AND NOW, comes the Plaintiff, Jim Woods, by and through his
attorney David A. Raho, Esquiro, who files a Complaint and in
support thereof avers the following:
1. PlainUff, Jim Woods, is an adult Individual who resides
at 501 South 4th street, Chambersbur'l, l"ranklin County,
Pennsylvania 17201.
2. 'rhe Defendant, Gar.y Mlxell, is an adult individual TlnlA
Gary's Salvage Yard, located at 19 Creekview Road, Newville,
Cumberland County, Pennsylvania 17241.
3. On or about Febr.uar.y 7, 1995, Plaintiff placed an
advertisement in the Franklin Shopper seeking to purchase a 2.6
Mitsubishi engine.
4. On or about February 16, 1995, Defendant contacted
Plaintiff and represented to Plaintiff that he was in possession of
a 2.6 Mit5ubishi engine which he wanted to sell,
5. On or about February 16, 1995, Defendant represented to
Plaintiff that the engine was in very good condition with only
69,000 miles and that Defenddnt would guarantee it.

6. On or about Fobruary 22, 1995, Dofendant ropreaented to
Plaintiff, both orlllly and in writinq on tho salell receipt, that
the engine had a 30 day expross warranty, (Attached aa Exhibit
"A")

9. ImmediateLy after Plaintiff installed the engine in his
vehicle, the engino made and continuea to make a Loud, continuous
ticking noiso.
10. On or about March 1, 1995, Plaintift transported hia
vehicle to Shi veley Motors in Chambersburl), pennsy LVllnia wh ich
informed Plaintiff that it would cost $750.00 to repair the engine
and that the vehicle should not be driven until the repairs were
made.
11. On or about March 7, 1995, after plaintiff informed
Defendant of the cost to repair the engine, Defendant agreed to
examine the engine.
12, On or about March 7,1995, Plaintiff, at his own expense,
had the vehicle transported by trailer to Defendant's salvage yard.

13. On or about March 14, 1995, Defendant represented to
Plaintiff that Defenda.lt had adjusted the timing chain on the
engine and that the engine was in good condition.

failed to do so,

repair the engine in a good and workmanllku manner, Defendant has
refused to comply with Plaintiff's ruquellL.
16. Dofendant's failure to repair Lhe engine constitutes a
breach of contract and a breach of uxpres/I warranty,
19. Plainliff has alrulIdy ell[londlld $525.66 to repair the

WHEREFORE, Plaintiff demands judgement be entered in his favor
and against the Defendant in the sum of $992,22 plus interest,
costs, and attorney's fees.

for any monetary losses.
22. Plaintiff failed to specify and partiCUlarize to the
Defendant the alleged defects.
23. Defendant therefore did nQt have an opportunity to seasonably
cure any such alleged defects.
24. Under Section 2605 of the Uniform Commercial COde-Sales. 53
P.S. Section 2605. Plaintiff is therefore barred from
recovery.

statements that the engIne was in very good condiUon with only
69,000 miles on it and that Defendant would guarantee it.
