A pretrial conference was held before the Honorable
George E. Hoffer, Judge, on Wednesday. February 26. 1997,
In this vehicle accident negligence case, Richard A.
Sadlock, Esquire, appears for the plaintiff: and Michael B.
Scheib, Esquire, represents the defendant.
Plaintiff was traveling south on Route 81 in
Cumberland County on the dote of the occident. The defendant
was in 0 pickup truck loaded with large boxes of furniture that
he hod purchased that evening. Plaintiff claims that the boxes
were not properlY secured in the bed of the pickup truck, that
they fell out, and that plaintiff come upon them without any
chance to ovoid collision.
Plaintiff was driving his motorcycle behind
defendant's truck. Neither party is clear os to how for behind
defendont.s vehicle that the plaintiff was traveling. Defense
claims that plaintiff was traveling too close behind 0 tractor
trailer. on his motorcycle. when plaintiff switched lanes and
encountered the box in the center lone; defendant has evidence
to indicate that the plaintiff hod 0 blood alcohol content at
the time of the driving of over .20. Plaintiff was subsequently
arrested for DUI during this incident and has been convicted in
Cumberlond County Court. Plaintiff agrees the conviction per se
may be Introduced os negligence and that the Jury moy be charged

On October 21, 1994 at approximately 740 pm, Plaintiff Robert Nethken was
operating his motorcycle In a southerly direction on State Route 81 Mr Nethkon believe
he was travellinp in the far left lane when a lanker truck entered the lane in front of him
Rather than ba subjected to fumes end road debris from the tanker truck, Mr
Nethken moved into the center lane Immediately upon entering the center lene, Mr
Nethken encountered several large boxes that had fallen off of Defendant's pick-up truck
Defendant had passed through the eccldent slle several minutes prior to Mr Nelhken
and dropped several boxes of furlllture off of the back of his pick-up
Liability is based on Defendant's failure to secure Ius load, failure to be alerl and

After striking one 01 the boxes, Mr Nethken skidded on his side coming 10 rest
on the highway. Mr Nethken's injuries Include multiple rib frectures, contusions, and a
ruplured spleen requiring surgical rapair end resulting in e signiliconl scar. Mr.
Nethken's recoverable medical bills lotal $23,22720

AND NOW comes ths Plaintitt, by and through his attorneys,
Angino & Rovner, P.c., and hereby enters the tOllowing Reply to the
New Matter ot Defendant:
26. Insotar as Detendant is attempting to incorporats
paragraphs 1 through 25 into paragraph 26, the allegations
contained in those paragraphs are hereby denied.
27. Denied. Plaintitt's Complaint does in tact state a cause
of action upon which relief may be granted.
28. (a-j) Denied, None ot Plaintitt's injuries were caused or
were the result ot Plaintift's alleged negligence, Plaintiff was
not negligent in any manner,
(a) Denied. Plaintlft properly operated and controlled his
motorcycle under the circumstances which contronted him at that
time ot the incident.

Plaintitt took all reasonable and prudent
evasive actions which were available to him based on the tacts and
circumstances as alleged in the complaint.
(c) Denied. Plaintitt maintained his motorcycle under proper
control under the tacts and circumstances as alleged in the
Complaint. He had no opportunity to either avoid the accident or
otherwise protect himself against the debris which laid in the
roadway.
(d)
Denied.
Plaintitt in fact did keep a proper lookout.
However, because the debris was not clearly visible, Defendant is
completely responsible tor Plaintiff's injuries.
(e) Denied. Plaintitt was in no way careless, negligent or
reckless. He operated his motor vehicle in a sate manner.
(f) Denied. By the time Plaintitt noticed the debris in the
roadway, it was too late tor him to take any evasive action. The
complaint describes the manner in which the accident occurred, and
describes the manner in which Plaintiff was in no way negligent.
(g) Denied. Plaintitf operated his motor vehicle in a sate
manner and is in no way responsible for his own injuries,
(h) Denied. Plaintitt did not operate his motorcycle at an
excessive rate ot speed tor the conditions then existing on the
roadway. He operated his motorcycle in a sate and caretul manner.
(i) Denied. Plaintitt drove, operatod and was in physical

control of tho movement ot his motorcycle and was tully capable of
safe driving. Detendant's conduct is the sole and proximate cause
of the injuries which Plaintift sustained. Plaintift was not under
the influence of alcohol and/or a controlled substance.
Alternatively, Plaintitt's use ot alcohol in no way rendered him
incapable of safe driving.
(j) Based upon information and beliet, Plaintitt denies the
allegations contained in subparagraph (j). Additionally, Plaintiff
affirmatively alleges that he was not under the influence of
alcohol to the point that it made any ditference in his ability to
control his motorcycle. Detendant's conduct was the sole and
proximate cause of the injuries sustained in the instant action.
Additionally, any measurable blood alcohol level is inadmissible in
the instant action. Plaintitf denies the blood alcohol content
cited by the Detendant.
29. Denied. Plaintitf was in no way contributorily and/or
comparatively negligent and there tore contributory and comparative
negligence in no way relates to the allegations contained in the
Complaint or defenses r3iE:ed by the Detcndant in its anllwer.
Alternatively, no contributory or comparative negligence rises to
the level of being a substantial factor in bringing about
Plaintiff's alleged injuries and damages. Detendant is solely
responsible for Plaintitt's injuries,
30. Denied. Plaintiff's injuries and damages are in no way

