speaking with Suzanne Stoll regardinq the physical condition of
James H. Stoll on May 29, 1993, and said allegations are therefore
denied.

whioh is incorporated by referenoe. By way of further answer,
under the circumstance. and symptoms outlined, Dr. SUllivan, in the
ulua1 couree of hie medical practice, would not have qiven to .uoh
patient the advice and directions which are averred in paragraph

Defendant has no recolleotion or record of writing or "calling in"
a preecription for Mr. James Stoll on May 29, 1993, or at any time
material hereto. However, and in the alternative, if he did
recommend and prescribe such a drug for Mr. Stoll, it was not done
on the balis of the symptoms and conditions averred in paragraph 16
because, under such circumstances and conditions, and in the usual
oourle of his medical practice, Dr. Sullivan would not have ordered
luch a prescription drug for the patient.

which are incorporated by reference.

30. Each and every of the answers and allegations set forth
in paragraphs 1 through 29, above, is incorporated by reference
thereto.
31-32. Each and every allegation of these paragraphs is
denied generally pursuant to Pa.R.C.P. l029(e).
NEW HATTER
33. In the usual course of his medical praotice, Dr. Sullivan
would not have given the orders nor prescribed the medicines for
Plaintiff James Stoll as averred in paragraphs 10, 13, 16 and 17 of
the Complaint, nor does Dr. Sullivan have any recollection or
record of having so advised or treated James Stoll in the manner
alleged on or about May 29, 1993.
34. If Defendant had been made aware of the symptoms and
conditions being experienced by Mr. Stoll as alleged in the
Complaint, and particularly paragraph 15 thereof, he would have
ordered Mr. Stoll to be taken immediately to the Emergsncy Room at
Holy spirit Hospital and would either have met him there to provide
the necessary examination, diagnosis, treatment and follow-up care,
or would have arranged for same by the Emergency Room physician or
other appropriate physician at said hospital.
35. Plaintiffs have failed to state a claim upon which relief
can be granted.

36. Plaintiffs' olaiml may be barred or limited by the
applicable Itatute of limitationl.
37. It il believed, and therefore averred, that discovery
will show that the plaintiffs were neg1igsnt and such negligence
may bar their claiml, in whole or in put, punuant to the
provilione of the Pennsylvania Comparative Negligence Act.
3B. It is believed, and therefore averrt"d, that discovery
will Ihow that the pla1ntifh voluntarily allumed a known rilk,
thereby barring recovery under the doctrine of allumption of rilk.
39. Plaintiff'l Jamel stoll'l injuriel, if any, were
IUltainad as a relult of natural or unknown caulal and not al the
relult of any actin or inaction by Defendant Sullivan.
40. If Defendant provided treatment and care to plaintiff
Jamel Stoll, whioh il neverthelell denied, Defendant provided full,
oomplete, proper, realonabJe and adequate medical care and
treatment in accordance with the applicable Itandard of care.
41. No conduct on the put of Defendant was a lubltantial
factor in cauling or contributing to any harm which the Plaintiffs,
or either of them, may have suffered.
42. If plaintiffs, or either of them, luffeted any damage,
the damage I were cauled by the conduct of otherl over whom
Defendant had no control or right of control.
43. If Defendant elected or recommended any treatment
modality for Plaintiff Jamel Utoll, which is neverthelell denied,

and luch treatment or modality wal and is recognized al proper, but
may differ from another appropriate treatment modality, then
Defendant raisel the "two Ichools of thought" defense.
44. If it is subsequently proved by a preponderance of the
evidence that Defendant made a diagnosis as to the Plaintiff James
Stoll'l phYlical condition, which is nevertheless denied, it is
averred that Defendant took all reasonable and necessary steps to
make a proper and appropriate diagnosis and to the extent it may be
determined that any diagnosis wae in error, Defendant asserts that
the alleqed error in diagnosis was a reasonable and legally
justifiable error and was nevertheless in accordance with
Ippropriate profellional judgment.
WHEREFORE, Defendant William A. Sullivan demands that judgment
ba entered in hil favor and againlt Plaintiffs James H. Stoll and
Suzanne Stoll, with COltl to follow the judgment.

