remain in effect subject to the following
modificationl
A. Paragraph 12 is modified to provide that Father shall
have an evening per week with the child from 5130 P.M.
until 8130 P.M. on every week. The day shall be
Tuesday unless agreed otherwise by the parties.

IN ACCORDANCE WITH CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report I
1. The pertinent information pertaining to the children who are
the subject of this litigation is as follows,
Zachary R. Marpoe, born June 28, 1990, and Jeremy J. Marpoe,
born December 8, 1992.
2. A Conciliation Conference was held on August 24, 1995, with
the following individuals in attendancel
The Mother, Heather R. Marpoe, with her counsel Richard L.
Webber, Jr., and the Father, John A. Marpoe, Jr., with his
counsel, Marcus A. McKnight, Esquire.
3. The parties separated in April. A Consent Agreement on
custody ~as ontered in May in conjunction with a protection
from abuse action. This was a temporary Custody Order which,
in essence, gave the Mother primary physical custody with the
Father having periods of temporary physical custody on
alternating weekendJ and periods of time in the summer and
other times.
4. Father now suggests that the older child is expressing an
interest to come to live with the Father. The Father is now
seeking primary physical custody of the minor children, but
indicated at the Conciliation Conference that a shared week
on week off arrangement may be workable. The Mother is
adverse to any significant change in the existing Order.
She exprosses concerns about the Father's work schedule and
how that would he handled in conjunction with the Father
having the children during the week. The parties were
unahle to reach all agreement and a I/oaring is necessary.
A }fearing should take no more than one day.

directed as follows, '
1. A Hearing is scheduled in 9.!?~rtroom No. 5: of the Cumberland
(}qR,Vnt:( Courthouse on the J.S.;!.; day of1)fCilYlher- , 1995, at
1~ JIf.M., at which timo tostlmony wilT'be taken in tho above
caso. At this Hearing, the Father, John A. Marpoe, Jr., shall
be the moving party and shall proceed initially with
testimony. Counsel for the parties shall file with the Court
and opposing counsel a Memorandum setting forth the history of
custody in this case, each party's respective position on
custody, a list of witnesses that will be called by that party
to testify at the Hearing along with a summary of the
anticipated testimony of each witness. This Memorandum shall
be filed at least ten days prior to the Hearing date.
2. Pending further Order of this Court, this Court's May 15,
1995, Order shall remain in effect subject to the following
modification:
A. Paragraph 12 is modified to provide that Father shall
have an evening per woek with the child from 5'30 P.M.
Until 8,30 P.M. on every week. The day shall be
Tuesday unless agreed otherwise by the parties.

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), tile undersigned Custody Conciliator submits the
following report:
The pertinent information pertaining to the children who are
the subject of this litigation is as follows:
Zaohary R. Marpoe, born June 28, 1990, and Jeremy J. Marpoe,
born Deoember B, 1992.
2. A Conciliation Conference was held on August 24, 1995, with
the following individuals in attendance,
1.
The Mother, Heather R. Marpoe, with her counsel Riohard L.
Webber, Jr., and the Father, John A. Marpoe, Jr., with his
counsel, Marcus A. McKnight, Esquire.
3. The parties separated in April. A Consent Agreement on
custody ~as entered in May in conjunction with a protection
from abuse action. This was a temporary Custody Order which,
in essence, gave the Mother primary physical custody with the
Father having periods of temporary physical custody on
alternating weekends and periods of time in the summer and
other times.
4.
Father now suggests that the older child is expressing an
interest to come to live with the Father. The Father is now
seeking primary physical custody of the minor children, but
indicated at the Conoiliation Conference that a shared week
on week off arrangement may be workable. The Mother is
adverse to any signifioant change in the existing Order.
She expresses conoerns about the Father's work schedule and
how that would be handled in conjunction with the Father
having the children during the week. The parties were
unable to reach an agreement and a Hearing is necessary.-
A Hearing should take no more tllan one day.

