AND NOW, this

day of March, 1996, upon
consideration of the within stipulation and Joint Motion for
Agreed order, it is Decreed and Ordered that the total market
value of the subject property as of the date applicable to thia
proceeding is $900,000.00, and that the common level ratio
applicable hereto is 7.3%. The total assessment of the property
for tax yearo beginning January 1, 1996, January 1, 1997, and
January 1, 1998, and thereafter until changed as provided by law,
shall be $65,700.00.
The Cumberland county Aosessment Office shall allocate said
total assesoment between land and improvements for the subject
tax parcels as provided by law, and by the procedures of the
Cumberland countj Assessment Office. 1~e Cumberland county
Aeeesoment Office shall promptly notify the appropriate taxing
bodlee of the change in assessment, effective retroactively to

STIPULATION AND JOINT MOTION FOR AGREED ORDER
AND NOW, this
day of March, 1996, it is hereby
agreed and stipulated between Appellants, PIN HSUN and SW TSEN
KUO, by their attorney, Michael J. Pykosh, Esquire, and
Appellees, Cumberland county Board of Assessment Appeala and
Cumberland county, by its attorney, Stephen D. Tiley, Eaquirel
and East Pennsboro Area School District, by its attorney, Richard
C. snelbaker, Esquire, as follows:
1. On or about May 17, 1995, Appellants filed a petition
for assessment appeal from the assessment fixed by the Cumberland
county Board of Assessment Appeals on April 21, 1995 to which an
Order fixing a date and place for a hearing was entered on May
22, 1995. The hearing was originally scheduled for August 30,
1995 and was continued generally. The parties have now settled
this case in accordance with the terms of this stipulation.
2. The applicable year for which the above captioned
assesoment appeal was filed is the calendar year 1996.
3. The property which is the subject of this appeal ia
composed of Cumberland County Assessment Parcel Nos. 09-13-1002-

213A and 09-13-1002-215, and Is known as "Shady Lane Apartments".
The property is situate in the Township of East Pennsboro,
Cumberland county, Pennsylvania.
4. The parties stipulate that the total market value of the
subject property as of the date the original petition to the
Cumberland County Board of Assessment Appeals was filed shall be
fixed at $900,000.00 for both tax parcels as combined.
5. The common level ratio applicable to this appaal for the
1996 tax year, as certified by the state Tax Equalization Board
on or before July 1, 19~, is 7.3\. Applying the common level
ratio to the total market value of the subject property results
in its lawful total assesoment being $65,700.00 for both tax
parcels as combined. The common level ratio varies by more than
15\ from the Cumberland county predetermined ratio, which is 25\
and therefore the common level ratio is applicable to this appeal
and the assessment shall be fixed at the said $65,700.00 for both
tax parcels as combined.
6. The Cumberland County Assessor's Office shall allocate
the total assessment between land and improvements for the
subject tax parcels as provided by law and the procedures of ths
Cumberland County Assessment Office.
7. The Cumberland county Aesossment Office shall promptly
notify the appropriate taxing bodies of the change in assessment,
effective retroactively to January 1, 1996, and instruct the
taxing bodies to make any appropriate refunds.

Dear Judge Bayley:
J write in my capacity as atturney for East Pennsboro Area
School District, intervenor in the above action.
We respectfully request the continuance of the hearing
scheduled for August 30, 1995, in the above matter. The School
District is actively opposing the owner's appeal and has engaged
a professional real estate appraiser to determine value.
Unfortunately, the appraisal is not completed at this time and we
cannot be prepared properly for the hearing on August 30, 1995.
Counsel for the owners and the county Board of Assessment
and Review of Taxes have consented to this request.
Enclosed is a suggested Order for your use together with
pre-addressed and stamped envelopes for your convenience.
