Inc., acting within the scope of their employment, sold and
delivered to the Defendant, Warner Homes, Inc., goods and materials
at the times, in the amounts of, of the kinds, and for the prices
set forth in a true and correct copy of Plaintiff's book of
original entry, copy of which is marked Exhibit "A" and Exhibit
"A-I" to and including Exhibit "A-12", attached hereto and made
part hereof, which goods and materials were received and accepted
by the Defendant, Warner Homes, Inc.
7. The prices charges for said goods and materials are just
and reasonable and are the prices which the agents, servants, and
employees of the Defendant, Warner Homes, Inc., acting within the
scope of their employment, orally promised to pay Plaintiff for the
same.
8. Plaintiff has demanded payment from the Defendant, Warner
Homes, Inc., in the amount of $2,031.93, together with delinquency
charges in the amount of one and one-fourth (1-l/4th\) percent per
month after thirty (30) days, but Defendant, Warner Homes, Inc.,
has refused and still refuses to pay the same or any part thereof.
WHEREFORE, Plaintiff, Hempt Bros., Inc., demands judgment
against Defendant, Warner Homes, Ino., in the amount of $2,031.93,
together with delinquency charges in the amount of one and one-
fourth (1-1/4th%) percent per month, together with costs of suit.

COUNT II
9. The allegations of paragraphs 1 to and including 8 are
incorporated herein by referenoe as though herein fully set forth.
10. The Plaintiff, Hempt Bros., Inc., at the special
insistence and request of the agents, servants, and employees of
the Defendant, Warner lIomes, Inc., acting within the scope of their
employment, sold and delivered to the Defllndant, Warner Homes,
Inc., goods and materials at the times, in the amounts, of the
kinds, and for the prices set forth in invoices marked Exhibit
"A-I" to and inclUding "A-12", attached hereto and made part
hereOf, which goods and materials were received and accepted by the
Defendant, Warner Homes, Inc.
11. The prices charged for said goods and materials are just
and reasonable, and are the prices which the agents, servants, and
employees of the Defendant, Warner lIomes, Inc., acting within the
scope of their employment, orally promised to pay Plaintiff for the
same.
12. Plaintiff has demanded payment from Defendant, Warner
Homes, Inc., in the amount of $2,031.93, with delinquency charges
in the amount of one and one-fourth (1-1/4th%) percent per month
after thirty (3U) days, but Defendant has refused and still refuses
to pay the same or any part thereof.
13. As II result of the aforesaid, Defendant, Warner Homes,
Inc., has been unjustly enriched at tho Plaintiff's expenee in the
amount or $2,031.93.

WHEREFORE, Plaintiff, Hempt Bros., Inc., demands judgment
against Defendant, Warner Homes, Inc., in the amount of $2,031.93,
together with delinquency charges in the amount of one and one-
fourth (1-1/4th\) percent per month, together with costs of suit.
COUNT II I
'4. The allegations of paragraphs 1 to and inclUding 13 are
incorporated herein by reference as though herein fully set forth.
15. The Plaintiff, at the special insistence and request of

employees of the Defendant, Warner Homes, Inc., acting within the
scope of their employment, orally promised to pal Plaintiff for the
same.
17. Plaintiff has demanded payment from the Defendant, Warner
Homes, Inc., in the amount of $2,031.93, together with delinquency
charges in the amount of one and one-fourth (1-1/4th%) percent per

COMPLAINT
1. The Plaintiff, Hempt Bros., Inc., is a Pennsylvania
corporation with a principal place of business at 205 Creek Road,
camp Hill (Lower Allen TOWnship) , Cumberland county, Pennsylvania,
17011.
2. The Defendant, Warner Homes, Inc., is a Pennsylvania
oorporation with a place of business at 3811 Claverton Road,
Mechanicsburq, Cumberland county, Pennsylvania, 17055.
3. At all times relevant hereto, Plaintiff has been enqaged
in the business, inter AliA, of manUfacturing and selling concrete,
asphalt, and stone.
4. At all times relevant hereto, the Defendant, Warner
Homes, Inc., has been engaged in the construction, landscaping,
remodeling, and excavation business.
COUNT I
5. The allegations of paragraphs 1 to and inclUding 4 are
incorporated herein by reference as though herein fully set forth.
6. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, Warner lIomes,
Inc., acting within the scope of their employment, sold and
delivered to the Defendant, Warner Homes, Inc., goods and materials
at the times, in the amounts of, of the kinds, and for the prices
set forth in a true and correct copy of Plaintiff's book of
original entry, copy of which is marked Exhibit "A" and Exhibit
"A-I" to and including Exhibit "A-12", attached hereto and made
part hereof, which goods and materials were received and accepted
by the Defendant, Warner Homes, Inc.
7. The prices charges for said goods and materials are just
and reasonable and are the prices which the agents, servants, and
employees of the Defendant, Warner Homes, Inc., acting within the
scope of their employment, orally promised to pay Plaintiff for the
same.
8. Plaintiff has demanded payment from the Defendant, Warner
Homes, Ino., in the amount of $2,031.93, together with delinquency
charges in the amount of one and one-fourth (1-1/4th%) percent per
month after thirty (30) days, but Defendant, Warner Homes, Inc.,
has refused and still refuses to pay the same or any part thereof.
WHEREFORE, Plaintiff, Hempt Bros., Inc., demands jUdgment
against Defendant, Warner Homes, Inc., in the amount of $2,031.93,
together with delinquency charges in the amount of one and one-
fourth (1-1/4th\) percent per month, together with costs of suit.

