BARRICK, D.M.D., Defendant COM P L A I N T AND NOW comes Complainant for her Complaint against the Defendent and avers the following: COUNT I NEGLIGENCE 1. Plaintiff is Kathryn D. Beachy, an adult individual, sui juris, a resident of Dauph1n County, Pennsylvania, residing at 2803 Buxton Court in Harrisburg, Pennsylvania 17110. 2. Defendant, Alan K. Barrick, D.M.D., is and was at all times mentioned in this plead1ng a general dentist licensed as such under and by virtue of the laws of the Commonwealth of Pennsylvania, w1th his principal office and chief place of business at 1902 Bridge Street in New Cumberland, Cumberland County, Pennsylvania 17070. 3. From the time ehe was a child until and including April 1993, Plaintiff was examined by and under the dental care and traatment of the Defendant. 4. During Defendant I s treatment of Plaintiff, Defendant became aware that Plaint1ff's permanent teeth never properly matured and Plaintiff I s upper and lower jaws contained sign1ficantly less than a full set of permanent teeth. 5. In June of 1988, Plaintiff requested of Defendant fabrication and installation of prosthetic devices in the form of crowns and bridges for her upper jaw. 6. Defendant undertook and completed crown and bridgework installation in the upper jaw of the Plaintiff on or about June 1, 1988, for which Plaintiff paid Defendant. 7. On or about October 1, 1990, Defendant undertook and completed the task of repairing Plaintiff's existing teeth with crowns and bridges on her lower jaw necessary to give to give Plaintiff a full complement of teeth. 8. Defendant's negligence in rendering the aforementioned dental care to Plaintiff includes the following: a. failing to perform proper testing and investigation prior to fabricating the reconstruction of Plaintiff's crown and bridgework for her upper and lower jaws; 2 \ \ b. failing to perform proper crown and bridgework procedures and to utilize appropriate orthodontic, prosthetic and periodontic methods and techniques in performing the crown and bridgework that he performed on Plaintlff; c. failing to properly and safely locate and install the crown and bridgework as is described above; d. failing to instruct Plaintiff as to the proper care of the crown and bridgework subsequent to its installation; e. falling to obtain approprlate consultation, assistance or advice from specialists in the field, including perlodontists, prosthodontists, orthodontlsts and oral surgeons; f. failing to warn Plaintiff of the risks inherent in and attendant to the installation, management and maintenance of a full crown and bridgework such as was installed in Plaintiff's mouth; 3 g. falling to remove or recommend removal and replacement of the defectively fabricated and installed crown and bridgework in a timely fashlon when Defendant knew or should have known wi thin a reasonable period of time that the crown and bridgework in Plaintiff's mouth posed an unreasonable risk of harm in the form of poor dental health to Plaintiff; and h. faillng to perform proper and adequate follow- up care to Plaintiff after the lnstallation and fabrication of the crown and bridge work referred to above. 9. As the direct and proxlmate result of Defendant'. negligence as described in the preceding paragraph, a. there exist open marglns, where the crown of the tooth does not meet the tooth properly on seven (7) of Plaintiff's teeth; b. crown margins on five (5) of Plaintiff's teeth are short and do not extend to the prepared tooth: c. the current prosthesis is extremely bulky and is not appropriately functlonal in terms of tooth contour, shape or quality of porcelain. d. ginglval margins are irregular, being lIluch higher on one side of Plaintiff's jaw than the other, making the teeth on the right side appear much shorter than those on the left side of Plaintiff's mouth; e. Plaintiff's overjet is three (3) millimeters, and her overbite is approxlmately thlrty-five percent (354'), creating a therapeutic Class I occlusion; f. during intercuspation, Plaintiff's teeth first hit together on the left side. then deviate to the right side; g. the horizontal occlusal plane of Plaintiff's reconstruction is considerably hlgher on the left side than on the right side of her mouth: h. ln an anterior-posterior occlusal plane, Plaintiff has little, if any, curvature; 4 i. Plaintiff's mandlbular midline is approximately three (3) millimeters to her left, and her maxillary midline is centered approximately two (2) mlllimeters to her right; j. Plaintiff has slgnificant RC-IC slip of two (2) millimeters vertically and two (2) millimeters horizontally, signifying that her occlusion is not reproducible; k. Plaintiff suffers from edge-to-edge occlusion on her left side, where teeth #13 and #14 should meet with teeth #19 and #21, respectively: and 1. the implant performed at Defendant's direction bears undue stress as a result of the design of the above-described bridge work performed by Defendant. 