ZINN, JR., 5S: 194-56-6486 and DOB: 4/28/62, is snJoined from physically abusing the plaintiff, or the minor children, or from placing them in fear of abuae. 2. The defendant is ordered to refrain from harassing and stalking the plaintiff, from harassing the plaintiff's relativee, or the minor children. 3. The defendant is prohibited from removing, damaging, dsstroYing or selling any property owned by the plaintiff or Jointly ownsd by the parties. 4. The court costs snd fees are waived. 6. This Order shall remain in effect for a period of one year or until modified or terminated by the Court after notice or hearing and may be extended beyond that time if the Court finds that the defendant has committed another act of abuse or has engaged in a pattern or practice that indicates continued risk of harm to the plaintiff. 6. This Order may subject the defendant to: i) arrest undsr 23 Pa. C.S. 66113; ii) a private criminal complaint under 23 Pa. C.S. 66113.1; ii;) a charge of indirect criminal contempt under 23 Pa. C.S. 66114, punishable by imprisonmsnt up to six months and a fine of $100.00-$1,000.00; and ivl civil contempt under 23 Pa. C.S. 66114.1. Resumption of co-residence on the '.{ , ". i \ part of the plaintiff and defendant shall not nullify the provisions of the court ordsr. 7. The Pennsylvania State Police Oepartment will be provided with a certified copy of this Order by the plaintiff's attornsy and may enforce this Order by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of the police officer. In the evsnt that an arrest is made under this section, the defendant shall be taken without unnecessary delay before the court that iesued the order. Z I NN, JR., SSN: 194-66-6486 and DOB: 4/28/62, is an adult individual residing at 2961 Croyden Road, Harrisburg, Dauphin County, Pennsylvania, 17101. 3. The defendant is the husband of the plaintiff. 4. Since approximately Au"ust 1989, the defendant hes attempted to cause and has intentionally, knowingly, or recklessly caused bOdily injury to the plaintiff, physically abused the minor children, or has placed the plaintiff and ths children in reasonable fear of imminent serious bodily injury, and has knowingly engaged in a course of conduct or repeatedly committed acts toward the plaintiff and the minor children undsr circumstancee which have placed tho plaintiff and the children in reasonable fear of bodily injury. Tll1S has included, but is not , limited to, the following specific instances of abuse: a. On or about May 21, 1995, the defendant charged at the plaintiff, shoved her into the living room with I enough force to cause her to flip ovsr the couch and fall. The C:eil ,'.,ant then punched the plaint i ff in til" breast and arm area, causing the plaintiff to fall the dsfendant threatened the plaintiff saying that his \ backwards onto the arm of the sofa. Later that day, father was going to get a gun and shoot the plaintiff. When the plaintiff went to the telephone, the defendant grabbed the phone from the plaintiff, ripped the phone cord in half, thrsw it at the plaintiff hitting her in the chest, and thrsw the phone at her. When the plaintiff went down the hallway to escape further abuse, the defendant followed her, threatened her several times saying that his father would kill her, stood extremely close to her face, screamed at her while pushing her backward, and trapped her in a corner, and waved his fist in her facs. When the defendant drew back both fists as if to punch the i' plaintiff, a friend of ths plaintiff yelled at the defendant telling him not to hit the plaintiff. The defendant eventually left and the Pennsylvania Stats police were called and charged the defendant with i. harassment. The plaintiff suffered bruising about her breast and arm. b. In or around August 1994, the defendant hit the plaintiff several times and pushed her onto the couch causing her to flip over it. bruising. The plaint i ff suffered G. The defsndant abuses the children in ways inclUding, but not limitsd to, the following: beating them about their back and buttocks with belts. wooden spoons, flyswatters, elnctrical cord, and his hand causing bruises. 5. The plaintiff believes and therefore avers that she and the minor children are in immediate and present danger of abuse from the dsfendant should they remain in the home without the defendant's exclusion and that they are in need of protection from such abuse. 6. The facts of the most recent incldent of abuse are as follows 1 On or about September 20, 1998, Plaintiff found out that Defendant, in front of her eight year old daughter and her friends, had threatened to shoot, kill, and toss her daughter's friends in a creek because they borrowed a video tape and calculator and had not returned them causing Plaintiff. to fear for her daughter's safety and the safety of her friends. When Plaintiff discussed this incident with Defendant, he punched at Plaintiff who moved to avoid being hit. Defendant punched a wall twice leaving indentatiolls and causing Plaintiff to fear for her safety. Plaintiff went into another room to get her child and leave, but Defendant followed her exacerbating her fear. Defendant abruptly ran to the car and left, but returned later that day, punched at Plaintiff again, kicked and hit Plaintiff several times in the legs, and threatened to kill her before he would let her divorce him. Defendant hit Plaintiff's face between his hands breaking her glasses and resulting in the bruising of her eyes and the side of her face. Plaintiff contacted the police who charged Defendant with simple assault, disorderly conduct, harassment, and terroristic threats. 13. Defendant has committed the following prior acts of abuse against Plaintiffl a. During the week of September 20, 199B, Plaintiff was informed that Defendant grabbed their daughter in the genital area on at least one occasion and had on several other occasions attempted to touch her in inappropriate areas causing the Plaintiff to fear for her daughter's safety. The police are investigating the matter. b. In or about June 199B, Defendant pushed Plaintiff, and, in front of the minor child, Mary Ellen, slapped, punched and pulled the hair of Plaintiff's pregnant eighteen year old daughter. When Plaintiff tried to intervene, Defendant repeatedly punched and kicked Plaintiff. o. Since November 1997, Defendant has on several different occasions, punched Plaintiff, kicked, and pushed her, and threatened her saying he would burn tho house down and murder her before he would let her go. d. On or about June B, 1995, a Protection from Abuse Order was entered under the above captioned number. Plaintiff's fear of abuse is exacerbated because of Defendant's history of abuse which included the following I shoving Plaintiff causing her to flip over a couch, punching her, threatening that his father would shoot her, pushing her, drawing back his fists in a threatening manner, slapping her, grabbing her by the wrista and shoving her backwards injuring her wrist. Defendant has a history of abusing the child in ways including I beating her about the back and buttocks with belts, wooden spoons, flyswatters, electrical cord, and his hand causing bruises. 14. The following police department or law enforcement agency in the area in which Plaintiff lives should be provided with a copy of the Protection Order I West Shore Regional Police Department. 15. There is an immediate and present danger of further abuse from the Defendant. 16. Plaintiff is asking the Court to exclude Defendant from the residence at BJ3-A Markel Street, Lemoyne, Pennsylvania, which is leased by Plaintiff and Defendant, but Defendant left the residence on or about September 20, 199B. 17. Defendant owes a duty of support to Plaintiff and the minor child. WHEREFORE, PLAINTIFr REQUESTS THAT THE COURT ENTER A TEMPORARY ORDER, AND AFTER HEARING, A FINAL ORDER THAT WOULD DO THE FOLLOWING I A.
