AND NOW, this ')!U'day of II{I r.J,I~( , 1995, upon consideration
of the attachedCustody Concll,t}Jtion Report, it is ordered and
directed as follows:
1. A Hearing is scheduled in Courtroom No. 11 of the Cumberland
countr Courthouse on the I,)l.~ day of J,(!'(J ...L...',"- , 1995, at
l ~ ~ I ,M. at which time testimony in the above case will be
taken. At this Hearing, the Mother, Patricia A. Warfield,
shall be deemed to be the moving party and shall proceed
initially with testimony. Counsel for the parties shall
file with the Court and opposing counsel a Memorandum setting
forth the history of custody in this case, each party's
respective position on the custody issues, a list of
witnesses that will be called to testify on behalf of each
party and a summary of the anticipated testimony of each
witness. This Memorandum shall be filed at least ten days
prior to the Hearing date.
2. In the event counsel for the parties agree upon retaining
a independent custody evaluator/psychologist to perform an
evaluation in this case, both parties are directed to
cooperate themselves and to also provide the children to
be available for this evaluation. Cost of the evaluation
would be split equally between the parties. The evaluator
shall be deemed to be an independent evaluator and shall
provide counsel for both parties equal access to reports
and information with respect to the evaluation.
3. Pending further Order of this Court, a temporal-y Custody
Order is entered whereby the Mother, Patricia A. Warfield,
and the Father, Neal K. Warfield, shall enjoy shared legal
custody of Amanda Lynn Warfield born March 13, 1988, Andrew
Th"mas Warfield, bo:-n DctofuH' 12, 1989, and Alexander Wayne
Warfield, born September 20, 1992. l'hysical custody shall
be handled with the Mother having custody during the week
and the Father having cuetody on weekends from Friday at
6:30 P.M. until Sunday at 8/30 P.M. Additionally, Father

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE IHTH CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The pertinent information pertaining to the children who are
the subject of this litigation is as follows:
Amanda Lynn Warfield, born March 13, 1988, Andrew Thomas
Warfield, born October 12, 1989, and Alexander Wayne
Warfield, born September 20, 1992.
2. A Conciliation Conference was held on August 11, 1995, with
the following individuals in attendance:
The Mother, Patricia A. Warfield, with her counsel, Paul
Esposito, Esquire, and the Father, Neal K. Warfield, with
his counsel, Stephen Kulla, Esquire.
3. The parties separated in April of this year. Initially,
the Father had primary custody for a few weeks. Since that
time the Mother has had primary custody during the week with
the Father having the children every weekend.
4. The parties are not able to reach an agreement on custody.
The Father desires primary physical custody. He lives in
Chambersburg. The Mother desires to maintain primary
physical custody. She lives in Newville.
5. Father is currently living with another woman and her two
children. Mother resides with all three children. Both
parties have had a history of mental illness problems.
Psychologist evaluations may be in order prior to a Hearing.
6. The status quo is the Mother having the children during
the week and the Father having the children on the weekends.
The Conciliator will recommend that the status quo remain
in effect pending a Hearing.

consideration of the attached Custody Conciliation Report,
ordered and directed as follows:

1. A hearing is scheduled in Court Room No.2 of the cumberland
County Courthouse on the .~Ou. day of ('}t!.t.lI(}..h , 1997 at
'~ (i,m. at which time testimony will be taken in the above
case. At this hearing, the Father shall be the moving party
and shall proceed initially with testimony. Counsel for the
parties shall file wi th the Court and opposing counsel a
memorandum setting forth the history of custody in this case,
the issues currently before the Court, each party's position
on these issues, a list of witnesses who will be called to
testify along with a sununary of the anticipated testimony of
each wi tness. This memorandum shall be filed at least ten
days prior to the hearing date.
2. Upon Father's agreement to incur the cost for an evaluation,
Father may make arrangements to have a custody evaluation
performed by a professional designated by the Father. Mother
shall cooperate with this evaluation and also ensure that the
three minor children and Mother's significant other shall be
involved in the evaluation. Even though Father may be
incurring the cost of the evaluation, this shall be an
independent evaluation and the results shall be shared with
counsel for both parties.
2. Pending further Order of this Court, this COJlrt / s March 11,
1996 Order shall remain in effect.

