On May 28, 1993, the Plaintiff, Linda Mary Garman was operating an automobile
traveling west bound on Pa. Route 641 also known as the Newville Road.

At apprOldmately II :40 A.M. the PlaintilT as she was operating the automobile, saw or
what appeared to be a transmission wire directly in front of her hanging down within her lane of
travel.

The Plainlitf, Linda M. Garman, attempted to avoid coming into contact with the wire and
swerved her automobile to do so. In the process of seeking to avoid the danger, she hit a
telephone pole loeated beside said Pa. Route 641.

The Plaintiff had no warning thatlhe wire was hanging in her lane of travel.

The wire hanging Into the lane of travel was a television transmission wire of Defendant,
Raystay Company.

Employees of the Raystay Company had bcen conduetinll work on said transmission wire
a short time prior to the wirc fallinll into the west bound lane of travel and had leR the area.

The Defendant, Raystay Company, by the actions of its emllloyces, engalled in the
followinll negligent conduct:
a. The Defendant's employees failed to properly secure the television
transmission line which crossed I'a. Route 641;
b. The Defendant's employees failed to adequately determine whether the
television transmission line was properly secured;
e. The Defendant's employees failed to adcquately warn the Plaintiff of the
fallen television transmission line; and
d. The Defendant's employecs failed to use due carc In connecting and
handlinll the television transmission line which crossed Pa. Route 641.

The Defendant's employees knew or should have known that their negligcnt conduct
would jeopardize the safcty of the Plaintiff if the television transmission line fcll onto the travel
lane of Pa. Route 641.

As a result of the negligent conduct of the Defendant's employees, the Plaintiff ran off the
highway and sustained serious damage.

The Plaintiff, Linda Mary Garman, sustained loss of her personal property Including her
clothes.

The Plaintiff, Linda Mary Garman, sustained neck and back injuries which caused
substantial pain and suffering for many months.

The Plaintiff, Lioda Mary Garman, sullered loss of convenlenee and lost time trom her
employment for medical treatment and therapy.