parent's care. Each parent shall notify the other immediately of
medical emergencies which arisa while the children are in that
parent's cftre.
8. The parties realize that their children's well being is
paramount to any differences they might hove between themselves.

may estrange the children from the other parent, or injure the
opinion of the children as to the other parent or which may
hamper the free and natural development of the children's love or

AND NOW, this 22nd day of June, 1995, upon
consideration of the complaint for indirect criminal contempt in
the above-captioned matter, and pursuant to an agreement of the
Commonwealth in the person of Will I. Gabig, Esquire, which is
acoeptable to the alleged victim in the case, and the Defendant
with his counsel, Marcus A. McKnight, III, Esquire, it is
ordered and directed that the trial in this matter shall be
continued for a period of six months conditioned upon the
Defendant's compliance with the Protection From Abuse Order as
heretofore entered. In the event that there is an alleged
violation of the order within that six month period, the
District Attorney is directed to list both this matter and that
matter for trial. In the event that there is no alleged
violation of the Order within such period, the complaint in this
matter shall be automatically dismissed without further order of
Court.

and consideration of the within Petition, and upon finding that
the plaintiff, HEATHER R. MARPOE, now residing at 450 S. Fayette
Street, Shippensburg, Cumberland County, PennsYlvania, is in
immediate and present danger of abuse from the defendant, JOHN A.
MARPOE, JR., the following Temporary Order is entered.
The defendant, JOHN A. MARPOE, JR., SSN: 204-48-1723 and
DOB: 10/13/65, now residing at 36 Thompson Creek Drive,
Shippensburg, Cumberland County, Pennsylvania, is hereby enjoined
from physically abusing the plaintiff, HEATHER R. MARPOE, or
placing her in fear of abuse.
The defendant is ordered to stay away from the plaintiff's
reeidence located at 450 S. Fayette Street, Shippensburg,
Cumberland County, Pennsylvania, a residence Which is owned by
the plaintiff's parents and to which the plaintiff moved to avoid
abuse.
The defendant is ordered to refrain from having any direct
or indirect contact with the plaint iff InclUding, but not limited
to, telephone and written communicat ions,
The defendant is enjoined from haraSSing and stalking the
plaintiff and from harassing the plaintiff's relatives.
The defsndant is enjoined from entering the plaintiff's
place of employment.
A violation of this Order may subject the defendant to: i)
arrest under 23 Pa. C.S. 66113: ii) a private criminal complaint
under 23 Pa. C.S. 66113.1: iii) a charge of indirect criminal
contempt under 23 Pa. C.S. 66114, punishable by imprisonment up
to six months and a fine of '100.00-'1.000.00; and iv) civil
contempt under 23 Pa. C.S. 66114.1. Resumption of co-residence
on the part of the plaintiff and defendant shall not nullify the
provisions of the court order.
This Order shall remain in effect until modified or
terminated by the Court after notice or hearing and, can be
extended beyond that time, if the Court finds that the defendant
has committed another act of abuse or has engaged in a pattern or
practice that indicates continued risk of harm to the plaintiff.
Temporary custody of ZACHARY and JEREMY MARPOE, is hereby
awarded to the plaintiff, HEATHER R. MARPOE.
This Order shall remain in effect until modified or
terminated by the court after notice or hearing. A hearing shall

The Court of common Pleas of Cumberland County is reQuired by law

a. On or about April 27,1995, the defendant grabbed
the plaintiff by the shoulders, violently shook her,
and threw her into the gun cabinet. The defendant then
grabbed the plaintiff by the wrists end pushed her
backward into the television, causing her to hit her
hip. Only when a neighbor heard the noise and yelled
in the window, did the defendant let the plaint i ff go.
Fearing for her safety, the plaintiff and her children
left the residence.
b. In or around March 15, 1995, the defendant came at
the plaintiff, causing her to back into the sink hit
her back and suffer pain,
c, In or around December 1994, the defendant shoved
the plaintiff with enough force to cause her to fall
onto ths coffee table.
d. Since 198a, the defendant has abused the plaintiff
In weys Including, but not I imited to, the following:
shoving, grabbing, restraining, choking, pulling hdir,
pinching, and scratching. On one occassion in 198a,
the defendant choked the plaintiff and beat her head on
the floor, causing her to have a concussion.
5, On or about April 27, 1995, the plainliff af1d the two
minor cllildren left their residence at 36 Thompson Creek Drive,
Shlppensburg, CllInberland County, Pennsylvflnie, in order to avoid
further abuse.
6. The plaintiff helleves and therefore fivers thnt she is
in immediate and prellunt danger of abuse from the defendent. and
that she is in need of proteclion from tiuch abuse.
7. The plaint iff desires thRt the defendanl be prohibited
from having any direct or indirect contact with lhe plaint iff

