AND NOW, this 27th dllY of July, 1995, the
Defendant, Kenneth R. Binkley, now appearing in Court with the
Publio Defender, Ellen K. Barry, Esquire, and having tendered
plees of guilty to four oounta of Indireot criminal Contampt for
violation of a Temporary Proteotion from Abuse Order previously
entered in this oaee, and the Commonwaalth, in the peraon of
Jaime M. Keating, Esquire, and ooun.el for the Defendant having
agreed that the aentenoe in this oa.e will be a sentenoe of
probation of three month., and that in the event of a revooation
of probation, the .entenoe of the Court will be three month.
imprisonment on eaoh count, with the perioda of imprisonment to
run oonourrently with each other, the Defendant'. plea. of
guilty are aooepted.
Pursuant to the afore.aid agreemant of ooun.el,
the .entenue of the Court is that the Defendant pay the oosts of

AND NOW, this 26th day of July, 1995, this Court certifies
that the attached complaint has been properly completed and
verified, and there is probable cause for the issuance of
process. In consideration of the attached Commonwealth's
Petition, the defendant, KENNETH R. BINKLEY is directed to appear
for trial on the charge of Indirect Criminal contempt before the
Court on the ll!J1 day of July , 1995 at 3:00 o'clock
p.m. in courtroom. 2.... of the Cumberland county Courthouse,
Carlisle, Pennsylvania.
The defendant has a right to be represented by an attorney.
If the defendant cannot afford an attorney, upon request one will
be assigned to represent the defendant. If the defendant wishes
assignment of counsel, contact should be made prior to trial with
the Cumberland County Public Defender's Office at 717-240-6285.
Further, if the defendant fails to appear, an arrest warrant will
be issued.
The Sheriff of cumberland county is directed to serve this
Order and Petition upon the defendant. The assessment of costs
to be determined by the Trial Judge subsequent to trial.

Jaime M. Keating, Assistant District Attorney of cumberland
county, pennsylvania brings the following Petition for a hearing
on charges of Indirect Criminal contempt:
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached criminal complaint.
3. The victim requeste the filing of an Indirect criminal
contempt charge upon information received.
4. The District Attorney's Office approves the filing of
thie criminal complaint.
5. The Commonwealth is requesting a trial on the charges
of Indirect Criminal contempt pursuant to 23 pa.c.S.A. 56113.

h) 011 or ahout April 211, 1995. Ihe defendanl gmhbed Ihe parties' II ye<lr-old
daughler, Alisha, by her arm and dmgged her upstairs. When she got inlo the
lop bunkbe.d the defendanl gmbhed her by the arm again and dragged her oul of
the top bunk causing the child to hit her back on the bed frame. The child
sustained bruises and abrasions approximately 10 inches in lenglh on her back as
a result of this incident.
c) On or about April 12, 1995, the defendant spanked the parties' 3 year-old
daughter, Victoria, missed her bUllocks and struck her on lhe back, The child
sustained red marks and bruises about her back as a result of lhis Incident.
d) On or about April 2, 1995, the defendant picked up the plaintiffs 10 yc.1r-
old son, Clayton Geesaman, and threw him into his bed causing the child 10 hit

grabbed the plaintiff by her arms in a manner that frightens and intimidates her.
h) On or about August 31, 1994, the defendant kicked lhe plaintiff in the shin
with his stecl,lOed work boots so forcefully that it caused her to fall to the floor.
i) On or about May 13, 1994. Mother's \)ay, the defendant slammed the
door in the plaintifrs path causing It to strike her body with such force lhal she
began to hemorrhage, When the plaintiff sought medical allention for her injuries
sustained as a result of this incident. she was advised thai she was pregnant and
lhat the blow had caused the placenta to separate from her uterus, The parties'
daughter, Mylayla. was bom 3 months premature as a result of this incident.

NATURE or COMPLAINT INCLUDING PROBABLE CAUSE STATEMENT:
On June 18 1995 at approx. 1010hrs this officer received notification of an
active don~stic at 208 Second St. West Fairview Boro. Upon arrival at residence
this officer came in contact with a Robin BINKLEY who stated that her husband Kenneth
BINKLEY had entered the residence and grabbed hold of her and stated "that he could
not take it any more" spun her around the room and departed the residence and fled
into the street. During his~d~parture from the l'esidence Kenneth R. BINKLEY cut the
telephone line on the outside of the residence.
Robin BINKLEY does hold an active Protection from Abuse Order signed by the
Honorable Judge J. Wesley OLER Jr., and stipulates that Kenneth BINKLEY is excluded
from the residence of 208 Second St. and ordering tl~t he is to refrain from any contact
with Robin BINKLEY or the minor children.
Due to the aforementioned facts, this officer respectfully requests that a
warrant of arrest be issued for Kenneth R. BINKLEY.

The defendant did violate a Protection From Abuse Order by contacting
the plantiff/victim Robin Kathleen BINKLEY, via telephone on four times
within a one hour time frame and the defendant did also drive past the
plllntiff/victim's residence within that same hour aa well.
All of these acts were in violation of the order signed by the
llonorab1e J. wealey OLER Jr., dated May 19, 1995, which directs the
defendant to be e~clud9d from the reaidence of 20B Second st., West Fairview,
and from lIny direct or in-direct contact with victim/plantiff Robin Kathleen
BINKLEY, her minor children and her relatives.

