AND NOW, comes Plaintiff, Dennis G. Fillmore, acting as agent
for Pamela A. Zeigler, by and through his attorneys, Reager ·
Adler, P.C., and moves to strike the supersedeas pursuant to
Cumberland county Rules of civil Procedure 3571
1. plaintiff was granted judgment for possession of real
property located at 934 Valley Road, Enola, cumberland county,
Pennsylvania, 17025 on May 18, 1995.
:I. Defendants filed a timely appeal to this judgment on June
16, 1995.
3. Under C.C.R.P. 367, the Defendants were required to
deposit all rental payments to the Prothonotary of cumberland
County.
4. Defendant deposited June's rent on June 16, 1995.
5. Defendants have failed to deposit rent for July.
WHEREFORE, Plaintiff hereby requests this Honorable Court to
strike the supersedeas and grant possession of the property located
at 934 Valley Road, Enola, Cumberland County, PennsYlvania, 17025,
to Plaintiff as well as the costs of filing this Motion.

THAT, intellding to be legally bound, the parties agree as
follows:
1. Lease. Landlord hereby rents to Tenant the premises

(hereinafter the "property"), for the term of one (1) year 'CA

possession, reasonablc wear and tear alone excepted;
h. Return all keys and (If applicable) garage door
openers to Landlord at the expiration or earlier termination of
this Lease. Tenant hercby acknowledges receipt of ~ complete

and with the terms of all state, federal and local laws
applicable to the use of the Property, and save Landlord harmless
from any penalties, fines, costs or damages resulting from
