The Petitioners are Blessing properties, Inc. and APS, Inc., with property located at 810 N. Hanover Street, Dorough of Carlisle, County of Cumberland, Commonwealth of Pennsylvania. 2. On or about the 30th day of August, 1994, Dlessing Properties, Inc. and APS, Inc. filed an Appeal to the Cumberland County Board of Assessments from the IIssossmont for the year 199!:i in the amount of 'I'hnle Hundred 1'housand Dallal's ($JIlO, 000. 00) for 'I'III! Parcel No. 29-20-1000- 007. 3. On or about the 21st day of Apr i I 1995, the sai d 1I00H'd of Assessment Appeals, after hoaring, fixed the final assossment at Throe lIundred Twenty Thousand Dollars (~J20,000.00) for the above tax parcel effective for the tax year 1995. 4. The Pet! t!oner's are aggri eved by the assessment as fina 11 y fixed by the said 1I0ard for tax assessment purposes and appeal to your 1I0norablu Court for rellef therefrom. Petitioners assign the following reasons for this appeal. (a) The assesqment as finally fixed by the said Board is excessive llnd represents a figure which Is substantially more than the fair market value of the said property, (b) The said assessment Is not uniform with olher assessments fixed on similar real eetate in the County of Cumberland. This appeal ie being filed to pursuant the Third Class county Assessment Law, Act of 1931, June 26, P.L. 1379, as amended (72 1'.6. 55324, et seq.) The propcrty which is the suhject of this uppeut is Cumherland County Assessmenl Parcel No. 29-20-IIIOO-007und is known us 1110 North Hunover Street, Curlislc,PA 17013. TIle property is situute in North Middleton Township, Cumberlund County, Pennsylvunia. 4. The parties stipulate Ihat the total market value of thc subjcct property as of the date the original petition to thc Cumherland County Board of Asscssment Appeals was filed shall be fixed at $280,000.00, 5. The common level ratio applicable to this uppeal for the 1995 tux year, as certified by the State Thx Equalization Board on or before July I, 1994, is 7.5%. Applying the common level ratio to the total market valuc of the subject property results in its luwfultotal assessment being $21,000.00. The common level ratio varies by more than 15% from the Cumberland County predetennined ratio, which is 25%, and therefore the common level ratio is applieable to this appeal and the assessment shall he fixed at the suld $21,000.00. 6. The Cumberland County Assessor's Office shall allocate the total assessment between land and improvements as provided by law and the procedures of the Cumberland County Assessment Offiee, 7. The Cumberland County Assessment Offiee shall promptly notify the appropriate laxing bodies of the change in assessment, effcctive retroactively to Junuary I, 1995, and instruet the laxing hodies to make any appropriate refunds, 8. The new assessment shull he effective Junuary I. 1995 and shall remainunehunged unless and until changed as otherwise provided by law, 9. Each pal1y to this appeal shall hear its own costs, 10.
