compensation proceeding, were performed In Lackawanna and Wayne counties;
(6) No proceedings related to the claim took place In Cumberland County,
For the aforementioned reasons, we conclude that venue Is not properly laid
In Cumberland County and hereby order the case transferred to Northampton

AND NOW, come the Plaintiffs, Old Republic Insurance Company
and School Boards Insurance Company, Ltd" by and through their
attorneys, Michael I, Levin and Associates, who file this Complaint
and who, in support thereof, alloge the following:
1, The Plaintiff, Old Republic Insurance company (hereinafter
referred to as "Old Republic") is an insurance company licensed to
writs workers' compensation insurance in the commonwealth of
Pennsylvania. old Republic has offices located at 445 S. Moorland
Road, Brookfield, Wisconsin, 53005.
2, The Plaintiff, school Boards Insurance company, Ltd"
(hereinafter referred to as "SBIC") is an insurance company
domiciled in Bermuda with offices located at 41 Cedar Avenue,
Hamilton HM 12, Bermuda.
3. The Defendant Cal Leventhal, (hereinafter referred to
individually as "Leventhal") is an adult individual and an attorney
licensed to practice law in the commonwealth of Pennsylvania. His
offices are located at R,D, 2, Box 2061, Honesdale, Pennsylvania,
18431, It is belisved and therefore averred that Leventhal is a
partner in Dougherty, Leventhal and Price and Saba,
4, The Defendant, Dougherty, Lsventhal and Price, upon
bslief, is or was a partnership, practicing law in the commonwealth
of Pennsylvania with offices located at R,D, 2, Box 2061,
Honesdale, Pennsylvania,

5. The Defendant Dougherty, Leventhal, Price and Saba, upon
belief, is a partnership and successor to the firm of Uougherty,
Leventhal and Price, practicing law in the commonwealth of
Pennsylvana with offices located at R.D, 2, Box 2062, Honesdale,
Pennsylvania.
6, The Defendant, Dougherty, Mundy, Leventhal and price, upon
belief, was a partnership and a predecessor to Dougherty,

Leventhal, Price and Saba, practicing law In the Commonwealth of
Pennsylvania with offices located at R,D. 2, Box 2061, lIonesdale,
Pennsylvania,
7, old Republic has been a client of the Defendants and the
Defendants have represented Old Republic In various miltters through
and until at least in or about August, 1994, and Defendants
continue to represent Old Republic with respect to at least one
matter,
B. SOIC provides reinsurance to Old Republic with respect to
certain insurance policies issued by Old Republic, including the
policy relevant to this matter. A copy of the relevant. portions of
the Reinsurance Agreement is attached hereto as Exhibit "A" and
incorporated herein by reference as if fully set forth herein,
9. Claims Management Servicss, Inc" (hereinafter referred to
as "CHS") is a third party administrator and agent of old Republic
who procssses and administers certain workers' compsnsation claims
for and on behalf of Old Republic, Including the worker's
compensation claim relevant to this aotion, At all times relevant
hereto, CMB has had offices located in cumberlan1 County,
Pennsylvania, at 26 South ~'ront street, Wormlesburg, Pennsylvania,

10, All, or virtually all, communications between CMS, as
agent for old RepUblic, and the Defendants were either to or from
CMS's office In Cumberland County, CMS, as agent for Old Ilepublic,
retained the sel"vlces of the Defendants out of its offices in
Cumberland County, Ileports were made to CMS, as agent tor old

Republic, by the Defendants to CMS's offices in Cumberland County,
COUNT I - TRBBPABB
11. Paragraphs 1 through 10 hereof are incorporated herein by
reference as if fully set forth herein,
12, Old Republic, through its agent, CMS, assigned to the
Defendants the defense of a petition for worker's compensation
benefits filed by or on behalf of Martha Fisk (hereinafter referred
to as "Fisk"). By letter dated May 9, 1990, a copy of which is
attached hereto as Exhibit "B" and incorporated herein by reference
as if fully set forth herein, the Defendants were asked to "protect
the interests of our client," The Defendants, by and through their
actions agreed to provide legal representation to Old Republic and
its insured, Tunkhannock Area School District, (hereinafter
referred to as the "School District"), as exemplified by the
following I
a, The Defendants filed an Answer on behalf of Old Republic
and the School District;
b, The Defendants acknowledged receipt of the file and
acceptance of the case by letter dated May 9, 1990, a
copy of which is attached hereto as Exhibit "C" and
incorporated herein by reference as if fully set forth
herein;
c. The Defendants undertook the Bole and complete legal
representation and defense of Old Republic's interest
with respect to the petition filed by Fisk; and
d, The Defendants billed for and accepted payment for legal

