4. At all times lolnvant helutu, DBfondant, COLD
SPRINGS INN, INC., waB a l'ennBylvania corpolation subject
to the licensing and regulation of tho Penllsylvania Liquol'
code at 47 1'.8. Section 1-101 et.l>oq.
5. At all timos relevant Iierato, [)ufandants, RODEnT
MAKOWSKI AND 1'.J. MAKOWSKI, t/d/b/a COLD SPRINGS INN, INC,
acted through their autliorJzod agents, Borvants, and
employees, who were acting wi thi n the scope of their
employment.
6, The acts and occurrences hereinafter stated took
place on March 25, 1994, bet.ween approximately 1:45 a.m,
and approximately 2: 30 a .m" at or near the Cold springs
Inn, at its aforesaid location.
7. At the aforesaid time and place, Defendant, JAMES
8, ADAMS, was a patI'on of the Cold springs Inn, where he
had been served alcohol Ie beverages by agentB, servants,
and employee8 of Defendant, COLD BI'HINGH INN, INC., during
and after which tlfl had becollle vtBlbly intOXicated, loud,
boisterolls, and combali ve.
B. At the aforesaid tlllle Ilnd place, Plaintiff was

involved in breaking up a fight between Defendant, JAMES B.
ADAMS and another patron. At that time, Defendant, JAMES
B, ADAMS, pushed Plaintiff and loudly stated that he would
be "weiting for" plaintiff when he left the premises.
9. When plaintiff walked out of the door of the Cold
springs Inn, Defendant, JAMES B. ADAMS, attacked him
violently, pushed him against a guardrail, struck him
repeatedly with his fists, and shoved him into a large
pothole along the berm of the roadway directly abutting the
Cold springs Inn.
10. As a direct and proximate result of the aforesaid
actions of Defendant, JAMES B. ADAMS, plaintiff suffered
severe injuries which include but are not limited to:
a. a bimalleolar fracture dislocation of the left
ankle.
ll. As a direct result of his injuries, Plaintiff
has undergone in the past and will in the future continue
to undergo great pain and suffering.
12. As a direct result of his injuries, Plaintiff
may have suffered a permanent disability and permanent
impairment of his earning power and capacity.
13. As a direct result of his inj uries, plaintiff
may have sustained a permanent diminution in his ability to
enjoy life and life's pleasures,
