AND NOW, this -1-'1- day of April, 1996, upon consideration of
Plaintiffs' Affidavit filed herewith, it is hereby ORDERED that the
Defendants are forever barred from asserting any right, lien, title
or interest in and to the land which is the subject of this action
inconsistent with the interest or claim of the Plaintiffs set forth
in their complaint, unless the Defendants file an Answer within
thirty (30) days of the date hereof. If such Answer is not filed
within such thirty-day period, the Prothonotary on Praecipe of the
Plaintiff shall enter final jUdgment.

AND NOW come the Plaintiffs, Clyde lIawbecker and Madeline
Hawbecker, husband and wife, by and through their attorney, stuart
J. Magdule, and file the within Complaint which is more
particularly set forth as follows:
1. The Plaintiffs, Clyde Hawbecker and Madeline lIawbecker,
husband and wife, are individuals who reside at 2313 New York
Avenue, camp Hill, cumberland County, Pennsylvania.
2. The Defendant, Max P. Johnson, is an individual who is
deceased, who was the record owner of a certain parcel of
unimproved ground pursuant to a Deed dated March 26, 1894. A true
and ccrrect copy of said Deed i~ attached hereto, marked Exhibit
"A", and made a part hereof.
3. The Property is contiguous with Plaintiff's propsrty,
located at 2313 New York Avenue, camp lIill, Pennsylvania.
4. For a period in excess of twenty-one (21) years,
Plaintiffs have openly, notoriously and hostile to the outside
world adversely possessed the Property.
5. By virtue of the continuous adverse possession of the
Property for a period in excess of twenty-one (21) consecutive
years, Plaintiffs have acquired fee simple title to the Property
which title shall be complete, free and clear marketable title.
6. Plaintiffs desire that the Dofendant, his heirs, assigns
and successors in interest be barred from asserting any right,
lien, title or interest in and to the property by reason of the
Plaintiffs' adverse possession, which had terminated all of the
right, lien, title or interest of the Defendant, his heirs, assigns
and successors in and to the aforesaid Property.
WHEREFORE, Plaintiffs request that this Court:
A. Enter an Order that Clyde Hawbecker and Madeline
Hawbecker, husband and wife, are the legal owners of the fee simple
title to the Property, which title shall be full, complete, free
and clear marketable title; and
B. That the Defendant, Max P. Johnson, his heirs, assigns
and successors, be forever barred from asserting any right, lien,
title or interest in and to the Property inconsistent with the
interest of the claim of the Plaintiffs.

I, MADEI.INE IIANI3ECKER, being duly sworn according to law I
depose and say as follows:
1. That she is one of the Plaintiffs in the above-captioned
matter.
<1. 'l'hat to the best of her knowledge, the Defendant, Max P.
Johnson, is deceased.
3. That to the best of her knowledge no estate has ever been
filed in Cumberland County for the Defendant, Max P. Johnson.
4. That to the best of her knowledge, several of the heirs
uf Mnx p, Johnson are now deceased and Plaintiff is unaware of the
whereabouts of any of the heirs of the Defendant, Max P. Johnson.
5. That the Plaintiffs huve made reasonable efforts to
determino the whereabouts of the Defendant, and his heirs, by
examination of the telephone records and the records of Cumberland
county.
