12. At the time of the acrldent, Christian M. Gantt was driving a
19117 Ford Aerostar south on SR 0011 (US 11 & 15), and James Edward Hoch
was driving a 1992 Ford Eronoline 150 North on the sallle highway, At or
about the location of the entrance to the Suml11erdale Plaza, James Edward
Hoch caused the vehicle he was driving to suddenly cross the center turning
lane of US 11 & 15 and enter the southbound lane wllt're it collided with the
vehicle operated by Christian M. Gantt.
13. Christian M. Gantt was pronounced dt'ad at the scene of the
accident by Cumberland County COrllnt'r, Michael Norris.

the right to pursue any uther daim that may exist against any ulher person ur
entity as a result of this acciden\. If Claimants obtain a judgment against any
other party in any legal actiun as a result of the accident, this release shall not
bar or reduce Claimants' recovery on the judgment in any way, unless Gayle
Faust and/or James E. Hoch arc judicially determined to be jointtortfeasors,
sharing joint and several liability for the judgment. In that event, Claimants'
recovery on any judgment shall be reduced, but only by Gayle Faust and lor
James E. Hoch's pro rata share of liability for the judgment, without regard to
the amount of the considerallon paid for this release. The terms of this joint
tortfeasors release shall be construed pursuant to the Pennsylvania Supreme
Court's opinion in Charles v. Giant Eagle Markets. 513 Pol. 474, 522 A.2d 1
(1987).
In the event that any other tortfeasors are responsible to us for damages
as a resull of the aforesaid accident, the execullon of this release shall operate
as a sallsfactlon of our claim against the parties herein released to the extent
of the relative pro rata share of said damages which the parties herein
released, would otherwise have hnd to pny, except for this release, and to Ihe
extent of the relt'ased parties' liability for contrlbullon to any other joint
tortfeasors resulting out of the nccidt'nt aforesaid.

Ganll and Marie Ganll, individually, and Jesse E. Canll as Administrator of
the Estate of Christian M. Ganll ("Claimants"); and Horace Mann ("Insurer"):
WITNESSETH:
WHEREAS, Jesse E. Ganll and Marie C. Gantt, arc the natural parents
of Christian M, Ganll who died on June 9, 1994, as a result of injuries he
sustained in a motor vehicle accident that occurred on that date, and;
WHEREAS, at the time of his death, Christian M. Ganll WilS a resident
in the home of his parents, Jesse E. Ganll and Marie C. Ganll, and;
WHEREAS, Jesse E, Oanll is the administrator of the estate to Christian
M. Ganll, by virtue of Lellers of Administration granted by the Register of
Wills of Cumberland County, Pennsylvania on July 12, 1994, and;
WHEREAS, At the time of the accident, Insurer insured one (1) motor
vehicle in the Claimants' household under a policy bearing policy number 37
4721 9500. The named insured on this policy was Christian M. Gantt, and;
WHEREAS, Insurer has represented to Claimants that this policy
contained underinsurance coverage with stacked limits of One Hundred
Thousand Dollars ($100,O()O.00) fur each person and Three Hundred
Thousand Dollars ($300,000.00) fur each accident, and;
WHEREAS, Insurer has offered selllement of Claimants' claims for
