PETITION FOR REVIEW
1. This Court has jurisdiction pursuant to 42 Pa. C.S.A.
Section 933 (a) (1) (ii),
2. Chad W. Flasher, petitioner, is seeking review of the
Department of Transportation's suspension of the petitioner's
operating privileges as a result of violating 75 Pa. C.S.A. Section
1543.
3. The mail date is June 9, 1995, and signed by the Director
of Driver Licensing, Douglas K. Tobin.
WHEREFORE, the petitioner respectfully requests that this
Honorable Court set a date for hearing in this matter and after
hearing hold the Department's action to be improper and order
reinstatement of the petitioner'S driver's license.

violating Section 1543 of the Vehicle Code, DRIVING WHILE
SUSP/REVOKE on 03/14/1995, your driving privilege is being
SUSPENDED for a period of 1 YEARCS) as mandated by Section
1543 of the Vehicle Code.
Effective Date of Suspension: 03/29/1996, 12:01 a.m.
The above mentioned sanction is in addition to any
previously issued sanctionCs).
You will be notified of any outstanding restoration
roquirements apprnx1matelv 30 days before the eligibility
date of the restoration of your driving privilege. You
must follow those instructions very carefully in order to
have your driving privilege restored.

You have the right to appeal the Department's action to the
Court of Common Pleas (Civil Division) within 30 days of
the mail date (JUNE 09, 1995) of this notice. PLEASE NOTE
that this Civil Appeal is in addition to any appeal you
have to file from the criminal conviction. You must follow
the instructions listed below according to your individual
situation.
1. PENNSYLVANIA RESIDENT If you are a resident of
Pennsylvania, you must file an appeal with the Court of
Common Pleas in the County of your residence. Sending a
copy of the appeal which you filed with the Court, to the
Department, will postpone the Department's action pending
a final decision by the Court if the appeal was filed
within the required 30 days. However, if your privilege
to operate a commercial motor vehicle has been
DISQUALIFIED, a signed supersedeas by the judge must
accompany your appeal.
2. NON-RESIDENT If you are not a resident of
Pennsylvania, you must file an appeal with the Court of
Common Pleas in the Pennsylvania County where the violation
occurred. Sending a COpy of the appeal which you filed
wi th the Court, to the Department , will postpone the
Department's action pending a final decision by the Court
if the appeal was filed within the required 30 days.

STATEMENT OF THE CASE
AND NOW, comes the Petitioner, Chad Flasher, by and through
his attorney Austin F. Grogan, Esquire, and avers the following as
to why the suspensions are invalid:
1. Petitioner was found guilty of Driving While Operating
Privilege is Suspended or Revoked.
75 Pa,C.S.A. 1543 (a) on
January 5, 1995.
2. petitioner filed an pro se appeal with the Court of Common
pleas on February 1, 1995. (See attached appeal and receipt.)
3. Petitioner received civil notice of license suspension
dated January 25, 1995. (See attached) .
4, petitioner believed that filing a appeal of the underlying
conviction would act as a stay to the civil revocation,
5, petitioner neglected to file an appeal with the
Prothonotary's Office for Cumberland County.
6. On or about February 10, 1995, Petitioner retained counsel
to represent petitioner in the underlying traffic conviction.
7, Petitioner and counsel did not address the civil
revocation until Petitioner was stopped while driving his car on
March 14 and 18, 1995,
8, petitioner through counsel filed an Appeal Nunc Pro Tunc
on or about April 7, 1995,
9. On April 27, 1995, the Honorable Kevin A, Hess granted
Petitioner's Appeal Nunc Pro Tunc.
10. The Appeal Nunc Pro Tunc allows the civil revocation
arising out of the January 5, 1995, conviction to proceed as if the
Appeal had been filed timely with the Court of Common Pleas.

through his Attorney, Austin F, Grogan, Esquire aver the following:
(1) The Petitioner filed this Petition for Review on June 27, 1995; seeking judicial
review of the Department of Transportation's suspension of Petitioner's driving privileges.
(2) The Petitioner was found guilty of the underlying vehicle offenses on Tuesday,
October 17, 1995 before the Honorable Kevin Hess,
(3) The convictions of underlying negates the civil Petition for Review.
(4) Counsel for Penn Dot has been advised of the convictions for the underlying
appeals.
WHEREFORE, the Petitioner respectfully request this Honorable Court to dismiss the
Petition for Review.
