COMPLAINT
1. Plaintiff, Pennsylvania State Employees Credit Union
(hereinafter "PSECU"), is a PennFylvania financial institution
with its principal offices located at One Credit Union Place,
Harrisburg, Pennsylvania 17110.
2. Defendants, Joel L. West and Pamela J. West, are adult
individuals whose last known mailing address is P.O. Box 81, 8174
Lincoln Way East, Fayetteville, Pennsylvania 17222.
J. On or about April 13, 1990, Defendants executed an
Application and Note Personal Service Loan Application (the "Loan
Agreement"), pursuant to which Defendants could borrow monies in
the nature of a revolving loan from PSECU. A true and correct
copy of the Loan Agreement is attached hereto and made a part
hereof as Exhibit "A".
4. On or about September 6, 1991, Defendants executed a
Visa & Mac Application (The "Visa/Mac Agreement") for a VISA/MAC
account with Plaintiff, pursuant to which Defendants could make
purchases and cash advances in the form of an open ended credit
line from PSECU. A true and correct copy of the Visa/Mac
Agreement is attached hereto and made a part hereof as Exhibit
"B".
5. Under the terms of the Visa/Mac Agreement and Loan
Agreement (hereinafter collectively referred to as the
"Agreements"), the Defendants agreed to pay PSECU "(i)n equal
installments not less frequently than monthly, with interest on
unpaid balances at a rate of 12.9\ per year.
6. Defendants have defaulted on their obligations under
the Agreements by failing to make the required monthly payments
since October 15, 1993.
7. The total amount remaining due and owing to PSECU by
Defendants pursuant to the Agreements as of May 26, 1995 is Ten
Thousand Ninety-six Dollars and sixteen Cents ($10,096.16), which
includes principal in the amount of $9,367.06 and interest in the
amount of $729.10.
8. The Agreements provide that in the event of default,
Defendants shall be responsible for the payment of attorney fees
and collection costs in an amount equal to twenty (20\) percent
of ths outstanding loan balance.
9. By correspondence dated April 21, 1995, PSECU, by and
through its attorneys, McNees, Wallace & Nurick, notified the
Dsfendants of their default under the Agreements and demanded

payment thereunder, but Defendants have failed and refused to

WHEREFORE, PSECU demands judgment against the Defendants in
the sum of Ten Thousand Ninety-six Dollars and sixteen Cents
($10,096.16) plus interest, late fees, costs of suit, and
attorneys' fees, which amount requires reference to compulsory
arbitration.

favor of Pennsylvania State Employees Credit Union, Plaintiff, in
the above-captioned action, and against Joel L, West and Pamela
J. West, Defendants, in the above-captioned action, for failure
to file an Answer to Plaintiff's Complaint within twenty (20)
days from the date of service of said Complaint and assess
Plaintiff's damages in the total sum of $9,741.46 as follows:
$9,367.06 as principal, $128,40 as costs, $246.00 as
attorney fees, plus interest at the rate of 12,9\ per year since
October 15, 1993 until Defendant's obligation is paid in full, I
hereby certify that a written Notice of Intention to File this
Praecipe for Entry of Default Judgment was given in accordance
