AND NOW come the Defendants, Jesse L. Yeager and Geraldine L.
Yeager, by and through their attorney, William c. Costopoulos,
Esquire, and respectfully represent as follows in support of this
Answer and Counterclaim:

8, Denied. It is specifically denied that the Mortgage is in
default. To the contrary, by letter dated May 5, 1995, Defendants'
attorney forwarded to Plaintiff two checks ($3,000.00 and
$2,434.90) totalling $5,434.90, which amount was represented as the
total due of arrearages together with interest on the Mortgage. A
copy of the May 5, 1995 letter and checks is marked Exhibit "A" and
attached hereto, For reasons unknown to Defendants, the Plaintiff
returned the check in the amount of $3,000,00 by letter of May 23.
1995 and indicated that it was "an insufficient amount to bring
your account current." A copy of this letter is marked Exhibit "B"
and attached hereto.
9. Denied. It is specifically denied that the amounts
indicated are due. To the contrary. the Mortgage is no longer in
default for the reasons set forth in Paragraph B above which are
incorporated herein.
10. Denied, It is specifically denied that any interest
should accrue. To the contrary, no interest should accrue because
the Mortgage is no longer in default for the reasons set forth in
Paragraph 8 above which are incorporated herein.

WHEREFORE, Defendants hereby demand that judgment be entered
in their favor and against Plaintiff,
counterclaim
Abuse of Process
1. Defendants, Jesse L. Yeager and Geraldine L. Yeager,
husband and wife, are adult individuals residing at 114 West Main
Street, Shiremanstown. Cumberland County, Pennsylvania 17011.
2. Plaintiff, Fleet Mortgage Corp., is a corporation doing
business in the Commonwealth of Pennsylvania with its principal
offices located at 11200 West Parkland Avenue, Milwaukee, Wisconsin
53224.
3. Defendants executed a Mortgage with the Lomas & Nettleton
Company on or about June 19, 1986, a copy of which is attached to
Fleet Mortgage Corp.'s Complaint in Mortgage Foreclosure at the
above docket number, to which Mortgage the Fleet Mortgage Corp. is
the assignee.
4, Defendant Jesse L, Yeager is 81 years of age and Defendant
Geraldine L, Yeager is 74 years of age, Because of their advanced
age, certain medications and general "forgetfulness, " the
Defendants neglected to make payments on the Mortgage over the
course of several months,
5, Upon discovering that Defendants were in default, members
of their family made arrangements to ascertain the amount due and
owing the Fleet Mortgage Corp, in order to make payment in full.
6, To that end, the Fleet Mortgage Corp, adviaed Defendants
and their family that payment of the amount of $5,4]4,90 would
reinstate the Mortgage Inclusive of Intel-eat,
7. By letter dated May 5, 1995, Defendants' attorney
forwarded to thu Fleet Mortgage Corp, two checks ($3,000.00 and
$2,434.90) totalling $5,434,90, which amount was represented as the
total due of arrearages together with interest on the Mortgage, A
copy of the May 5, 1995 letter and checks is marked Exhibit "A" and
attached hereto.
8. For reasons unknown to the Defendants, the Fleet Mortgage
Corp. returned the check in the amount of $3,000,00 by letter of
May 23, 1995 and indicated that it was "an insufficient amount to
bring your account current." A copy of this letter is marked
Exhibit "B" and attached hereto,
9. Despite the fact that the Defendants paid or attempted to
pay the entire amount due and owing on the mortgage, as represented
to them by the Fleet Mortgage Corp., the Plaintiff nevertheless
commenced a mortgage foreclosure act ion on or about May 22, 1995,
by which date the Defendants had already paid or attempted to pay
sum of $5,434,90,
10, The aforesaid conduct of Plaintiff, !'leet Mortgage Corp.,
constitutes the malicious, willful and intentional abuse of civil
process,
11. The aforesaid conduct of 1'1 a int if l, FJ ""t M()f'tgage,
Corp" is outrageous ilnd juotifies the award of punitive damagoD to
Plaintiffs.
WHEREFORE, Defendants. Jesse L, Yeager and Geraldine L.
Yeager, hereby demand judgment against Plaintiff, Fleet Mortgage
Corp., on Defendants' Counterclaim in an amount in excess of the
compulsory arbitration limits plus interest and costs as provided
by law as well as attorney's fees and costs in defending this
action.

6. Denied. The averments of this paragraph are denied because
plaintiff, in fact, advised defendants that their payments totaled
$5,461.09, plus additional expenses incurred and advised defendants to
contact their attorneys, Shapiro & Kreisman for the total amount due to
reinstate their mortgage. See Exhibit "B" attached to Defendants'
Answer and counterclaim.
7 . Admi tted in part; denied in part. It is admitted that
defendants' counsel sent the checks indicated in his letter attached to
Defendants' Answer and counterclaim as Exhibit "A"; it is denied,
however, that said amount was sufficient to cure defendants' default and
pay all arrearages due. See Answer 6 above.
8. Admitted in part; denied as stated in part. It is admitted
that plaintiff returned the $3,000 check; it is denied, as implied in
defendants' Answer, that plaintiff did not return the additional check
in the amount of $2,434.90. Plaintiff, in fact, did return said check.
The checks were returned for the reasons stated in Answer to
counterclaim, Paragraphs 6 and 7 above.
10. Denied. The averments of this paragraph are denied as
conclusions of law requiring no response and factually because plaintiff
did not act maliciously, willfully or intentionally abuse civil process
by returning the checks which were insufficient to reinstate defendants'
mortgage at the time received. See Exhibit "B" attached to Defendants'
