In the present aotion, Erio Lynn Johnson (Johnson) appeals
from a suspension of his driver'S lioense by the Department of
Transportation (the Department), oontending only that he needs
his lioense in order to drive to work and sohool. We held a
hearing on Auguot 1, 1995, from which we made the following
findings of facti
FINDINGS OF FACT
1. Johnson is an adult male residing at 55 West Broadway
Avenue, Clifton Heights, PA.
2. On January 30, 1995, the Department suspended Johnson's
driver's license for a period of one year.
3. On January 31, 1995, Johnson wae stopped for a vehicle
code violation on West North Btreet in Carlisle, Cumberland
County.
4. At that time, Johnson had applied for an oocupational
limited license to allow him to drive to and from work during the
period of his suspension pursuant to seotion 1553 of the vehicle
code. 75 Pa.C.B.A. 51553.
NO. 95-2572 CRIMINAL TERM
5. The stop of Johnson on January 31, 1995, relulted in a
conviction for driving under suspension on March 14, 1995.
6. ~ursuant to that conviction, the Department notified
Johnson that his licenso would be suspended for one year
beginning on January 30, 1996.

The sole issue in this matter is whether Johnson is entitled
to an ocoupational limited lioense after his conviotion for
driving under suspension. The governing statutory section state.

been issued - Any driver who is eligible for
an oooupational limited license and is
oonvioted of any offense listed in seotion
1535 (relating to sohedule of oonviction and
points) or any offense for whioh the penalty
is a canoellation, recall, suspension or
revooation of operatillg privileges shall not
be issued an oocupational limited lioense,
or, if suoh driver has been issued en
oooupational limited lioense, the department
shall immediately reoall and the driver shall
surrender the limited lioense to the
department or its agents as the department
may designate under the authority of section
1540.
75 Pa.C.S.A. S1553. The faots of this matter olearly indioate
that Johnson was oonvicted for dr.iving under suspension while
waiting for an occupational limited lioense. Such an offense
negates Johnson's eligibility for an ocoupational limited
lioense. The appeal is therefore DENIED.
