pstitioner, Kenneth W. Gartzke, by and through his attorney, R.
Mark Thomas, Esquire, files this Petition for Return of Seized
property and in support thereof, respectfully represents I
1. Your petitioner, Kenneth W, Gartzke, resides at 30 Creek
Road, carlisle, cumberland county, Pennsylvania 17013,
2, On or about June 12, 1995, your petitioner'S wife, Shirley
E, Gartzke, filed a Petition for Protection from Abuse and
requested a temporary protection order.
3. On June 16, 1995 the Temporary Protection Order was signed
by the Honorable Kevin A, Hess, and that order directed the North
Middleton Township Police Departmont to turn over to the custody of
the Cumberland county Sheriff's Department two (2) rifles, a
handgun, a BB gun and two (2) knives which were located at your
petitioner'S residence which had been seized from your petitioner'S
residence.
4. On June 23, 1995, Shirley E, Gartzke, through her
attorney, caused a praecipe to withdraw the protection from abuse
aotion with the prothonotary's office,
5. The praecipe to withdraw this action which was filed by
shirley Gartzke included a request that the temporary order be
vacated.
6. As of the date of the filing of this Petition for Return
of Seized Property there has been no order signed vacating the
temporary order of June 16, 1995,
7. Your petitioner desires to have the property which was
seized and is held by the cumberland county Sheriff's Department to
be returned to him,
WHEREFORE, your petitioner prays that this Honorable Court
will enter an order vacating its temporary order of June 16, 1995,
and directing the sheriff to return the seized property to your
petitioner,