10. As the dlrect and proximate result of Defendant's negligence as described in Paragraph 8 and due to the defects and deficiencies described above ln Paragraph 9, Plaintiff has suffered serious, substantial and irreparable injury, in that: a. she now suffers and has suffered from dental caries, present on the palatal, lingual and cervical aspects of four (4) of her teeth along the margins of the crowns; b. she suffers from ginglva1 inflammation; c. she suffers from temporomandibular joint pain; d. she has been unable to keep her prosthesis clean; 5 e. she suffers from periodontal sensitivity in many areas in and around her mouth; f. she is constantly endangered by the fact that bacterial invasion under the crown of the lncompletely sealed margins will eventually result in decay to and subsequent loss of the prepared tooth lying under each of the faulty crowns; g. she suffers from and is at rlsk for more severe symptoms of muscular spasms and temporomandibular joint dysfunction; and h. she suffers from bone loss in the area in and around the implant placed ln her jaw at the Defendant's direction. 11. As a result of Plaintiff's oral, dental, prosthodontic, periodontic and orthodontic problems, all of which are the direct and proximate result of Defendant's negligence, Plaintiff's dental health requires a multi-discipline approach utilizlng a prosthodontlst, a periodontist, an orthodontist and an oral surgeon to completely repeat the prosthodontic treatment provided by the Defendant. 12. The remedial treatment to which Plaintiff must submlt is descrlbed in a treatment plan prepared by the medical care provlders of P1aintlff's selection, a true and correct copy of which is set forth in Exhlbit A hereto and is incorporated herein by reference. 6 13. According to Exhibit A, the cost of the procedure described therein will exceed forty-five thousand dollar. ($45,000.00) and will entail as many as thirty-three (33) months to complete. 14. The treatment referred to in Paragraph 11 and described in Exhibit A requires Plaintiff to submit to multiple and heretofore otherwise unnecessary oral, surgical, periodontic, prosthodontic or orthodontic procedures, seriously interfering with her normal lifestyle and her ability to maintain employment and creating a great deal of inconvenlence and aggravation to and for the Plaintiff. 15. As a result of Defendant's negligence as set forth above and as a natural and normal consequence of the necessary treatment to which Plalntiff must submit to cure the injuries caused by Defendant's negligence, Plaintiff has suffered and will continue to euffer regularly from physical pain and discomfort, mental anguish and emotional distress. 16. As a result of Defendant's negligence as set forth above, Plaintiff has suffered in the past and will continus to suffer in the future from a loss of the abllity to attend to her daily functions and needs, as well as a loss of life's pleasures. 17. As a result of Defendant's negligence 8S set forth above and as a natural and normal consequence of the treatment 7 .. referred to above in Paragraph 11 and described in Bxhibi t A, Plaintiff has suffered in the past and will continue to suffer a lost of earnings and earning capacity. t . WHEREFORE, Plaintiff demands judgment against Defendant in an amount in the excess of twenty thousand dollars ($20,000.00), together with costs and any other relief that this Court deems appropriate. COUNT II BREACH OF EXPRESS AND IMPLIED WARRANXY 18. Plaintlff incorporates by reference the allegations contained in Paragraphs 1 through 17 above as those set forth herein at length. 19. Defendant has expressly and impliantly warranted to Plaintiff the prostheses which were designed, fabricated and manufactured by him and which was sold to Plaintiff and installed in her mouth as merchantable, fit and safe for human implantation and oral utilization and was effective for their intended use. 20. The prosthetic fabrications implanted and installed in Plaintiff's mouth are unsafe, unmerchantable and unfit for human utilization and have been and wlll continue to be injurious to Plaintiff. 8 21. Defendant was aware that Plaintiff was relying on Defendant's skill and judgment to design, fabricate, manufacture and install in Plaintiff's mouth the prosthetic devices, in the fcrm of crown and bridgework, as safe and effective for their intended use. 22. Defendant has breached the implied warranties of merchantability of the crown and bridgework that he designed, fabricated, manufactured and installed for Plaintiff because the crown and bridgework is not fit for its ordinary, intended purpose. 23. As a direct and proximate result of Defendant's breach of the express and implied warranties of merchantability and fitness, Plaintiff was caused substantial injury and damages, as is set forth above. WHEREFORE, Plaintiff demands judgment against Defendant in an amount in excess of twenty thousand dollars ($20,000.00), together with costs and any other relief that this Court deems appropriate. COUNT III NEGLIGENT MISREPRESENTATION 24. Plaintiff incorporates by reference herein the allegations contained in Paragraphs 1 through 23 above as those set forth herein at length. 9 , , 25. Defendant, in designing, fabricating, manufacturing, promoting, selling to Plaintiff and installing the crown and bridgework which is currently installed in Plaintiff's mouth a. safe and fit for human utilization. made material misrepresentations to the Plaintiff. 