COMPLAINT
I. The Plainliff. Real Estate Investments, Inc. is a corporation organized
and existing under the laws of Ihe Commonwealth of Pennsylvania with
principle ollice localed 01 33 North Second Street. City of Harrisburg. Dauphin
County, Pennsylvania.
2. Defendant Sheila C. Toland. is an adult individual. sui juris, residing al
3301 Market Street, Camp Hill, Cumberland County, Penneylvania.
3. Plaintiff and Defendanl are owners, as tenants In common, of a
property generally known and numbered as 3301 Markel Street. Borough of
Camp HilI. Cumberland Counly, Pennsylvania, referred 10 hereinafter as "Ihe
properly" by deed dated December 22, 1993 and recorded January 31. 1994 in
Ihe Office of Ihe Recorder of Deeds of Cumberland County In Deed Book T,
Volume 36, Page 1085. A true and correct copy of the said Deed is attached
herelo, labeled Exhibit "A" and made a part hereof. and Includes a more
particular description of the properly.
4. No person other than the parties 10 the Instant action have any
ownership Inlereslln Ihe property.
S. As equal tenants in common the parties are each entitled to a one-
hall undivided interest in Ihe property and joint and equal right in the
management thereof and proflls deriving therefrom.
6. The parties have been unable to jointly agree on the manogement.
possession, occupation or rental of the property and. accordingly, Plalnflff
requests a partition of the property.
7. Despite requests for voluntary partition of the property" Defendant Is
unwilling to divide the property either by purchase from or sale to Plaintiff or by
cooperative sale to the public.
8. Plainliff respectfully requests this Honorable Courl to require the sale
at the said property. paying all reasonable costs at sale. mortgages and liens on
the property and dividing the remainder ot any proceeds therefrom equally
between Ihe porties.
WHEREFORE. Plaintiff respectfully requGsts that this Court decree thai the
property at 3301 Market Street. Borough of Camp Hill. Cumberland County.
Pennsylvania is partitioned and order, that the property be sold and that the
reasonable costs at sale as well as all existing mortgages. liens and
encumbrances of record on the property be paid out of the proceeds of the
sale and the remaining profits therefrom. it any. be divided equally between
the parties hereto.