Definitions. The following definitions are applicable to these standard
Interrogatories:
"Document" means any written, printed, typed, or other graphic matter of any
kind or nature, however produced or reproduced, including photographs, microfilms,
phonographs, video and audio tapes, punch cards, magnetic tapes, discs, data cells,
drums, and other data compilations from which information can be obtained.
"Identify" or "Identity" means when used in reference to --
(1) A natural person, his or her:
(a) full name; and
(b) present or last known residence and employment address
(Including street name and number, city or town, and state
or county);
(2) A document:
(a) its description (e.g., letter, memorandum, report, etc.), titie,
and date;
(b) its subject matter;
(c) its author's Identity;
(d) its addressee's identity;
(e) Its present location: and
(f) its custodian's identity;

"Incident" means the occurrence that forms the basis of a caule of action or
claim for relief set forth In the complaint or similar pleading,
"Person" means a natural person, partnerBhlp, anoclatlon. corporation, or

Standard Instructions, .. The following Instructions are appUcabla to thesB

any specialty or licensing board, or if you are now or ever have been a member

c. If you are no longer certified, licensed or a member, give the date your
certification, licensure or membership was terminated and the reason for same;

21. Relationship to Plaintiffs - - Indicate whether you have ever treated Mr.
5toll at any time or for any reason other than the occasion on or about May 29, 1993,
which Is the subject of this litigation, and whether you had any relationship with Mr. or
Mrs. 5toll other than the Incidents that are the subject of this litigation.
22. Telephone Calls with Plaintiffs.. Provide a detailed account of your
telephone contacts with the Plaintiffs on or about May 29, 1993, specifically Including:
a. the manner In which you became aware of Plaintiffs initial call to their
physician (Dr. Cohen), Including the approximate time and date of such
notification, who notified, where you were at that time, and the reason for such
notification:
b. a description of any return call you made to Plaintiffs, Including the location
and time from which you made any such call, the duration of the call, the nature
of the conversation, the identity of all parties to the conversation, and a detailed
description of all Information you received in any such call and any evaluation,
diagnosis or action you made or took as a result:
c. a description of each subsequent call made to you regarding contact with the
Plaintiffs, and any all calls or other actions taken by you as a result of any such
calls, Including the location and time from which you made or received any such
call, the duration of the call, the nature of the conversation, the Idenllty of all
parties to the conversation, and a detailed description of all Information you
received In any such call and any evaluation, diagnosis or action you made or
took as a result:

