Calarco, the Aui~tanl Di~lrict Attorney in Newark, New York, 10 attempt tulucate Ms. Atwell.
Mr. Calarco's nUke was unahle to proville Ihe pClilioner wilh a rurrent adllre~s fur Ms, Atwell.
II, On April 21, II)I)~, Plaintiff/Petitioner l'lllltacloo the Wayne County
Children and Youth Servkes, Ihruugh which Mr. Atwell previously filed a claim of child
endangerment against Ms, Atwell, in an attempt to ohtain a current address on Ms, Atwell.
Wayne Counly Children and Youth Services was unahle to provide Mr. Atwell with a currenl
address,
C, On April 21, 1995, Plaintiff/I'elitiuner cuntacted the Lyons Police
Departmenl in Lyons, New York, The desk officer informed Mr, Atwelllhat she was familiar
with Ms, Atwell, and Ilhe believed Ms. Atwell was living on the Iltn:ets uf Lyons, New York,
and Ihcrefllre could not provillc hin' wilh a curren I address,
D, On April 21, 11)95, I'laintiff/l'etitioner contacted the New York State
I'olice Ilarracks in WolcOll, New York. The investigator assigned to the child endangerment
case was nol availahle.
Jl, On April 25, 11)95, 1'laintiff/Petilioner conlacted the Town of Nurth Rose
District Cuurt, North Rose was Ihe tuwn thaI issued the aforementioned bench warrants. The
ÿcourt clerk informoo Mr. Atwelllhal ~hc dill not have any information relating to the current
whereabouts of Ms, Atwell.
F, On April 26, 199~, Plaintiff/Petitioner again contacled the Lyons Police
I>epartmenl in Lyons, New York, l11e desk officer informed Mr, Atwell that she had no new
infnrmalion regarding the whereabouts of Ms, Atwell.
(l, On April 28, 199~, Invesligator Dave Miller of the Slate Police lJarracks
In relumed Mr. Atwell's call, and informed him that he (Investigatur Miller) was in possession
of several bench warrants issued for Ms.Atwell, but that he did not have a current adrress on
Ms, Atwell.
H, On June 9, 199~, Plaintiff/Petitioner's counsel, the Family Law Clinic,
allempted 10 serve Ihe Divorce Complaint on Ms. Atwell via certified mail, restricted delivery,
return receipt requesled, at her last known address of 96 Williams Street, Apartment 117, Lyons,
NY 14489. However, this letter was later relurned unclaimed.
I. On July 13, 199~, Plalntiff/Petilitioner's counsel, Ihe Family Law Clinic,
contacted the Wayne Counly Children and Youth Services, Ihrough which Mr. Alwell previously
filed a claim of child endangerment againsl Ms, Atwell. Wayne Counly Children and Youth
Services would not release any information regarding the address of Ms. Atwell.
J, On July 13, 199~, Plalnliff/Petititioner's counsel, the Family Law Clinic,
contacted the Lyons Police Department in Lyons, NY. Several bench warranls have been issued
in Wayne County fllr the arrest of Ms. Atwell. Attemps 10 serve these warrants have been
unlul'eessful as Ms. Atwell continues tu elude police. The Lyons Police Department informed
Ihe Family Law Clinic that their last known address for Ms. Atwell was the same address to
which PlainlifflPelilitioner's counsel attempted service of the Divorce Complaint.
