Dear Mr, Socha;
Confirming ou~ telephone conve~sation which I had placed but
not completed at the time of this lette~, the Deputy P~othonotary
contacted me regarding the appeal which you have taken in the
matter above. r am advised that you filed an appeal on Mar 11
from a judgment entered by District Justice Manlove on Apr 1 11.
A problem has arisen from the fact that the transcript of
judgment shows-the dat" of the judgment as being April 4, rather
than April 11, although District Justico Manlove confirms that
jud~nent was actually entered at th~ later date. Kimberly
Banzhoff had issued a writ of execution subsequent to May., but
prior to your appeal,
Since judgment was not actually entered until April 11, it
would appear that your appeal was timely filed and that the writ
of execution should not have issued, By this letter, I am
suggesting that Kimberly Banzhoff voluntarily stay the writ so
that the appeal can proceed in an orderly fashion, If ehe does
not choose to do this, then you would have to petition the court
to stay the execution to allow the appeal,
It is unfortunate that these stepa have to be taken in a
relatively minor matter, but r aBsure you that it is not the
fault of the Prothonotary's Office, Apparently, the problem has
been with the computer in District Justice Manlove's office and
