Your Appellant was arrested for allegedly operating his motor vehicle while Driving Undsr the Influence on April 23, 1995, at, 0128 hours by Patrolman Erick J. Colsman, of the Silver Springs Township Police Department. 4. Your Appellant was arrested on SR944 in the area of Sample Bridge Road east of the townohip line. 5. Your Appellant was notified on or about May 18, 1995, that his licsnse wao being suspended for a period of one year whioh would go into effect Januory 7, 1996 at 12101 a.m. A true ond oorrect oopy I of the Notice is ottached ot Exhibit "A". 6. Your Appellant denies that he refuoed to oubmit to breath, i blood or urine testing and that said suspension is improper and unwarranted. 7. The police officer lacked probable couso to stop the Oefendant. 8. The police officer lacked probable cause to arrest the Defendant. 9. The police officer failed to properly inform the Oefendant of his righte pureuont to the implied coneent law. 10. The police officer has agreed to withdraw the charge for the alleged refusal. See Exhibit "B". WHEREFORE, your Appellant reepectfully requeste your Honorable Court to grant him a hear.ing and deny the Commonwealth's request that his license be suspended and your Honorable Court to etay any and all ouepeneions.