NATURB OP COMPLAINT INCLUDING PROBABLB CAUSB STATBMBMT:
On June 25, 1995 between the hours of 2230 to 2345 the defendllnt did
lIppllrently contact the victim Robin Kathleen BINKLEY via telephone from
an unknown location. The defendant called the victim on four occassions
within a one-hour time frame. According to the victim, he identified himselt
ellch time,lInd was requesting the victim to meet with him inorder to
get the charges against him "dropped". When the victim declined each time
he called, the defendant drove passed her residence within that eame hour
but did not stop.
The victim does have an active Protection From Abuse Order signed
by the Honorable Judge Wesley OLER and dated May,19, 1995. This Order
excludes the defendant from the victim's residence of 208 Second Street,
West FlIirview and also orders him to refrain from any direct or in-direct
contact with the victim.

A. ABUSE
1. The plaintiff, Robin K. Binkley, Is an adult individual residing at 208 2Rd Street,
West Fairview, Cumberland County, Pennsylvania 17025,
2, The defendant, Kenneth R, Binkley, (SSN: 184-48-9862)(0,0,8.: 12/31/57), is
an adult individual whose whereabouts are unknown to the plaintiff.
3, The defendant is the husband of tbe plaintiff and the father of three of her eight
children,
4, Since approximately 1988, the defendant has allempted to cause and has
iRlentionally, knowingly, or recklessly caused serious bodily harm, to the plainllff, physically
abused the minor children, has placed the plaintiff and minor children in reasonable fear of
imminent serious 11ll\lily injury, allll has knowingly .'ngaged in iI WurSl' of l'llnduct or repealedly
committed ilcls Inwilrd the plainlil" ilnd Ihe minor children under l'irl'umslances which have
placed the plaintiff and Ihl' minor children in reasonahle kar of hndily injury, This has

iI) On or IIhout May ll, 199~, Ihe defendant grahhed the parties' II year-old
daughter, Ashley, hy the hack of her Iwd IInd pushetl hl'r hC<ld tnward the
hathluh, The child suslailll'd a large red mark on the hack of her neck as a result
of this incident.
h) On or ahout April 2(" 199~, Ihe defendanl grahhed Ihe parties' II year-old
daughler, Alisha, hy her arm and dragged her upstairs, When she got illlo the
top hunkbed the defendant grahhed her hy the arm again and dragged her out of
the top bunk causing the child 10 hil her hack on the hed frallle, The child
suslained bruises and ahraslons allpruximalely 10 inches in length on her back as
a reiullof Ihls incident.
c) On or ahout April 12, 199~, Ihe defendanl spilnked the parties' 3 year-old
daughler, Victoria, missed her huttoch ilnd stnll'k her on the hack, The child
sustained red marks and hruises ahout l1\'r hark as a result of this incident.
d) On III ahout April 2, 199~, the defl'lIllanl pirkl"d up the plainliff's 10 year-
old son, Clayton Oc'esaman, and threw him Inlo his hed rausing the dlild to hit
his head nn the headhnant. The child sustained II large IUlllpon his head as a
result of this Incident. During the Ilasl 11 nlllllths the defendant has grabbed,
shoved, slapped and punched Clayton, The child has sustained red marks and
bnlises ahout his head, face and body as a result of these incidents,
e) On or ahout March 15, 1995, the defendant spanked the parties' 5 year-old
daughter, Kendra, missed her hullocks and struck her on the hack, The child
sustained red marks and hruises ahout her back as a result of this incident.
t) In or about November, 1994, the defendant threw a wooden jewelry box
at the plaintiff while she was holding the parties' 3 month-old infant daughter.
To avoid being hit, the plaintiff dodged the object, and it hit Ihe wall causing a
large hole in the drywall.
g) SiRce approximately August 31, 1994, Ihe defendant haS repeatedly
grabbed the plaintiff by her arms in a manner that frightens and intimidates her.
h) On or about August 31, 1994, the defendant kicked the plaintiff in the shin
with his stecl-tocd work boots so forcefully that it caused her to fall to the noor.
i) On or about May 13, 1994, MOlher's Day, the defendant slammed the
door in the plaintiff's path causing it to strike her body with such force thai she
began to hemorrhage, When Ihe plaintiff sought medical allenlion for her injuries
sustained as a result of this incident, she was advised that she was pregnant and
that the hlow had caused the placenta to separate from her ulerus, The parties'
daughter, Mylayla, was born 3 months premature as a result of this incident.
j) In or aboul 199.1, the plaintiff sought a Protection Order againsl the
defendant in Perry County, During the term of the Order the defendant violated

II. The plaintiff currently has no placc to stay with her childreR exccpt thc marital
home, aRd the defcndant has family and friends in the area with whom he can stay, The
defendant left the marital hOllle on Wednesday, May 10, 1995, and has been staying at a location
unknown to the plaintiff.
12. The plaintiff desires possession of the home so as to give the greatest degree of
continuity to the lives of the children and to allow them to continue their education at their
schools and to continue their school and social activities.
13. The plaintiff desircs the defendaRtto provide suitable alternate housing for her and
the miRor children,

14. The defeRdant has a duty to support the plaintiff and the parties' three mlRor
children.
15. The plllintiff is iR need of financial support from the defendant including, but not
limited to: health Insurance coverage, payment of unreimbursed medical cxpenses for the
plaintiff the parties' three minor children, and the rent payment on the residence at 208 2Rd
Street, Wcst Fairview, Cumberland County, Pennsylvania,

llloomfield, Perry County, and has annual salary of apprmlmately $21.500,
