AND NOW, comes the Plaintiff, Michele M, Hiester, by and through her allomey,
Charles Rector, Esquire, and flies a Petition to Modify Order of Custody, and In support
thereof, avers the following:
1, Plaintiff 15 Michele M, Hiester, mother. who currently resides at 6403
Glenwood Street, Apt. #4, Mechanlcsburg, Cumberland County, Pennsylvania,
2. Defendanlls Andrew B, Hiester, Sr" father, who currently resides at 625
Pleasant View Road, Lewlsberry, Pennsylvania,
3. The parties hereto are the parents of the minor children Andrew B.
Hiester, Jr, (DOB 4/12/93) and Amanda E, Hiester (DOB 8/16/95) who currently reside
with mother, at 6403 Glenwood Street, Apt. 114, Mechanlcsburg. Pennsylvania.
4. On September 23, 1996, the parties entered Into a Separation and
Property Settlement Agreement which contains a custody provision providing for shared
legal and physical custody. A true and correct copy of the relevant portions of this
Agreement are marked Exhibit "A." attached hereto. and made part thereof,

This agreement made this 23rd of September 1996, by and between Michele
Marie Hiester of Dauphin County, Pennsylvania, party of the first part, hereafter referred to as
"Wife" and Andrew D, Hiester of Cumberland County. Pennsylvania 17112. party of the second
part, hereinafter referred to as "Husband",

WITNESSETH:
WHEREAS. Husband and Wife were married on July 8, 1989"
WHEREAS, there are two minor children of this marriage. Andrew D. Hiester, Jr. born
April 12, 1993 and Amanda C, lliester, born August 16, 1995,
WIffiREAS, Husband and Wife are residents of the Conunonwealth of Pennsylvania and
have been so for at least the past sLx months;
WHEREAS, certain differences have arisen between the parties hereto and as a
consequence, they have lived separate and apart since February 1996.
WHEREAS, Husband and Wife desire to 5ellle and determine certain of lheir marital
rights and obligations, and make an equitable distribution of their marital plOperty, determine their
rights to alimony. support and other matters which may be cunsidered under the Divorce Code;
and
WHEREAS, it is the intention and purpose of this Agreement to set forth the respective
rights and duties of the parties while they continue to live apart from each other and to settle all
financial and property rights betwccn thcm; and

Enforceability and Consideration, This Agreemenl shall survive any action for divorce and
decree of divorce and shall forever be binding and conclusive on the parties, and any independent
action may be brought, either at law or in equity, to enforce the terms of the Agreement by either
Husband or Wife until it shall have been fully satisfied and performed, The consideration for lhis
contract and agreement is the mutual benefits to be obtained by both of the parties hereto and the
covenants and agreements of each of the parties of the other, The adequacy oflhe consideration
for all agreements herein contained and stipulated is confessed and admitted by the parties, and
th~ panics intend to be legally bound hereby, In the event either party breaches the aforesaJd
Agreement and it is determined through appropriate legal action that the alleged party has so
breached the Agreement, the breaching party shall be responsible for any and all attorney's fees as
well as costs and expenses associated with litigation incurred by the non-breaching party to
enforce this Agreement against Ihe breaching party,

Background Information Indicated Ihat Michelle and Andy melln 1987. They
married In July of 1989. Their firsl child, Andrew was born April 12, 1993, In April
of 1995, while four monlhs pregnant with their second child Amanda, Michelle
left Andy, laking Andrew to her parenls home, because she alleges he was
seeing another woman and refused to end Ihal relalionship, Michelle returned 10

Debra divided their attention equally between the Iwo children. Both Andy and
Debra showed patience while Instructing the children how to assemble a puzzle,
There was an easy open exchange betweon Michello Hnd the children. Matthew
sat on the sofa and did not interact with Andrew and Amanda Thero was litlle
laughter exchanged during this sossion, Michelle, after a period of time, sat with
Matthew and allowed the children to play independenlly,
Andrew, al the age of seven, seems to understand that his paronts are divorcing.
His first grade leacher, at Green Ridge Elementary School, Mrs, Messner,
reported Ihat Andrew's attitude and emollonal stabilily needs consislent, stable
support. His school performance Is Inconsistent. He shows anxiety and stress
when work Is challenging, She feels he needs stabilily and consistency with
discipline, It Is possible Ihal his weak attentlon/concenlratlon Is emotionally
based, Mrs. Messner staled she believes Andrew plays one parent against the
other 10 gel his own way, He needs to respect authorily and follow classroom
rules,
Shirley Mumma, a former daycare provider, reported Ihal Amanda's behavior
was poor after coming back from a week with her father. Ms, Mumma felt
Amanda was mean to the olher children, "It was her way or no way," She
believes Andy Heisler thought she was being unfair because she would nol
watch the children until 9:00 al night.
