Scott Cramer and brings this action against the defendants, above-named, upon a cause of action whereof the following is a statement I 1. Plaintiff William Williams is an individual residing at 92 Glutz Hole Road, Duncannon, Pennsylvania, 17020. 2. Defendant Rodney Clouser is an individual residing at R. D. N3, Box 1982, Newville, Pennsylvania, 17241. 3. Defendant Randy singleton is an individual t/a/d/b/a Car Tunes, Unlimited, with an office at R. D. N1, Box 24, Walnut Bottom, Pennsylvania, 17266. Count I Plaintiff v. Defendant Clouser 4. Defendant Clouser on or about the 11th day of June, 1994, sold to plaintiff a 1973 truck for Three Thousand Eight Hundred ($3,800.00) Dollars and, as an inducement for the purchase of said truck, orally promised and warranted that Baid truck was of first quality, in good shape and condition, and had just passed inspection, which was evidenced by a current inspection sticker. 5. Plaintiff, on or about said date, relying upon defendant's promise and warrant, purchased said truck as aforesaid. R. ~OTT (RAMtR Allorn.... at low P, lJ. Prowe, lit I>uncannon, PA 17020 6. The said truck, at the time of the sale, was defective in that both front and rear brakes did not meet the R, SCOTT CRAMER Attorney ot law p, O. OtOWI" 159 Ouncannon, PA 17020 braking performance standards promulgated by the Pennsylvania Department of Transportation. 7. The plaintiff avers that an examination of said truck at the time of sale would not have revealed any defects as same were latent defects and not readily ascertainable. 8. in order operable Plaintiff hae expended the sum of $1,980.26 dollars, to have the truck pass inspection and be legally for the highway. 9. Despite defendant C10users specific representation that the engine was in good condition, both the engine and transmission were also defective and will be required to be replaced at a cost of $4,000.00. 10. The contract between the parties was oral. WHEREFORE plaintiff demands judgment against defendant Clouser for $5,980.26 plus interest and costs. COUNT II Plaintiff v. Defendant singleton 11. Paragraphs 1 through 10 are incorporated herein by reference. 12. At the time the sale was made, defendant singleton was a duly certified inspection mechanic in the commonwealth of Pennsylvania. 13. At the time of the sale, said truck bore an inspection sticker certifying its inspection on March 3, 1994, which inspection sticker was valid for one year subsequent thereto. 14. Despite having knowledge that the brakes of said truck did not meet the standards promulgated by the Pennsylvania Department of Transportation, defendant singleton represented the truck to have so met the standard and passed the truck for inspection. 15. Defendant singleton used unfair or deceptive acts or practices as defined in the Unfair Trade Practices and Consumer Protection Law (UTPCPL), section 201-2(4) with reference to his representing goods to be of a particular standard or quality while knowing they are of another or lesser standard. WHEREFORE Plaintiff demands judgment against defendant Singleton for three timss the actual damages sustained as per 73 P.S. section 201-9.2 (UTPCPL), plus attorney fees. Defendant Singleton had inspected the vehicle In February of 1994 and he had also Inspected the same vehicle on one or more previous occasions. 2\. Any dalllages sustained by the plaintiff were self imposed by the c1langes he sought to be made to the truck and not tho conducl of defendant Clouser. 22, The averments of paragraph twenty-two (22) are denied. Defendant Clouser is without sufficient information or knowledge regarding the use of the truck by the plaintiff, 23 The averments of paragraph twenty-three (23) are denied. On the contrary, the truck was sold to the plaintiff by defendant Clouser on an "a. is" basis for a reduced price. Mr, Clouser itemized the problems and plaintiff had ample opportunity to Inspect and evaluate the truck but failed to do so, 27. The averments of fact contained in paragraph twenty-seven (27) of the Complalnl are specifically denied, Defendant Clouser did not fail to disclose any item of which he wu aware needed to be checked, The tnlck was inspected in February and was sold to the plaintiff In July. No further inspection was performed by the plaintil1~ 28. The plaintiff did not contact the defendant until many weeks following the sale of the truck. 29. At no time did Mr. Clouser engage in any fraudulent conduct regarding the sale of the truck. 31. The averments of fact contained in paragraph Ihlrty-one (31) of the New Matter are admitted in part and denied in part, It Is admitted that defendant Clouser knew of no defects regarding the truck severe enough to not pan Inspection, In February of 1994 defendant Clouser did notilY Singleton that the brake rotors In the front of the truck were close to needing repaired but that they would need to be checked to be certain of passing Inspection.