this Incident, Including but not limited to any communication regarding
prescriptions, consultation or other treatment, and speCifically state for each
such communication where and when it was undertaken, the manner and
method of any such communication, who It was directed to, the nature of any
such communication, and whether any documentation or record of the
communication exists and If so where and under whose custody such a record
exists;
e. If an answering service or telephone service of any kind Is Involved in any ofd
these calls, provide a listing of which calls, the name and address of any such
service or agency, an explanation of your relationship to any such service or
agency, and the n8me of the employee(s) specifically involved In each such call:
and,
f. provide the name and address of any person(s) present during any such calls,
including their relationship to you, and a detailed description of their Involvement
or knowledge of any such calls
23. Other contact with Plaintiffs.. State If you have had any other contact
with either of the Plaintiffs not already disclosed In answer to the above Interrogatories.
24. Procedures for responding to calls.. State if you have a standard
method for responding to phone calls from patients who contact you regarding ailments
over a weekend, and provide a detailed description of it if you do, including:
a. describe how such calls are relayed to you, and how they are returned,
identifying any employee, service or agency involved in this procedure;
b. describe your procedure for obtaining information from patients in such
situations;
c, describe your procedure for responding to patients in such situations;
d. describe your procedure for keeping records or otherwise documenting your
contact and treatment of patients In such circumstances;
e. describe your procedures for determining whether or not to prescribe
medication In such circumstances;
f. describe your procedure for keeping records or otherwise documenting your
decisions and actions regarding the prescribing of medication In such
circumstances; and,
g. Indicate whether these procedures were in effect nnd used at and around May
29, 1993, and if they were not followed st that time Indicate the reason for any
deviation from such procedures.
25. Phone records -. Describe any records or documentallon that document
or list phone call contacts between you and patients. including any patients you were
communlcallng with on behalf of any other physician. including the nature and form of
such records, whether the records exist for the time period of May 28-June1, 1993, and
Indicate:
a. if they do not exist, Indicate if such records ever existed and If so when and
under what circumstances they were destroyed;
b. If they do exist. where they are and the name address and relationship to you
of the person who has custody of them:
c. the character of the Information contained in any such records;
d. how the record(s) was created, when the record(s) was created, and who
created the record(s);
e. the substance of any Information contained in the record(s) regarding calls
between the Plalnllffs and you, or between you and the Plaintiffs, on or about
May 29. 1993;
f. the number of calls Indicated on any such records between you and pallents or
between patients and you on Msy 29, 1993:
g. whether such records Indicate any calls on May 29, 1993, between you and
any pharmacy, or between sny pharmacy and you, and, If such and Indlcallon 18
Included, the name and location of the pharmacy or pharmacies Indicated.
26. Phone "coverage" relationship"" Describe the relationship between
yourself and any physicians that you had an agrel:lment with on May 29, 1993 to .cover"
their pallents over or for any portion of the 1993 Memorial Day Weekend, including:
a. the name, address and relationship to you of all such physicians;
b. the lime period that you were obligated to provide such treatment or coverage;
c. describe in detail any compensallon, payment, benefit or remunerallon
involved in any such arrangement;
d. regarding to this arrangement with Dr. Howard Cohen, indicate how long this
arrangement had been In effect, all participants in any such arrangement, and
whether It Is sllll in effect and If not when it was terminated and why;
e. If there have been changes to your arrangement with Dr. Howard Cohen
describe any such changes, indicate when they took effect, and Indicate the
reason for any such changes;
f. list every occasion in 1993 when you "covered" such calls for Dr. Cohen, and
each occasion In 1993 when he "covered" such calls for you, Including the
durallon of each such period, and the method used to refer calls; and,
g. Indicate any procedure that existed regarding exchanges of Information
between you and other physicians in this sort of relationship in May of 1993,
Including any such procedure regarding information concerning pallents prior to
.coverlng" calls and Information regarding patient contacts or treatment rendered
while "covering" calls.
27. Substance Impaired - - If you consumed any elcohollc beverage,
sedallve, tranquilizer, mariJuana, cocaine, hashish, or other drug or pili on May 29,
1993, state:
a. the nature, amount and type of Item consumed;
b. the amount of time over which It was consumed;
c. the identity of any and all persons who have any knowledge as to the
consumpllon of those items; and,
d. the Identity of the physician or medical practitioner or other person who gave,
purchased or prescribed any of the said items, if any.
28. Rules. regulations. guidelines and laws .,-= Identify each rule, regulation,
guideline, Instruction, protocol, law or other recommendation, manual, code, handbook,
collection of orders or notices or other document or directive you relied on, followed or
considered In your contact with and treatment of the Plalntilfs regarding this matter.
29. Procedure for prescribing drugs - - Describe with particularity your
procedure, regular practice and the regulations or laws to which you understood you
were subject with regard to prescribing or dispensing drugs to patients on or about May
29, 1993, Including:
a. any practice, procedure or habit you maintained with regard to prescribing or
dispensing any such drugs;
b. your practice, procedure or habit regarding examination of patients prior to
prescribing or dispensing any such drugs;
c. your practice, procedure or habit regarding prescribing or dispensing such
drugs to patients you were treating on a temporary basis while 'coverlng" for
other physicians;
d. your practice, procedure or habit regarding the making, keeping and/or
maintaining or any records or documentation of any such prescriptions
dispensing of such drugs, Including the nature of any such records and the
current location and custodian of such records;
e. your understanding or the regulations or laws you were subject to regarding
each of these practices, procedures and habits, and your understanding of
whether your practices fully conformed to these regulations and laws; and,
f. If your practices, procedures or habits with regard to these mailers did not fully
conform with all applicable regulations and laws, your reason for any such
violation.
