HomeMy WebLinkAbout02-3964NO LIEN AGREEMENT THIS NO LIEN AGREEMENT IS MADE THIS 12th day of July, 2002, by and between Richard G. and Janice S. Hippensteel, of 452 Centerville Road, Newville, PA 17241, hereinafter referred to as the "Owner", whether one or more; and Morton Buildings, Inc., 3368 York Road, Gettysburg, PA 17325, hereinafter referred to as the "Contractor", whether one or more. WHEREAS, the said Owner is the lawful owner of certain real estate situate at 457 Centerville Rd., Newville, PA 17241, hereinafter referred to as the "Property"; WHEREAS, the said Contractor has undertaken and agreed to perform certain construction work and to provide certain materials necessa~/to erect storage structures on t~ Property; WHEREAS, the said Contractor has entered into agreements with the Owner to perform the aforesaid construction work in connection with the Property. NOW, THEREFORE, THIS AGREEMENT WITNESSETH, That the said Contractor and Owner for and in conside~a~on of the sum of One ($1.00) Dollar to said Contractor in hand paid, the receipt whereof is hereby acknowledged, and further consideration as agreed upon, the Contractor, the Contractor's subcontractors, and all parties acting through or under the Contractor, covenant and agree that no mechanics' lien or liens shall be filed or maintained by them, or any of them, against said storage structures of the Owner situated as above stated, and the plot of ground appurtenant thereto, for or on account of any work done or materials furnished by them, or any of them, under the said contracts or otherwise, for towards, in or about the said construction and work at the storage structures of the Owner, and the Contractor, the Contractor's subcontractors, and all others under them, for themselves, hereby expressly waive and relinquish the right to file or maintain any mechanics' lien or claim against said storage structures and the plot of ground, and agree that this agreement waiving the right of lien shall be an independent contract. Hippensteel, known to me (or satisfactorily proven), to be the persons whose names are subscribed to the within instrument, and acknowledged the foregoing no lien agreement to be their act and deed, anti,desired the same to be recorded as such.
