9. Plaint if f haD not pal-t icipated as a party, wi tness or in
another capacity or in othel- I itigation concerning the custody of
the child in this 01- another Court, with the exception of the fact
that the pal-ties entered into a MalTiage Settlement Agreement on
January 28, 1994. Par'agl'aph 19 of said Agreement readu:
"CUSTODY: HUSBAND shall have pr-imary phys ical
custody of the minol- child, WI FE shall have libel-al
periods of part i aI custody for the purpose of
visitation."
Said Agreement was incoqJorated into the final divorce decree
between the parties dated February 8, 1994. A copy of the Decree
in Divorce is attached hereto, made a part hereof and marked
Exhibit "A".
10. Each parent whose parental rights to the child has not
been tel"Olinated and the pel"SOn who has physical custody of the
child have been named as a party to this action.
WHEREFORE, Plaintiff requests the court to grant shared legal
custody and partial physical custody of the parties' minor child,
CASEY M. JOHNSON, to her.

child's school vacation each year, provided that the mother then has motor
vehicle transportation to transport the child to and from these perlodn.

temporary custody. Hother shall he responsible to pick up the child at the
commencement 01 her period 01 temporary custody and the lather shall be responsible to
pick up the child at the end 01 the mother's period of temporary custody.
4. Notwithstandin9 the above, each party shall have the chIld for two weeks each
summer, uninterrupted hy time with the other parent. Each parent shall he responsible
to give written notice to the other parent of Illf'ir intended two week period hy the
lOth 01 April each year.

7. Neither party shall consume alcohol to excess in the presence of the chlld.
8. The parlles have agreed that the chlld'u curfew, when with (dther parent,
shall be 11:00 p.m. "oth parties uhall provide direct snpervlsion {or the child by a
competent adult after 9:00 p.m. on all days and evenings that the child is with that
parent. In light o{ thlu, it is not necessary for the child to check in with the
father hy tel<.phone every evening that she Is wilh the mother. although the child and
the parlleu are encouraged to encourage the child to have frequent telephone
communication with the other parent.