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The pertinent information pertaining to the children who are
the subject of this litigation is as follows:
Amanda Lynne Warfield, born March 13, 1988; Andrew Thomas
Warfield, born October 12, 1989 and Alexander Wayne Warfield,
born September 20, 1992.
2. A Conciliation Conference was held on August 22, 1997, with
the following individuals in attendance:
The Mother, Patricia A. Warfield, with her counsel, Joan E.
Carey, Esquire, and the Father Neal K. Warfield, with his
counsel, James J. Kayer, Esquire.
3. There is an existing Order for March of 1996 which was done by
stipulation of the parties and gave the Mother primary
physical custody of the children during the school year and
the Father custody during the summer. It also provided
periods of temporary custody at other times for each party.
4. Father now petitions for custody seeking primary custody of
all three children during the entire year. Father says that
the older child has expressed a desire to come to live with
him. Father also has some serious concerns about Mother's
living accommodations for the children and other factors which
Father believes would merit a change in custody. Mother
acknowledges that the older child may have expressed, at some
time, a desire to live with the Father. J/owever, Mother feels
that it is in the best interest of all three children to
remain together at this particular time and desires to
maintain the existing Court Order.
5. The parties are unable to reach an agreement and a hearing is
required.
6. The Conciliator reconunends all Order ill the form as attached.

have, The daughter, Amanda, has been diagnosed with Attention
Deficit Disorder (ADD), The mother has monitored her performance,
including her progress in school, where the child is getting A's
and B's in her academic subjects and performing the required
skills satisfactorily, The mother and daughter have a close
relationship,
As to the boys, the mother has consistently attended to
their needs including the developmental needs of the younger son,
Alex, The mother, who is a trained child care worker, works
consistently with Alex to develop age appropriate skills; for
example, gross and fine motor skills as well as language skills
and color and number recognition, The mother has had long term
employment with Mulberry Child Care where she has had the
responsibility of caring for and teaching toddlers,
The mother has concerns that the fatherte behavior has
adversely affected the children, On several occasions he
attempted to commit suicide including taking pills and slitting
his wrists which traumatized the children, He has received
treatment, including in-patient treatment for depression and the
mother is not certain of his current diagnosis and/or his need
for on going treatment including medication, The father has also
denied the mother phone contact with the children when they are
in his custody for longer periods during the summer.
Lastly, there is no Children and Youth involvement regarding
the mother, She has begun counseling to address issues connected
with her misleading her family(not her children) to believe that
she was diagnosed with cancer, To the best of the mother's
knowledge, her children were not traumatized by this incident,
but she 1S w1lling to work with her counselor and that of ths
children if this is necessary, The mother has consistently
provided and can continue to provide for her children's needs,
She feels that it 1S in the children's hest interest to remain in
her primary custody,
II, WITNESS LIST
Patricia Warfield, the mother, is to testify as to her ability to
provide for the children, her relationShip with them, and her
concerns regarding the father,
Lee Vencak, the mother's hoyfriend, is to testify as to the
mother's relationship with the children and the care she provides
for them, He will also testify to his relationship with the
children,
Faye Ronemus, the maternal grandmother, is to testify as to the
mother's relationship with the children and the care she has
provided for them,
Cecile Hund, the mother's supervisor at Mulberry Child Care, is
to testify as to the mother's ability to provide for the children
under her care,
Children's Teachers, if necessary, are testify as to the children
progress in school,
Melissa Vaccaro, the mother'a long time friend, is to testify as
to the mother's ab1lity to care for the children and her
relationship with them,
Rhonda Danner, the mother's friend, is to testify as to the
mother's ab1lity to care for the children, her relationShip with
