18, The Defendant haB been unjustly ondched, in that
payment has belHl made lly tho Plaintiffs to the Defendant in the
amount of $2,41),11, and has been wronqfully held by the
DefBndant since on or about July 14, 1994,
19. It is believed, and therefore averred, that the
Oefendant has prepared a wedding album and family portrait,
pursuant to the written and oral contractull agreements bBtween
the parties, said wedding album and family portrait remaining in
the posseBsion of the Defendant,
HIlEREFORE, the Plaintiffs needing equitable relief pray
that thiB Ilonorable Court rlecrBe and direct aB followB:
A. That the Defendant, Jeffrey S, Rose, be ordered and
directed to deliver to the Plaintiffs the wedding album and
family portrait prepared the DefBndant under the written and oral
contracts entered into between the parties; and
U, That the Defendant, .Jeffrey r;, HOBe, be ordered and
directed to pay to the Plaintilfs the Bum of $79,50 representing
the costs previously incurred by the Plnintlffs rolnting to this
matter, reasonable "ttorney's feeB incurred lly the PlaintiffB in

AND NOW come the Plaintiffs, stephen F, Kessler and
LiBa K. KesBler, by and through their attorneys, Friedman and
Friedman, P.C., and bring this cause of action against the
Defendant and aver as followSI
REPLY TO NEW HATTER
ParagraphB 1 through 19 of the Plaintiffs' Complaint
are incorporated herein by reference as though more fully set
forth herein.
20, The averments contained in paragraph 20 of the
Defendant's New Matter are admitted, excepting Defendant's
averment that the contractual agreement "included Jeffrey Rose's
Bervices and 30 pictures for a total of $1,595," This averment
iB denied, and proof thereof is therefore demanded at trial. By
way of further reply, it is averred that the package which was
contracted for, Memento C, included professional five hour
coverage and a bridal album, including thirty 10 x 10's, sixteen
5 x 5's, and one 4 x 5 B & H,
21. Admitted.
22. It is admittcd that the Dcfendant expended an
additional two hours of ovcrtlme at the wcddlng of the
Plaintiffs, It is specifically denied that Defendant Rose has
performed his part of the contractual agreement between the
partieB, and proof thereof is therefore demanded at trial. All
other averments contained in paragraph 18 of the Defendant's New
MattBr are denied, the contract being a written document, which
speaks for itself and is not subject to interpretation by the
Defendant, and proof thereof is therefore demanded at trial. By
way of further reply, it is averred that the Defendant never made
any requests of the Plaintiffs for additional payment prior to
the wedding, nor was additional prior payment before the wedding
ever made an issue between the parties.
23. It is admitted that Plaintiff, Lisa K. (Sheetz)
KesBler, was notified by the Defendant to come to hiB office to
preview the photographs. After reaBonable investigation, the
PlaintiffS are without knowledge or information sufficient to
form a belief as to the truth of the averred total number of
photographs, and the averment is therefore denied, and proof
thereof is thBrefore demanded at trial,
24. The averments contained in paragraph 20 of the
Defendant'B New Matter are denied, and proof thereof is therefore
demanded at trial. By way of further reply, it is averred that
Plaintiffs, steve and Lisa K, Kessler, tho parcnts of LiBa K.
(Sheetz) Kessler, Bill and Kathy Sheetz, and a sister of Lisa K.
(Sheetz) Kessler, Karen Sheetz, went through the photographB and
tentatively chose certain photographs not to be included, By way
of furthBr rBply, it is averred that at no timB during this, or
any subsequent discussion with Defendant Rose, was any indication
made by the Plaintiffs that Defendant Rose should finish and
place any selectBd photographs in an album.
25. The averments contained in paragraph 21 of the
Defendant's New Matter are denied, and proof thereof is therefore
demanded at trial, By way of further reply, it is averred that
after the Plaintiffs had tentatively made their initial exclusion
of photographs, they were informed by the Defendant that there
were too many photographB left remaining in relation to the
package that they had purchased, and that the remaining
photographs would COBt approximatBly another $1,400.00 in order
to finish and include in an album. The Defendant further offered
to the Plaintiffs to complete an album with all the pictures
which he had taken, for an additional payment of $700.00. By way
of further reply, it is averred that when the Plaintiffs were
unable to decide whether they wished to incur further eKpenseB,
eBpecially after having rBcBntly undergone a wedding of over
$20,000.00 in costs, they were informed by the Defendant that
they could go home and think about it, and it was not something
that had to be decided at that time,
26, Admitted, By way of further reply, it is averred
that in addition to the Plaintiffs having paid the remaining
balance on the $1,595.00 contract, they, in fact, paid a total of
$1,800.00 to the Defendant, that being the $300.00 down payment
and the $1,500.00 subsequent payment. By way of further reply,
it is averred that, in addition to the $1,800,00 paid, the
Defendant has also received payment of $613.11 for a family
portrait, which was orally contracted for between the parties,
and which to date the Defendant has refused to turn over to the
Plaintiffs,
27. It is admitted that the PlaintiffB have denied
ordering any additional photographs. It is admitted that the
Defendant Rose called Plaintiff, Lisa K. (Sheetz) Kessler's,
parents to inform them that the family portrait was prepared, and
to request that they inform the Plaintiffs to come in to the
studio to look at an album. After reasonable investigation, the
Plaintiffs are unable to determine the truth to the averment that
Defendant Rose placed all the photographs in the album, and the
averment is therefore denied, and proof thereof is therefore
demanded at trial, It is denied that the Plaintiffs ignored
telephone calls from Defendant Rose, By way of further reply, it
iB averred that when the Defendant informed the Plaintiffs that
he had prepared an album, they expressed surprise since they had
not agreed to expend any further monies as suggested by Mr. Rose
at their meeting.
WIlEREFORE, the Plaintiffs needing equitable relief pray
that this HonorablB Court dBcree and dirBct as follows:
A. That the Defendant, Jeffrey S. Rose, be ordered and
directed to deliver to the Plaintiffs the wedding album and
family portrait prepared the Defendant under the written and oral
contracts entered into between the parties; and
B. That the Defendant, Jeffrey S. Rose, be ordered and
directed to pay to the Plaintiffs the sum of $79,50 representing
the costs previously incurred by the Plaintiffs relating to this
matter, reasonable attorney's fees incurred by the Plaintiffs in
pursuit of this action, and costs of this proceeding; and
C. That the Defendant, Jeffrey S. Rose, be ordered and
directed to deliver to the Plaintiffs any and all negatives of
the photographs contained in the wedding album and family
portrait, which has been prepared by the Defendant and is in the
Defendant's possession; and
D. That such other and further relief be granted as
this Ilonorable Court may deem appropriate,
In the alternative, shOUld it be found by thiB
Honorable Court that the Defendant is unable to Bpecifically
pBrform the written and oral contractual agreemBnts betwBen the
parties, the Plaintiffs pray that your Honorable Court decree and
direct as followsl
A, That the Defendant, Jeffrey S. Rose, bB ordered and
directed to pay to the Plaintiffs the sum of $2,413.11, plUB
$79.50, plus coste and interest; and