26. Defendant failed to warn Plaintiff of the danger. associated with improper and faulty crown and bridgework after Defendant knew or should have known of the dangers associated with the physlcal appearance of the crown and bridgework of the Plaintiff, thereby negligently misrepresenting that Plaintiff's crown and bridgework was safe and fit for its intended use, representing instead to Plaintiff that the cement used to attach Plaintiff's prosthesis settled unevenly. 27. Defendant's misrepresentations described in Paragraph 26 above induced Plalntiff to forego alternative treatment, which alternative treatment included the replacement or augmentation of the crown and bridgework performed upon her by Defendant. 28. Admltted in part; denied in part. It is admitted that Dr. Barrlck undertook and completed crown and bridge work installation ln the upper jaw of the Plaintiff. It is denied, however, that this was undertaken and completed about June 1, 19BB. On the contrary, it was undertaken and completed in September and October of 1987. 7. Admitted in part; denied in part. It is admitted that Dr. Barrick undertook and completed the fabrication and lnstallation of crowns and brldges ln the Plaintiff's lower jaw. It is denied, however, that thls was undertaken and completed on October 1, 1990. On the contrary, the work began on October 6, 1990 and was completed on November 20, 1990. B. This is a dental malpractice action which was commenced by the flling of a Wrlt of Summons on June 21. 1995. 2. A complalnt was filed on Aprll 19, 1996. 3. Plalntiff, Kathryn D. Beachy (hereinafter "Mrs. Beachy"), alleges that from the time she was a child untll and lncludlng Aprll 1993, she was examined by and under the dental ., 0( . . care of Dr. Barrick. Mrs. Beachy's permanent teeth never properly matured and her upper and lower jaws contained significantly less than a full set of permanent teeth. (plalntiff's Complaint ~ 4). 5. In June of 198B, Mrs. Beachy requested that Dr. Barrick fabrlcate and install prosthetic devlces in the form of crowns and bridges for her upper jaw. (plaintiff's Complaint ~ 5). 6. Mrs. Beachy alleges that on or about June 1, 1988. Dr. Barrick undertook and completed crown and brldgework installation in Mrs. Beachy's upper jaw, (plaintiff's complaint ~ 6). 7. Mrs. Beachy alleges that on or about october 1, 1990, Dr. Barrick undertook and completed the task of repairlng her exlsting teeth with crowns and brldges on her lower jaw necessary to glve her a full complement of teeth. The applicable statute of limitations for Mrs. Beachy's cause of action is 42 Pa.C.S.A. 55524(2) whlch stateB, "The following actions and proceedings must be commenced within two years: An action to recover damages for injurles to the person or for the death of another individual caused b~ the wrongful act or neglect or unlawful vl01ence or negligence of another." (emphasls supplied) 10. The statutory perlod begins to run "as soon as the right to institute and maintain a suit arises; lack of knowledge, mistake or misunderstanding do[es] not toll the running of the statute of limltations." Summary Judgment may properly be entered in favor of a defendant when the plalntiff's cause of actlon ls barred by the statute of llmitations. It is antlcipated that Mrs. Beachy wlll argue that the statute of limitatlons has been tolled by the "dlscovery rule." 16. The dlscovery rule provides that where the exlstence of the injury is not known to the complaining party and such knowledge cannot reasonably be ascertalned within the prescribed statutory perlod, the limitations period does not begln to run untll the dlscovery of the injury is reasonably posslble. Colonna v. Rice at 4-5, 664 A.2d at 980, citina Schaffer v. Larzelere, 410 Pa. 402,406, 189 A.2d 267,270 (1963). 17. The fact that an individual plaintiff may have lacked knowledge of hls or her lnjury ls 'irrelevant," "the statute is tolled only if a reasonable person ln the plalntiff's posltlon would have been unaware of the salient facts." IB, The evidence produced during discovery clearly demonstrates that a reasonable person ln Mrs. Beachy's posltion would have known of the salient facts of her alleged injury more than two years prior to the flling of this lawsuit, 19. Dr. Jere I. Zarkln, D.M.D., Mrs. Beachy's employer from late 1991 until early 1992, was deposed and testifled as to the followlng concerning plaintiff's knowledge of the salient facts whlch precipitated the present lawsuit: a) Mrs. Beachy was a dental assistant for Dr. Jere I. Zarkin, D.M.D., from the fourth QUarter of 1991 until the first QUarter of 1992 (Deposition of Jere I. Zarkln, D.M.D., hereto attached as Exhlbit B, page 10, lines 18-20 and page 8, llnes 16-22)/ b) Whlle Mrs. Beachy was employed wlth Dr. Zarkin, she asked hlm to consult her concernlng her dental situatlon (Exhlbit B, page 12, lines 2-7 and page 14, lines 16-19)/ c) Mr. Zarkin informed Mrs. Beachy in some detail that her dental work would have to be redone (Exhibit B, page 13, lines 21-22)/ d) As a dental asslstant. Mrs. Beachy was examined by Bruce D. Kent, D.D.S on December 11, 1992, which was more than two years prlor to plaintiff filing suit. (Deposltion of Bruce D. Mrs. Beachy presented to Dr. Kent with a complaint concerning the occlusal plane of the bridge which Dr, Barrick had fabricated and installed. (~Exhibit B, page 10, 11nes 21-241. 23.