services they provided and performed with respect to the
Fisk matter.
13. As a result of eMS's assignment of the defense of the
Fisk matter to the Defendants and the Defendants' acceptance of
that assignment, an attorney-client relationship existed between
Old Republic and the Defendants,
14, As a result of the attorney-client relationship between
Old Republic and the Defendants, Defendants had a duty to represent
Old Republic with the reasonable care, skill and diligence
possessed and exercised by the ordinary attorney in similar
circumstances.
15. The Defendants breached their duty to exercise reasonable
care, skill and diligence on behalf of Old Republic in the
following waysl
a, Failing to obtain all relevant medical records in a
timely fashion,
b, Failing to request that Dr, Byron express opinions on all
relevant issues;

c,
Failing to obtain clarification from Dr, Byron in
d,
response to Dr, Byron's report;
Failing to call or present any witnesses, inclUding the
failure to call and present Dr, Byron as a witness, in
defense of the claim;
Failing to obtain all of the medical bills incurred by
e.
Fisk and advising the Plaintiffs of same;
f. Failing to cross-examine Fisk's medical experts with

respect to the medical bills Incurred by Fisk;
g, Failing to take tho action necessary to ensure that the
judqe would havo reqult'od t"isk to meot the burden of
proof as to the reasonableness, necessity and relatedness
of her medical bills to her injury of November 6, 1989;
and
h. Failing to preserve on appeal issues pertaining to the
reasonableness, necessity and relatedness of new medical
bills incurred by Fisk to treat her reflex sympathetic
dystrophy condition,
16. 1 t is believed and therefore averred that had the
Defendants not breached their duty to the Plaintiffs, as alleged in
paragraph 15, the school district and Old Republic would have
prevailed in the litigation with rellpeot to the medical bills
inourred by Fisk to treat her reflex sympathetIo dystrophy.
17. Bolely as a result of the neqligence of Defendants, the
Plaintiffs were required to pay for medioal bills incurred by Fisk
that were caused by and related to Fisk's reflex sympathetio
,dystrophy in an amount in excess of Twenty Fivs Thousand Dollars
($25,000) that the Plaintiffs would not have had to pay and which
would have remained the respondbil i ty of another insurance
carrier, Amsrican t"ire and casualty company, had the Defendants
properly repressnted the Plaintiffs' interesta,
WIIEREFORE, it is respectful 1 y requested that judgment be
entered in favor of the Plaintiffs and againat the Defendants in an
amount in eKcess of Twenty Five 1~ou8and Dollars ($25,000), plus
Ii
interest and costs of suit,
COUNT II - ASSUMPSIT
10, Paragraphs 1 through 17 hereof are incorporated herein by
reference as if fully set forth herein,
19, By letter dated May 23, 1990, a copy of which is attached
heretn as Exhibit "D" and incorporated herein by reference, the
Defendants promieed to schedule an independent medical examination
after they had gathered all of the medical records,
20. By letter dated June 26, 1990, a copy of which is
attached hereto ae Exhibit "E" and incorporated herein by
reference, the Defendants represented that they were collecting the
medical records pertaining to Fisk,
21. By letter dated November 15, 1990, a copy of which is
attached hereto as Exhibit "1'" and incorporated herein by
reference, the Defendants represented that Fisk's doctors had not
responded to the Defendants' subpoenas,
22. It is believed and therefore averred that in breach of
their promises and representations, that the Defendants took little
i or no action to obtain Fisk's medical records until on or after
November 15, 1995,
23, By letter dated November 28, 1990, a copy of which is
attached hereto as Exhibit "G" and incorporated herein by
reference, the Defendants (a) represented to CMS, as Old RepUblic'S
agent, who understood the Defendants to mean, that they may be able
to successfully defend against at leaet some of the medical bills
that were being incurred by Fisk; and (b) represented that the

Defendants would try to have Dr, Ilyron focus in on an attempt to
relate Fisk's problems to her 1985 work-related injury,
24. Ily letter dated May 24, 1991, a copy of which is attached
hereto as Exhibit "II" and incorporated herein by reference, the
Defendants represented that they were" in a much better posture" to
have the School District's prior insurance carrier maintain
responsibility for certain medical bills incurred by Fisk.
25. As a result of the promises and representations made by
the Defendants as alleged in paragraphs 19 through 24 hereof, the
Plaintiffs reasonably relied on the Defendants to exercise
reasonable care, skill and diligence to defsnd Fisk's claims and to
protect the Plaintiffs from having to pay certain medical bills,
26, It is believed and therefore averred that a contractual
relationship existed between Old Republic and ths Defendants,
27, In breach of its contractual commitments, promises,
representations and duties, it is believed and thsrefore averred
that the Defendants failed to take the actions necessary to protect
the plaintiffs from having to pay certain medical expenses incurred
, by Fisk, inoludingl
a. Failing to obtain all relevant medical records in a
timely fashion;
b. Failing to request that Dr. nyron express opinions on all
relevant issues;
c, Failing to obtain clarification from Dr, Ilyron in
response to Dr, Ilyron's report;
d, Failing to call or present any witnesses, including the