9. The allegations of paragraphs 1 to and including 8 are
incorporated herein by reference as though herein fully set forth.
10. The Plaintiff, Hempt Bros., Inc., at the special
insistence and request of the agents, servants, and employees of
the Defendant, Warner Homes, Inc., acting within the scope of their
employment, sold and delivered to the Defendant, Warner Homes,
Inc., goods and materials at the times, in the amounts, of the
kinds, and for the prices set forth in invoiceD marked Exhibit
"A-1" to and inclUding "A-12", attached hereto and made part
hereof, which goods and materials were received and accepted by the
Defendant, Warner Homes, Inc.
11. The prices charged for said goods and materials are just
and reasonable, and are the prices which the agents, servants, and
employees of the Defendant, Warner Homes, Inc., acting within the
scope of their employment, orally promised to pay Plaintiff for the
same.
12. Plaintiff has demanded payment from Defendant, Warner
Homes, Inc., in the amount of $2,031.93, with delinquency charges
in the amount of one and one-fourth (l-1/4th%) percent per month
after thirty (30) days, but Defendant has refused and still refuses
to pay the same or any part thereof.
13. As a result of the aforesaid, Defendant, Warner Homes,
Inc., has been unjustly enriched at the Plaintiff's expense in the
amount of $2,031.93.

against Defendant, Warner Homes, Inc., in the amount of $2,031.93,
together with delinquency charges in the amount of one and one-

14. The allegations of paragraphs 1 to and including 13 are
incorporated herein by reference as though herein fully set forth.
15. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, Warner Homes,
Inc., acting within the scope of their employment, sold and
delivered to the Defendant, Warner Homes, Inc., goods and materials
at the timeD, in the amounts, of the kinds, and for the prices set
forth in the invoices marked Exhibit "A-I" to and including Exhibit
"A-12", attached hereto and made part hereof, which goods and
materials were received and accepted by the Defendant, Warner
Homes, Inc.
16. The prices charged for said goods and materials are just
and reasonable, and are the prices which the agents, servants, and
employees of the Defendant, Warner Homes, Inc., acting within the

OPINION AND ORDER OF COURT
BAYLEY, J., October 6,1997:--
On December 29, 1987 appellant, Kevin L. Mullen, was granted a variance for a
property he owns at 2301 Ritner Highway, West Pennsboro Township, to operate a
commercial woodworking shop to make unfinished wood products. The facility Is
located In a 6,000 square feet building. On July 19, 1993, West Pennsboro Township
adopted a new Zoning Ordinance. Appellant's property Is located In a Residential
District Low Density (R-l) District. His continuous use of his property pursuant to the
1987 variance became nonconforming under the new zoning ordinance.
On February 7, 1995, appellant flied an application with the Township seltlng
forth:
Applicant seeks expansion of a nonconforming storage uae pursuant
to Section 1303A.3 of the Zoning Ordinance. (Emphasis added.)
Appellant seeks to add two separate additions to the building on his property.
One addition to the east would be 3,600 square feet and contain eighteen 10 feet by

20 feet storage units to be rented to the public. The other addition to the rear would
be 1,600 square feel. Appellant testified before the West Pennsboro Township's
Zoning Hearing Board that he plans to use BOO square feet for storage of materials
and products of his business, and the other BOO square feet for 10 feet by 20 feet
storage units to be rented to the publlc.1 Appellant Intends to continues to operate
his commercial woodworking business In his property. The Zoning Hearing Board
denied appellant's application on the basis that his proposed additions do not
constitute a lawful expansion of a nonconforming use.2 Appellant filed this appeal
which was briefed and argued on October 1, 1997. The standard of review Is whether
the Zoning Hearing Board committed a manifest abuse of discretion or error of law.

