ITIPULATION AOAINIT LIINI
THIS AGREEMENT made the 8TH of June, 1995, by and between
J & B Partners,
hereinafter referred to as Contractor,
AND
Douglas C. Disbrow and Susan E, Disbrow,
hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a
single family residence on that certain lot of ground known as,
Lot 42, Yankee Drive, Liberty Woods subdivision, Borough of Nt,
Holly springs, Cumberland County, Pennsylvania, as shown on Plan
prepared by Walter N, Heine Associates, Inc., dated December 8,
1989 and recorded in Plan Book 64, Page 90,
NOW THEREFORE, THIS AGREEMENT WITNESSETH' That the said
contraotor, for and in consideration of the sum of One and 00/100
Dollar ($1,00) to Contraotor in hand paid by owner, the reoeipt
whereof is hereby aoknow1edged, and the further oonsideration
mentioned in the agreement aforesaid, for themselves and their
suboontraotors, and all parties aoting through or under them,
oovenant and agree that no mechanic's liens or olaims shall be
filed or maintained by them or any of them against the said
building. and the lot of ground appurtenant thereto for or on
aooount of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the ereotion and oonstruotion of the said buildings on the lot
above desoribed, and the said Contraotor, for themselves, their
subcontractors and others under them hereby expressly wa1ve and
relinquish the right to have, file, and maintain any mechanio's
liens or olaims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.
