AND NOW this 10th day of May, 1995, upon consider~tion of
the J?etition of the cwnberland county Bourd of Elections, by
stephen D. Tiley, Assistant cumberland county solicitor, the
elections for the office of constable which are cur.rently being
conducted by the cumberland County Board of Elections for
carlisle 2 I Mechanicl3burg 1 and 3 I Camp Hill BOl'ough, and Penn
Township are cancelled and voided. Any votes for any individuals
for those offices made in the current Primar.y which is being held
on May 16, 1995, are hereby declared void. The office of
constable in Carlisle ~, Mechaniosburg 1 and 3, and Penn Township
being vacant, interested partiea may petition the Court for
appointment to fill the unexpired terms in those voting
districts.
Anthony Magaro having been elected in 1991 to the position
of constable for Camp Hill B~rough, was therefore elected for a
six year ter.m and it is decreed and ordered that his term shall
continue until the first Monday of January, 1998.

whioh the following is a statement I
1. 'l'he Cumberland County Board of Elections for the year
1995 is composed of Larry Welker. Chairman, Ralph Viehman and
Karen Byers as thl!l current. Cumberland C<:lunty CommiBsioners are
all seeking reelection.
2. In past years, vacancies for conatables in Cumberland
County have been filled by election. Elections were held for the
unexpJ.red port ion of the term of the vacant of f ice. This
practice evidently carried over from practice decades ago, and
evidently continuing from even prior to the turn of the last
century, when vacancies in the offJ.ce of constable were treated
similar to a municipal office. In 11 municipal office, a vacancy
is filled by appointment until the next municipal election at
which time an individual is elected to fill the unexpired term.
3. Constables are elected for terms of six years. (13
Pa. CSA !il4.)

5. 'rho Boal:'d of mleotiona dililcovered that vacanciea were
to be filled by appointment only after preparat10nll had been made
for the current Primary election, which ia soheduled for May 16,
1995.

6, The Board of Slections had prepared for an election in
thl:'ee wardll or municipalitiea to fill unexpil:'ed tel:'ms of vacant
constable positions. All throe of aaid elections pur.port to fill
a vacancy for two yeara and indicate that t.he individual elected
to the office will serve for two yeara. The affected warda or
municipalltiea are as followsr Carlisle:2, Mechanicaburg 1 and
3, and Penn Township.
7, In eaoh of said three warda or munioipalities no
candidate filed petitiona to be placed on the ballot, however,
there is the possibility of write-in candidates for the cUl:'l:'ent
PrimElI:'Y.
6. There is no statutory authority for electing a
constable for less than a six year term,

9. In 1991, the Board of Elections condutted an eleotion
in the Borough of Camp Hill to fill a vaoancy in the office of
constable for that Borough, That election purported to pe for
the remaining four years of the term of office that had been
vacated.
10. By letter dated December 5, 1991 from the then Director
of Elections, Raymond A. Hockley, a copy of which letter is
attach~ hereto, marked Exhibit "A," and is incorporated herein
by reference thereto, the Board of Elections advised Anthony
Magaro that he was the successful write-in candidate for the
office of constable in Camp Hill Borough.
11, One of the requirements to fulfill the office of
constable is to provide a bond. Anthony Magaro de~ired to accept
th~ office of constable and provided the bond required by law. A
copy of the bond is attached hereto, marked Exhibit "B," and is
incorporated herein by reference thereto.
12. Notwithstanding the fact that the term of office for
which Anthony Magaro was elected was for four years, Mr. Magaro's
bond sets forth a term of six years.
13, It is believed, and ther~for~ Averred, thaL Anthony
Magaro waa providl'ld by the Cumberland county Clerlt of Courts
Offioe with a blank bond forlll lIuch as that which would currently
be provided to elected constables, a oopy of which is attsohep
hereto, marked Exhibit "~," and ia incorporated herein by
reference thereto, It ill further believed, and therefore
averred, that Anthony Magaro thereafter filled out the bond to
provide for the six year term. Mr, Magaro then submitted the
bond to the Clerk of Courts Office and the same was approved by
the Court on Pecember 13, 1991 as noted thereon,
14. Since the Board of Blections only conducted an election
in 1991 for an unexpired term for constable in Camp Hill Borough,
the Board of Blections has undertakeu to conduct ano~her election
in 1995 for this office, for a full aix year term. This office
has therefore heen made available and is on the Primary for May
16, 1995 for a six year term,
15, Anthony Magaro did not aubmit a petition to appear on
the May 16, 1995 Primary ballot for the Camp Hill Borough
constable position. One candidate did file a petition and does
appear on that ballot. He is Stephen M. Urban, 2205 Chestnut
Street, Camp Hill, PA 17011.
16. Anthony Magaro maintains that he was unaware that the
1991 election was for a four year term, that he believed that it
was for a six year term, and that he was unaware of the current
election until after the filing deadline for petitions to appear
on the ballot. The Board of Blections is in receipt of a letter
dated May 5/ 1995 from Anthony Magaro, a copy of which is
,attached here<to, marked Exhibit; "D/" and is incorporated herein
by l'oferen(Je hal-eto.
17. The Cumberland county Board oC Ehlctions believes that
Anthony Magaro' fl term does expire at the end of 1995 llnd that
there should be an election in 1995 for a new aix year term.
However, as there are two interested parties, the Cumberland
county Board of Blections will not take an official position in
this regard.
WHIRIPORI, your Petitioner prays Your Honorable Court for an
Order, eitherl
(1) cancelling the election for constable for the Borough
of Camp Hill for 1995, voiding any votes for any individuals
for that office should the same be made at the May 16, 1995
Primary, and cel:tifying that Anthony Magaro was elected for
a six year term in 1991 and that his term expires on the
first Monday of January, 19981 or
(2) declaring that the office of constable for the Borough
of Camp Hill currently held by Anthony Magaro expires on the
first Monday of January, 1996, and that the same shall be
filled by the current election for a new six year term.