Townlhlp, 157 Pa. Commw. 3B7 (1993).
Section 1303 of the Township Zoning Ordinance provides:
A. The types of extensions and enlargements listed below are
permitted for nonconforming uses, buildings, and structures
existing on the effective date of this Ordinance:

3. The extension or enlargement of a nonconforming building
occupied by a conforming or nonconforming use.
1. In his application on February 7, 1995, appellant also sought a variance for
his proposed additions. That request has been withdrawn.
2. On May 3, 1994, appellant was granted a variance io create rental storage
spaces Inside his building. He constructed nine 10 feet by 20 feet storage units that
he rents to the public. On January 10, 1995, appellant was denied a variance to
expand such rental storage facilities to as many as seventy-eight units.

Appellant testified before the Zoning Hearing Board that he operates a
production workshop In his building where he manufactures hundreds of thousands
of wood products. He stores raw materials In the building for actual fabrication and
construction of products and stores finished products before they are shipped.
Appellant maintains that he has a multiple purpose nonconforming use for (1) a
commercial woodworking shop, and (2) a storage facility. Therefore, he argues that
his application to construct rental storage facilities qualifies as an "expansion of a
nonconforming storage use." (Emphasis added.)
While a property can be utilized for multiple nonconforming uses, Lower
Moreland Township v. Shell 011 Co. and White, 3 Pa. Commw. 259 (1971), the
substantial evidence before the Zoning Hearing Board was that appellant as of the
date the new zoning ordinance was enacted was utilizing his property pursuant to the
variance Issued to 111m on December 29, 1967, as a commercial woodworking shop
to make unfinished wood products. That uninterrupted use continues to date. The
fact that appellant uses a substantial portion of his building to store material for
production and finished product does not make the property a storage facility. The
Board's conclusion that appellant's storage of materials and new products In his
building Is Incidental to the operation of his woodworking business and does not
constitute a separate nonconforming use Is supported by the evidence and 18 legally
correct. Providing rental storage units to the public is not a use of the same general
character as appellant's operation of his woodworking shop where the storage of

materials and products are Incidental to that business. As set forth In Phllm
Corporation v. Washington Township, 162 Pa. Commw. 126 (1994):
To qualify as a continuation of an existing nonconforming use, a
proposed use must be sufficiently similar to the nonconforming use
as not to constitute a new or different use. The proposed use need
not be Identical to the existing use, and an overly technical assessment
of that use cannot be utilized to stunt Its natural development and
growth. (Citations omitted.) (Emphasis added.)3
Altematlvely, appellant maintains that he Is entitled to operate his proposed
rental storage units pursuant to Section 1304 of the Township's Ordinance that
provides:
CHANGES IN NONCONFORMING USES. A nonconforming ule may
be changed to another nonconforming ule of the same or more
reltrlctlve clalalflcstlon. Whenever a nonconforming use has been
changed to a more restricted classification or to a conforming use, such
use shall not hereafter be changed to a use of less restrictive
classification. (Emphasis added.)
The Zoning Hearing Board acknowledges that under Section 1304 appellant
could change the entire use of his premises from a commercial woodworking shop to
a rental storage facility. However, the Board was legally correct In holding that
appellant Is not permitted under Section 1304 to expand his nonconforming
woodworking shop to add anothBr nonconforming use of rental storage units while
retaining the woodworking shop. In Atlantic Richfield Co. Appeal, 77 Pa. Commw.
3. Appellant's storage rental units cannot be built just because he already has
nine rental storage units Inside his building, Those units constitute a legal use, and
not a nonconforming use, because of the variance appellant was granted on May 3,
1994 after the eHective date of the current zoning ordinance,

310 (1983), a Newton Township, Bucks County Zoning Ordinance provided In
pertinent part:
Changes. A nonconforming use of a structure or land may be changed
to a nonconforming use of the same or more restricted classification"..
This Is the exact language In Secllon 1304 of the West Pennsboro Township
Zoning Ordinance. The Commonwealth Court of Pennsylvania Interpreted this
Section as not permitting a:
[I]andowner to continue an existing nonconforming use on his property
while, at the same time, establishing an entirely new and additional use
which Is Incompatible with the requirements of the zoning district.
In Atlantic Richfield, the property owner did not propose to discontinue one
nonconforming use and substitute another, but Instead desired to retain a part of an
existing nonconforming use and simultaneously establish an entirely new
nonconforming use. The Commonwealth Court concluded that "[S]uch a proposal
runs counter to the terms of the ordinance." Accordingly, In the present case, Section
1304 of the West Pennsboro Township Zoning Ordinance does not permit appellant
to retain his nonconforming woodworking shop and add what would be a new
nonconforming use of rental storage units.
For the foregoing reasons, the following order Is entered.