6. While Nethken was tl'avellin~l southbound, a tanker truck
pulled from a lane to the right of Nethkml into Nethk(~n' II lane of
travel, blocking his ViclW in his lane of travel.
7. The tanker tl'uck appeal'ed to be stainless steel and
Nethken did not notice any markings on the tl'uck. It had barrel
tubes facing him, which also appeared to be stainless steel.
8. After following the tanker truck approximately 15 to 30
seconds, Nethkell looked in his right rearview mirror and seeing no
cars immedIately to his right, blinked and moved into the right
lane.
9. Almost instantaneously with his movement into the lane
immediately to his right, Nethken' s motorcycle stl'uck a box located
Immediately in front of him.
10. Nethken could not avoid colliding with the box in that he
had just pulled out from behind the tanker truck, there was
insufficient lighting on the Interstate, the box was not visible,
it was a very dark night and he had no time to react.
11. The box had fallen out of an open bed pick-up tnlck (the
"pick-up") driven by Smith.
12. The pick-up was owned by Hay Staver, 12880 Stonewall Rd.,
Shippensburg, Pennsylvania 17257.
13. When Nethken collided with the box, his motorcyde flew
off the Interstate, onto the right side of the road.

1'1. By reason of the aforesaid injuries Elustained by
Plaintiff Nethken, he was fOl'ced to incur liability for medical
treatment, medications, hospitalizatiollEl and similal' miElcellaneous
expellses in an effort to reEltore himElelf to health, and claim iEl
made therefor.
18. Because of the natul'e of his injuries, Plaintiff Nethken
has been advised and, therefore, avers that he may be forced to
incur similar expenses in the future, and claim is made therefor.
19. As a result of the aforementioned injudes, Plaintiff
Nethken has undergone and in the futul'e will undergo gl'eat physical
and mental sUffedng, great inconvenience in calTying out his daily
activitieEl, loss of life's pleasures and enjoyment, and claim is
made therefor.
20. As a result of the aforesaid injuries, Plaintiff Nethken
has been and in the future will be subject to great humiliation and
embarrassment, and claim is made therefor.
21. As a result of the afOl'ementioned injuries, Plaintiff
Nethken has sustained work loss, 10SEl of opportunity and a
permanent diminution of his earning power and capacity, and claim
is made therefor.
22. As a result of the aforesaid injuries, plaintiff Nethken
has sustained uncompensated wOI-k 10SEl, and claim is made therefor.

23. Plaintiff Net:liken continues to be plagued by pel'sistent
pain and limitation and, therefOl'e, avrnlJ that hiu injul'ies may be
of a permanent nature, causing H'sidual lll'oblemfJ fOl' the 18mainder
of his lifetime, and claim is made therefor.
24. As a result of the aforeuaid accident, Plaintiff Nethken
has suutained scal'U which wi 11 refJ\llt in a permanent disfiqlll'ement,
and claim is made there10r.
25. As a l'esult of the afolesaid accident, Plaintiff Nethken
has sustained significant monetal'y damages including, but not
limited to damage to his motorcycle, clotheu, personal belongings
and effects, etc. and claim iu made therefor.
WIIEREFORE, Plaintiff Hobelt Nethken demands judgment: against
Defendant John K. Smi thin an amount in excess 01 $20,000,
exclusive of interest and costs and in excess of any jUl'isdictional

We are in receipt of your subpoena requesting any records (or
testimony) concerning Robert Nethken, Pursuant to federal
conCid(!ntiality laws and regulations (s(!e 42 U,S.C. 55 290ee-),
290ff-3, 42 CFR Part 2) we are unable to comply with your request
or even to acknoWledge whether or not this individual is or ever
was a patient in our program,
The federal confidentiality laws and regulations prohibit release
of information about current or former patients without written
patient consent in a form specified in the regulations, (See 42
eFR ss 2,31), A general medical release is not sufficient,
Furthermore, the federal law and regulations prohibit a program
from diSClosing information in response to a subpoena Unless the
court also issues an order in compliance with the procedures and
standards set forth in Subpart E of the regulations, ss, 2,61-2.67,
Btlfutu the court may issue SUch an order, both the program and the
alleged patient must be notified of the proceedings and given an
opportunity to appear in person or file a responsive statement (ss
2,64 (b) ) and the court must find that "good cause" exists to
