FRY, hereinafter referred to as Owner, whereby the former undertakes and agrees to pertorm excavallng on: ALL THAT CERTAIN tract of ground In Upper Frankford Township, Cumberland County, Pennsylvania, more particularly bounded and desCribed as follows: BEGINNING at an Iron pin on the boundary line between lands of the Grantor and lands now or fOI merly of Stankovlc, thence North 49 degrees 05 minutes 59 seconds East a distance of 1133,27 feet along lands of the Grantors to a pOint in Township Road 450; thence South 48 degrees 27 minutes 51 seconds East a distance of 69,16 feet to an eXlsllng railroad spike in said Township Road; thenca South 24 degrees 30 minutes 02 seconds East a distance of 316,32 feet to an existing railroad spike in said Township Road; thence South 11 degrees 01 minutes 06 seconds West a distance of 296,58 feet to an iron pin in said Township Road; thence South 18 degrees 47 minutes 14 seconds East a distance of 173,25 feet to an Iron pin; thence along lands now or formerly of Stankovic South 79 degrees 42 minutes 46 seconds West a distance of 725 feet to an iron pin; thence along said lands now or formerly of Stankovic North 61 degrees 32 minutes 37 seconds West a distance of 370 feet to an Iron pin, being the Place of BEGINNING. CONTAINING 12,002 acres more or less, BEING Lot No.2 on the SubdiVISion Plan of Clarence W, Fry and Frances Fry. dated June 21,1985, and recorded in the OHice of the Recorder of Deeds in and for Cumberland County, in Plan Book 48, Page 24, BEING the same property which Clarence W, Fry and Frances Fry, husband and wife, by their Deed dated August 1, 1985, and recorded in the OHice aforesaid, in Deed Book "K", Volume 31, Page 627, granted and conveyed unto Seth N, Fry, single man, NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1,00) Dollar to them In hand paid by Owner, the receipt whereof IS hereby acknowledged, and the further conslderallon mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mectlanlc's liens or claims thereto for or on account of any work done or matenals furnished by them or any of them under said contract or olllerwlse, for, towards, In, or about tile erection and construction of the said buildings 0:1 the lot above deSCribed, and the said Contractor, for themselves. their subcontractors and others under them hereby expressly waive and relinqUish the right to have, file and maintain any mechaniC'S liens or claims against the s8ld buildings or any of them. and agree that thiS Instrument, waiving ttle rlgtlt of lien, shall be an Independent covenant. t :\\'IIl~l\"'~lllo.l\al\~Ut'rJrl!Ttll!\.Hlo.l '.\01' 01...-' WITNESS our hands and seals this -0- ~ day of May, 1995.
