THIS AGREEMENT made the /5/<day of August 2002, by and between, Ken Culbertson,
tdba CULBERTSON CUSTOM HOMES, of 7902 Newburg Road, Newburg, Pennsylvania,
hereinafter referred to as Contractor,
RICHARD M. GRIFFIE and MAUREEN J. GRIFFIE, of 20 Heights Road, Newville,
Pennsylvania, hereinafter referred to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owners property situate in Cumberland County, Pennsylvania, known as Lot 29, Crossroads School
Road, Newvitle, situate in West Pennsboro Township, Cumberland County, Pennsylvania, more fully
described in Exhibit "A" attached hereto and made a part hereo£
NOW THEREFORE, THIS AGREEMENT WlTNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the
lot above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any ofthera, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

Pennsylvania, bounded and described in accordance with a Plan prepared by Stanley
Jarmolenko, R.P.L.S., dated January 10, 1989 and recorded in the Office of the Recorder
of Deeds for Cumberland County in Plan Book 58, Page 85.
BEGINNING at a point in southem right of way line of Cross Road School Road T-438
at comer of Lot No. 30 at Cross Road School Road Estates; thence along Lot No. 30 of
Cross Road School Road Estates, South 29 degrees 18 minutes 51 seconds East 967.27
feet to a point at Lot No. 41, Cross Road School Road Estates; thence along Lot No. 41
of Cross Road School Road Estates, South 60 degrees 41 minutes 09 seconds West,
300.00 feet to a point at Lot No. 27; thence along Lot No. 27, North 29 degrees 18
minutes 51 seconds West 662.27 feet to Lot No. 28; thence along Lot No. 28, North 60
degrees 41 minutes 09 seconds East, 150.00 feet to a point; thence still along Lot No. 28,
North 29 degrees 18 minutes 51 seconds West, 300.00 feet to a point; thence along
southern dedicated right of way line of Cross Road School Road, T-438, North 60
degrees 41 minutes 09 seconds East, 150.00 feet to a point the place of BEGINNING.
CONTAINING 5.629 acres and designated as Lot No. 29, on plan of Cross Road School
Road Estates.
BE1NG that same real estate that Harmon Graves Company, a Pennsylvania Corporation,
and KIMBA, Inc., a Pennsylvania Corporation, by their deed dated June 30, 2000 and
recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Deed Book 225 at Page 199, conveyed to Richard M. Griffie and
Maureen J. Griffie, husband and wife, Grantors and Mortgagors herein.
