The plaintiff was injured when she was involved in a motor vl'hidl' accident
which occurred on Interstatl' HI while it was under comtruction. The accident
occurred on August 26, 1993. The dl'fl'ndant was operating a truck in the
construction afl'a and was unable to slow or stop his vehicle. HI' struck a
vehicle being operated by Gerald D. ({l'gi, who WilS puslll'd into thl' vehicle

COMI'LAINT
1. The plaintiffs, Shelley J. Welchman and John It Welchman, are
adult individuals, and they reside together at 491 Petersburg Road, Carlisle,
Cumberland County, Pennsylvania.
2. The defendant, PGT Trucking, Inc., is a corporation having a place
of business at 12751'a. Avenue, East Liverpool, Ohio 43920.
3. The defendant, Kenneth Martin Greathouse, is an adulllndlvidual,
residing at Route Illl, Box 2321l, Wellsburg, West Virginia 26070.
4. At all times relevant hereto, Kenneth Martin Greathouse was an
employel' of PGT Trucking, Inc., and was acting within the scope of his
employment.
5. On or about August 26, 1993, at approximately 8:16 A.M., the
plaintiff, Shelley J. Weichman, was operating her van In a northern direction on
Interstate Ill, at or near the area of S.M. 490, in Middlesex Township,
Cumberland County, Pennsylvania, when she had to slow for traffic In a
construcllon site.
6. At the aforesaid lime and place, the defendant, Kenneth Martin
Greathouse, was operallng a tractor-trailer, and when the traffic slowed, he was
unable to bring his vehicle under control, striking the rear of a vehicle driven by
Gerald D. Regl, forcing the Regi vehicle into the vehicle operated by the plaintiff,
Shelley Weichman.
7. The aforesaid accident was caused by the negligence of the
defendant, Kenneth Martin Greathouse, while within the scope of his
employment.
Ii. The defendant, Kenneth Marlin Greathouse, was negligent In the
following respl'cts:
(il) in failing to maintain propl'l' i\lHI adelJuate control of his
vehicle;
(b) in failing tomainlain il proper lookout;
and
(c) in falling to drive wilhin the assured clear distance ahead,
(d) in falling to follow at a safe distance.
9. As a direct and proximate result of the negligence of the defendant,
Kenneth Martin Greathouse, while within the scope of his employment, the
plalnllff, Shelley Weichman, was injured. Her Injuries include, but are not
limited to, Injury to the neck and back, and shock to her nerves and nervous
system.
10. As a direct and proximate result of the injuries sustained by the
plaintiff, Shelley Weichman, she was forced to undergo medical treatment, the
cost of which may not be precluded by the Pennsylvania Motor Vehicle Financial
ResponslblUty Law.
11. As a direct and proximale result of the aforesaid injuries, the
plaintiff, Shelle}' Weichman, was forced to miss work, the amounts of which may
not be precluded under the Pennsylvania Motor Vehicle Financial ResponsiblUty
Law.
12. As a direct and proximate result of her injuries, the plaintiff, Shelley
Weichman, endured pain and suffering, a loss of wages, aggravation and
inconvenience in the past, and she may continue to endure the same in the
future,
WHEREFORE, it is prayed that judgment be entered in favor of the
plaintiff and against the defendants in an amount in excess of the amount
requiring compulsory referral to arbitration under the Local Rules of Court. A
jury trial Is hereby demanded.
CONSORTIUM
13. The averments of paragraphs 1 through 12 are incorporated herein
by reference thereto.
14. At the time of the accident, Shelley J. Weichman was married to
John It Weichman.
15. As a direct and proximate result of the injuries to the plaintiff,
Shelley J. Weichman, the plaintiff, John It Welchman, suffered a loss of the
society and companionship of his spouse.
WHEREFORE, it is prayed that Judgment be entered in favor of the
plaintiff and against the defendants in an amount in excess of the amount
requiring compulsory referral to arbitration under the Local Rules of Court. A
jury trial is hereby demanded.

IN REI PRETRIAL CONFERENCE
At a pretrial conference held Wednesday, August 27,
1997, before the Honorable Harold E. Sheely, President Judge,
pre.ent for the Plaintiff was William P. Douglas, Esquire, and
pre.ent for the Defendant was George B. Fowler, Jr., Esqui~e.
Liability has been admitted in this case. The
Defendant was operating a truck in the construction area of
Route 81, and he struck a vehicle operated by Gerald D. Regi,
whose vehicle was then pushed into the vehicle being operated by
the Plaintiff, Shelley J. Weichman. The Plaintiff now resides
in Florida.
The Regi case is planning to be tried during the
November term of court, and counsel have agreed to continue this
case until the November term of court because the driver of the
truck will have to be here for both trials. Since liability is
admitted, the case should not take that long to try. Both ca.es
can be tried during the week of November trials.
Counsel are directed to submit a new pretrial
memorandum for the pretrial conference on October 22nd, 1997.