appropriate amount according to the support guidelines
payable to the plaintiff in the form of a check or
money order, mailed to her residence, and orderin~ the
defendant to provide health coverage to the children,
directing the defendant to pay all of the unreimbursed
medical expenses of the minor children of defendant to
the provider or to the plaintiff when she has peid for
the medical treatment.
8. Ordering the defendant to pay reasonable attorney
fees to Legal Services, Inc.
The plaint iff further asks that this Petition be filed and
served without pre-payment of fees by the plaintiff, and that
certified copies of this Petition and Order be delivered to the
Pennsylvania State and Mid-Cumberland Valley Regional Police
Departments who have jurisdiction to enforce this Order.

Jeremy's attention deficits appear to be tldVi!l'] dn inl~)acl un ills ability
to focus and retain skills from day to day. lie has difficulty sittillg still
and focusing (juring group activities. At times, he becomes very frustrated
and stops working. lie does better one- on -one, but even with reduced
distractions, his performance varies. Jeremy also appears tirert or sad at
times. Ilis classroom teacher has reported several instances of Jeremy
falling asleep in his room in the afternoons. Many mornings he has a
difficult time getting started 011 his work, and complains cf heing tired.

Jeremy is currently reading at an instructional level of ending pre-
primer. lie is making generally slow progress in reading skills. At the start
of the current school year ,it was necessary to repeat many of the basic
vocabulary and word attack skills taught last year. Even after 9 weeks of
re-teaching and practice, he has not re-couped all of the skills at
vocabulary he had at the end of last year. lIis performance can vary greatly
from day to day. lie has a great deal of difficulty recalling the basic sight
words at the emergent to first grade level. lie currently knows 54 of the 108
sight words from Primer to first grade. His immediate recall of words or a
patterned phrase from a previous page is very weak. He does have some esrly
reading strategies in place. He is able to use picture clues, and has good
one to one correspondence for words. He knows most of the letter names and
sounds, but, at times, still confuses the letters Iw/,/y/,/u/,/h/,/b/,/d/,
and Ig/. He attempts to use beginning Bounds to figure out unknown words
while checking the pictures to see what would make sense. Jeremy's
comprehension of read stories Is good. He is able to retell stories in the
correct sequence with accurate facts and details. When reading completely
independently, he loses focus and quickly becomes frustrated.

In writing, Jeremy Is able to respond to simple writing prompts or
questions with complete sentences. lie has difficulty organizln'l his thoughts

paper. He can self-edit for capitals and periods on hiB sentences but often

his need for perfect spelling slows Jeremy down with getting his ideas on

2. A Conciliation Conference was held on December 21, 2000, with the following individuals
in attcndance:
lbe Mother, Ilealher Cwnmlngs, who appeared withoUl counsel; and lhe Father. John A.
Mllrpoe, Jr., with his counsel, MllfCus A. McKnight, 111, Esquire.
3. TIlere is a prior Cuslody Order trom 1995 which provides MOlher having primary physical
custody of lhe minor children. Father now suggests the children want 10 come to live with
him and also suggesls lhal the situation in the Mother's home Is nol conducive for the
children. lbe MOlher is unwilling to rclinquish primary custody and suggests that the
CUITCnt situalion is satisfaclOry for the children. 'Ibe parties eannot reach an agreement and
