On December 5, 1989, Llcenee. filed en 8ppeal with the
Penn.ylvania Liquor Control Board (Board). By Opinion and Order with a
msilinl date of January 29, 1990, the Board affirmed the Order of the
Admlnlatrat; v. I,aw Judie and dilmlaeed 1,1 censee' s eppes!.
On F.bruary 16, 1990, Licensee filed an appeal to the Court of
Common Pleas of Cumberlend County, No, 631 Civil, 1990. On Hay 16,
1990, Juda' Bayley, ruver..d th. Board'. Order and remsnded tho case to
th. Adminlstratlv. Law Judie for impoaltlon of a penalty on the
controll.d substance violation based solely on the violation date of
July 30, 1988.
On June 6, 1990, the Bureau of Liquor Control Enforcement filed
an appeal with the Commonwealth Court of Penneylvania, Docket No. 1236
C. D, 1990. On ;'UIUS t I, 199 t, the Commonwea 1 th Conrt reversed the
Order of Common 1'1eu Court of Cumberland County and reinstated the
Order of the Penneylventa Liquor Control Boerd which revoked tbe
license with bond forfeiture,

On February 7, 1991, Licenll8e appealed to the Pennaylvania
Supreme Court, On November 16, 1993, the Supreme Court of
Pennsylvania, 84 Middle District Appeal Docket 1992, iuued an order
which reversed the decision of the Commonwealth Court snd remanded the
case for further proceedings not inconsistent with its Opinion.
CONCLUSION OF LAW I
Licensee, by servants, agents or employes, permitted the use of
their licensed premises in the furtherance of the traffic in, or use
of, a controlled substance, on July 16, 30, September 9, 17, October 8
and 15, 1988, in violation of the Liquor Code and the Pennsylvanie
Controlled Substance, Drug, Device and Cosmetic Act.

This proceeding ariaes out of a citation that was issued on
June 5, 1989, by the Bureau of Liquor Control Enforcement of the
Pennsylvania State police (hereinafter "Bureau") again.t James Hallios
fa Evdokia J. Hal1ios, t/a Paradiae Hotel, Licenee Number H-AP-4383
(hereinafter "Licaneee").
This citationl contains three (3) counts,

The fir.t count charges Licensee with a violation of Section
493(1) of the Liquor Code (47 P.S. 14-493(1)). The charge ia that
Llcenaee, by aervants, agents or employes, sold, furnished and/or gave
or permitted such sale, furnishing or giving of alcoholic beverages to
a levantean (17) year old male minor, on Februsry 17, 1989,
The second count charges Licensee with violations of Section 471
of the Liquor Code (47 P.5. 14-471) and Section 780-113(a)(30) of tbe

cocaine. (Stipulation No, 3, Commonwealth Exhibit No, C.4, N.T, 159),
39. On July 15, 1988, Officer Schonely and the informant entered
the premises at approximataly 11:10 p,m. (N.T, 29-30),
40. They were approached by Rich Archer who the Officer had met
at tho licensed premises on prior occasions, (N,T. 30),
41. Rich Archer osked if they wanted /lny "blow." He said it was
good "rock" and that he could get a one-half of a gram for $50.00, The
Officer gave $50.00 to the informant in the presence of Rich Archer and
one, Timothy Biggs. The informant, Rich Archer and Timothy 81us
departed the premises through the reer door (main entrance) of the
licensed premises. The subatance seized from this transaction was
datormined to contain cocaine. (N.T. 31, Stipulation No, 4,

door, between the bar and the dining area. (N.T. 32),

in the company of the informant. (N.T. 33).
44. The Officar was introduced to Bobby Bryant, A meeting
occurred at a table approximately seven feet from the north end of the
bar, (N.T. 33, Commonwealth Exhibit No, C-3, notation "table"),
45. The Officer noticed that there were lines of 0 white
powdered substance on the table. Bobby Bryont had 0 razor blade in his
hand. He had just gotten done cutting and making the lines of the
powdered substance on the table, He asked, "Hey, do YOII guys want to

coke1", meening marijuena or cocaine. The informnnt asked how much for
the "coke" to which Joe Wentz responded that it was S 100.00 per gram.

place. Joe Wentz said that he was going to the bethroom and that he
would be beck. lie went out of sight, in the area of the bathroom, end
returned about a minute later. Joe Went~ took a pink paper packet frem

informant S 100.00 who handed it to Joe Wentz in exchange for the

Please be advised that the undersigned has been retained by the Ohio Casualty Group in
connection with two hotel liquor bonds which have been paid to the Pennsylvania Liquor
Control Board as a rcsult of violations at your establishment, Paradise Hotel. The bonds were
for 52,000 each, for thc years ending January 31, 1989 and January 31, 1990, respectivcly.
Pursuant to the terms of the bonds, you are required to reimburse Ohio Casualty the
entire 54,000.
Please remit 54,000 to the undersigned in the form ofa cashier's check or money order,
payable to The Ohio Casualty Insurance Company within thirty (30) days of the date of this
letter. If you dispule the amount of this debt, nutify the undersigned within thil1y (30) days of
the date of this letter, and a verification of the amount of your debt will be mailed to you If you
