COMPLAIIIT
1) Plaintiff in the above-captioned action is Stephen F,
Peters, Inc" a Pennsylvania corporation having business offices in
Newport, Pennsylvania with a mailing address of P,O, Box 69, Newport,
Pennsylvania, 17074,
2) Defendant in the above-captioned action is Chamberlin ,
Sons, Ino., a Pennsylvania corporation having business offioes at 311
Skyport Road, Heohanicsburg, Pennsylvania, 17055.
3) In the latter part of 1994 and into 1995, the Defendant
ordered and Plaintiff supplied labor and materials on construotion
projeots. Copies of the bills for the same are attaohed hereto and
I incorporated herein by reference.
I 4) All contraots by and between the Plaintiff and Defendant
were oral and the aforementioned bills were submitted upon oompletion
of the work. The total amount currently due is 34,651.00 as set forth
on the summary attached hereto and marked Exhibit A.
5) The Defendant never objected to the quality of the materials
or the workmanship of the labor supplied.
6) The Defendant had promised an additional payment of
1
$D,OOO.OO in mid-May, but has not forwarded eame and has negleoted or
rafused to return oommunioations from the Plaintiff in referenoe to
tha amount due.
7) The Defendant has never proteated or otherwise stated that
it doas not owe the Plaintiff the amount olaimed herein,
WHEREFORE, the Plaintiff raqueets judgment in the prinoipal eum
of $34,651.00, intereet at legal rate, coete and attorney feas as
applicable,