failure to call anrt present Dr, Byron as a witness in
defense of the claim,
e, Failing to obtain all of the medical bills incurred by
Fisk and advising the Plaintiffs of same;
f. Failing to cross-examine Fisk's medical experts with
respect to the medical bills,
g, Failing to take the action necessary to ensure that the
judge would have required Fisk to meet the burden of
proof as to the reasonableness, necessity and relatedness
of her medical bills to her injury of November 6, 1989,
and
h. Failing to preserve on appeal issues pertaining to the
reasonableness, necessity and relatedness of new medical
bills incurred by Fisk to treat her reflex sympathetic
dystrophy condition.
28, As a direct result of Defendants' breach of their
contract, promises, representations and duties to the Plaintiffs,

We do have a hearing in this matter set for November 28, 1990,
The doctors have not responded to my Subpoenas. I have asked
Claimant's counsel a number of times for the medical reports. I
refuse to have the Claimant examined until I have all of the
medical reports 50 we can differentiate between what may have
happened to the Claimant on the date of this injury and her prior
problems. This will be discudsed at the time of the hearing with
the Referee.

Dear Ms. Shuey:
please be advised that the undersigned is assisting Attorney
Leventhal with regard to the litigation in the above captioned
case. Most recently, I attellded the deposition of Or, Black
which wss taken by Claimant's counsel on May 8, 1991. Or. Plack
testified that he first saw the Claimant on March 23, 1990 an a
consult for Dr. Ranieri. Or. Black testified that prior to his
seeing the Claimant, she was suffering with long-standing
reflexive sympathetic dystrophy, In fact, he related her
symptoms of pain with radiation to the left knee as part of her
symptoms of RSO. When he saw the patient, he stated that her
current complaints were pain in her back bilaterally radiating in
her legs to the feet. lie also stated that she had chronic pain
syndrome with depression and sleep disturbance.
"is recomm,oded course of treatment was for the Claimant to
undergo surgery on her low back and the Claimant did eventually
undergo an operation during October of 1990. She had a lumbar
laminectomy with biloteral disc removal. On October 21, 1990,
the date of discharge, Dr. Black felt thet her prognosis for
lumbar surgery should be excellellt. Ilowever, her prognosis from
her chronic reflexive sympathetic dystrophy remains guarded.
Clearly, the doctor establiahed on the record that they are two
separate injuriea, lie tied the reflexive sympathetic dratrOPhY
to the 1985 injury for which the ohio Casualty Company ,on the
rlak.
Although the prognosis after the laminectomy was excellent, the
Claimant had ,uffered a setback when she developed all irritation
of the meninges seal aurrounding her spinal cord. The doctor
stated that moat likely this irritatioll resulted because of the
Claimant', sensitivity devaluped by her RSO. lie anticipates that
she will be undergoing surgery in the near fut;.ure to correct the
disturbance to her meningos Beal.

He cOllcluded that she is currently ~otally disabled and unable to
work and he stated that he would not be able to determille the
extent of her disability until the meninges seal surgery was
completed.
Finally, Or, Black was very adamant about the fact that he is not
treating this patient for RSO and he refuses to treat her for
that condition. lie stated that patiellts who suffer from that
condition require very extensive and long ongoill9 care which he
is not willing to provide. lie stated that her RSO is being
treated by Or. Rallieri.
As Attorney Leventhal advised you through his correspondence of
November 28, 1990, we cannot resist the exposure on this case.
Clearly, Or. Black has established a new injury as of November,
1989. However, with the doctor's testimony, I think that we are
in a much better posture to have the Ohio Casualty Company
maintain responsibility for the medical bills of Or. Benner and
Or. Ranieri regarding the 1985 incident.
It is my understanding that the ohio Casualty Company has cut off
the Claimant's medical entirely after the incident of November,
1989. If push comes to shove, it will be necessary for us to
file a Petition to Review the medicals in this case so that a
Referee can make a final determination as to the responsibility
on continuing medical treatment.
We will proceed in this matter by accumulating all medical
records and carefully reviewing the same. We will also forward
to you as Boon as possible the report of Or. Thomas W. Byron
following the independent medical examination scheduled for June

B. Plaintiffs allege in their complaint that an attorney-
client relationship existed between the plaintiff Old Republic
Insurance and the defendants pertaining to a workers' compensation
proceeding filed by one Martha S. Fisk against her employer, the
Tunkhannock Area School District and that the defendants breached
their duty of representation to the plaintiffs resulting in damage
to the plaintiffs.
9. All proceedings related to the above workers'
compensation claim were held before the Administrative Law Judge
and the Workers' Compensation Appeal Board in Lackawanna County.
