Plaint if f IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA vs. No. OLSTEN SERVICES-DIRECT 4720 Carlisle Pike Mechanicsburg, PA 17055 CIVIL ACTION - LAW COMPLAINT AND NOW, comes the Plaintiff, The Patriot-News Co., by its attorneys, Caldwell & Kearns, and states the following: COUNT ONE THE PATRIOT-NEWS CO. vs. OLSTEN SERVICES-DIRECT 1. The Plaintiff, The Patriot-News Co., is a Pennsylvania corporation with a principal place of business at 812 Market Street, Harrisburg, Dauphin County, Pennsylvania, 17105. 2. The Defendant, Olsten Services-Direct, is a business entity with a principal place of business located at 4720 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania, 17055, 3, From October 1, 1994, through March 18, 1995, Defendant entered into various agreements with representatives of The Patriot-News Co. for advertising services within The Patriot and The Evening News. (A copy of an invoice evidencing these agreements is attached as Exhibit A and incorporated herein by reference thereto.) COUNT TWO THE PATRIOT-NEWS CO, vs. OLSTEN SERVICES-DIRECT 4. Advertising was run for Defendant in accordance with these various agreements. 5. As a result of these various agreements, the bill for advertising was $12,354.07. 6. Defendant's last payment was on April 3, 1995. 7. After repeated demands for payment, this bill remains unpaid. B. The failure to pay the balance represents an unjust enrichment on the part of the Defendant and a breach of its contractual obligations to the Plaintiff, WHEREFORE, Plaintiff demands payment from Defendant in the amount of $12,354.07 plus costs of this action. 9, The averments contained in paragraphs 1 through 8 of Count One are incorporated herein by reference thereto. 10. Plaintiff on various dates did submit to Defendant various statements of the balance owed on said obligations and Defendant did fail to object to such statement or respond in any contrary manlier.
